Question: One witness in Nikah
Assalam u Alaikum
Me and my Faincee enter into nikah in presence of One witness and Quran.
Is Nikah Valid or not?
If incomplete what should we do?

الجواب حامداومصليا

It is necessary that the contract of Nikah takes place in the same Majlis (gathering) with two parties wherein two witnesses are present and they listen to the Offer and Acceptance.

Therefore, with regards to the above scenario your Nikah has not even taken place as there was no offer and acceptance as two witnesses had not listened to this being present in the same gathering.

You must redo your Nikah.

وينعقد متلبسا بايجاب من أحدهما وقبول من الأخر وضعا للمضي الخ وفيه أيضا وشرط حضور شاهدين حرين مكلفين سامعين قولهما معا علي الأصح ملخصا
