| Question: Is it wrong Islamically to collect child support from mother? | |
| I am a divorced father of 4 kids which i raise alone ages 7,6,4,3 for last 3 years. My ex wife doesn't contribute at all.. Initially she had custody and said i will die paying her child support. She also suffers from bipolar, narcissism and emotional instability. She is hostile and uncooperative and has left Islam and careless about her children. Am i wrong to collect child support from her. What does Islam say? | |

In the Name of Allah, The Most Gracious, The Most Merciful The father of the child is solely responsible for maintaining the child [1]; for a female, until she marries [2]; in the case of a healthy male, until he reaches maturity [2]. In the case of a disabled child (male or female) the father is permanently responsible [3]. And Allah Ta’āla knows best

____________________ [1] نفقة الأولاد الصغار على الأب لا يشاركه فيها أحد كذا في الجوهرة النيرة (الفتاوي الهندية، ج ١، ص ٥٦٠، مكتبة رشيدية) [2] الذكور من الأولاد إذا بلغوا حد الكسب ، ولم يبلغوا في أنفسهم يدفعهم الأب إلى عمل ليكسبوا ، أو يؤاجرهم وينفق عليهم من أجرتهم وكسبهم ، وأما الإناث فليس للأب أن يؤاجرهن في عمل ، أو خدمة كذا في الخلاصة ثم في الذكور إذا سلمهم في عمل فاكتسبوا أموالا فالأب يأخذ كسبهم وينفق عليهم ... ونفقة الإناث واجبة مطلقا على الآباء ما لم يتزوجن إذا لم يكن لهن مال كذا في الخلاصة (الفتاوي الهندية، ج ١، ص ٥٦٢-٥٦٣، مكتبة رشيدية) ( وكذا في فتاوي حقانية، ج ٥، ص ٢٥، جامعة دار العلوم حقانية )
ولا يجب على الأب نفقة الذكور الكبار إلا أن الولد يكون عاجزا عن الكسب لزمانة ، أو مرض ومن يقدر على العمل لكن لا يحسن العمل فهو بمنزلة العاجز كذا في فتاوى قاضي خان (الفتاوي الهندية، ج ١، ص ٥٦٢-٥٦٣، مكتبة رشيدية) |
