Asalaamalaikum, Two years back me & my husband had an argument & on being coerced he unintentionally wrote talak 3 times & sent it to me. I had it checked and Mufti saab said in your site that unintentional written talak is not valid. However another Mufti said it should be considered as 1st talak. My husband took me back within the 1 week itself. We have been living like normal husband & wife in these past 2 years whenever we meet as he was staying in Australia & I was in India. However he is now staying with another spanish woman withoot being married to her, we still share husband wife relationship since the past 6 months that I am in this country. Now he wants to give me a court divorce not by shariah law and says its only to terminate the legal marriage that we had in India so he can have a court marriage with her. Will this affect my islamic marriage too. Please can Muftisaab help me as I am very concerned I don't want a divorce for the sake of me 5 year old daughter. Jazzakallah. Misbah

Unintentional written divorce (Talaaq) is valid, no Scholar on this site has written otherwise.

If the party lodging the divorce petition with the County Court is the Husband and he seeks the Judge to rule on a separation and divorce, in such a case the Husband has the right to do so according to the Shari'ah (Islamic Law) since he has the discretion to either personally issue the divorce or he may depute someone to do so, thus it will be as though he has deputed the Judge to issue the divorce on his behalf. In the case of deputing someone it is not necessary for the appointed person to be Muslim nor is it necessary to have witnesses to observe such an appointment. Thus by the Judge divorcing the woman it will be effective and after her Iddat (waiting period) she can marry anyone else. There is no need to formally attain a divorce in the Islamic manner.

Court Divorces consist of two elements:

1)Decree Nisi (divorce notice)

2)Decree Absolute

The Decree Nisi does not result in a divorce becoming effective. However once the Decree Absolute is issued a divorce is effective from that very moment and Iddah will be calculated from that very moment on that particular date.

There are three types of divorce in Islam:

Talaq Raj'i: Revocable divorce

Talaq Baain: Irrevocable divorce

Talaq Mughallazah: Three divorces

Each one of these divorces has its own independent ruling.

The Decree of divorce issued by a court in the UK commonly has the following wording:

Be dissolved unless sufficient cause be shown to the Court within six weeks from the making thereof why the said decree should not be absolute, and no such cause having been shown, it is hereby certified that the said decree was on the .......... made final and absolute and that the said marriage was thereby dissolved. Dated...........

By this decree Talaq Bain (Irrevocable divorce) will become effective. The ruling regarding irrevocable divorce is that the marriage is terminated and that the husband cannot revoke the divorce, however if the couple wish to live as husband and wife again they will have to remarry.

If they no longer wish to live as husband and wife the woman can then, after the Iddah (waiting period), marry another man. [1]

پہلى صورت تو يہ ہے كہ كاؤنٹى كورٹ ميں دعوى دائر كرنے والا فريق مرد ہے اور جج سے جدائى اور طلاق دينے كا مطالبہ كرتا ہے تو اس صورت ميں شوہر كو طلاق دينے كا شرعاً حق ہے، اس لۓ يہ حق وه خود استعمال كرسكتا ہے يا كسى دوسرے كو اس حق كے لۓ وكيل بهى بناسكتا ہے، تو گويا كہ اس نے جج كو وكيل بنايا كہ آپ ميرى طرف سے ميرى بيوى كو طلاق دے ديجۓ، وكيل بنانے كى صورت ميں وكيل كا مسلمان ہونا ضرورى نہيں، مسلم اور غير مسلم دونوں وكيل بن كر يہ كام كرسكتے ہيں- نيز وكيل بناتے وقت گواہوں کى بهى ضرورت نہيں ہے؛ لہذا جج كے طلاق دينے سے عورت پر طلاق واقع ہوجاۓ گى اور عدت گزارنے كے بعد وه دوسرى جگہ نكاح كرسكتى ہے، اب اسلامى طريقہ پر مزيد طلاق حاصل كرنے كى ضرورت نہيں ہے-

اسلامى طلاق كى تين صورتيں ہيں:

ايک تو طلاق رجعى، دوسرے كو طلاق بائن اور تيسرے كو طلاق مغلظہ كہتے ہيں، ہر ايک كا حكم الگ الگ ہے، يہاں كورٹ سے جو طلاق كا مضمون لكها جاتا ہے اس ميں غالباً يہ الفاظ ہوتے ہيں: (جيسے اوپر مذكور)

اس عبارت كا خلاصہ يہ ہے كہ:

ابهى تک كوئى معقول وجہ بتائى نہيں گئ ہے اس لۓ گزشتہ جو حكم ديا گيا تها اسى حكم كو حتمى طور پر نافذ كيا جاتا ہے اور نكاح كو بلكليہ ختم كيا جاتا ہے-

اس لۓ طلاق بائن واقع ہوجاۓ گى اور طلاق بائن كا حكم يہ كہ اس سے نكاح كا تعلق ختم ہوجاتا ہے، مرد كو رجوع كرنے كا حق نہيں رہتا؛ ليكن دونوں پهر سے مياں بيوى كى طرح رہنا چاہتے ہيں تو نۓ سرے سے نكاح كر كے ره سكتے ہيں، حلالہ كرنے كى ضرورت نہيں ہوگى، اگر دونوں مياں بيوى كى طرح رہنا نہيں چاہتے تو عورت عدت گزار كر دوسرى جگہ نكاح كرسكتى ہے-

Decree Nisi سے طلاق واقع نہيں ہوتى؛ البتہ جس وقت اور جس تاريخ كو Decree Absolute يعنى حتمى فيصلہ لكها جائے گا اس وقت سے طلاق واقع ہوگى، اور عدت بهى اسى دن اور اسى وقت سے شمار ہوگى-
