Thanks to sister bint_azam of sunniforum;

This lecture took place in Hydrabad in 2007, and is aimed at adressing scholars.

Brought to you by the Hanafi fiqh channel-Taking you to the source.

The lecture is 2 1/2 hours so obviously this is not even a portion of all that he said.

Some important points by Mufti Saheb in the full video:

The ikhtilaf between Madhabis and ghair Muqallids/Salafis is not in masails but in Usool. Even if you give them the answer for one masala, they will bring thousands more, because the books are full of ikhtilaf. 80% of ikhtilaf came from Sahaba, only about 20% was from the 4 Imams. From the Sahaba, the ikhtilaf was in masail, and from the 4 imams, the ikhtilaf was for illat of masail (i.e establishing the proof for the masail) and then from there it branched out to the smaller masail based on illat.

Hadith - The Ikhtilaf of my Sahaba is Rahmat (mercy) for the Ummat So where is the rahmat? Nowadays, it's all fighting. The answer is that the rahmat is the 4 imams.

So the ikhtilaf of the 4 imams is rahmat, while the ikhtilaf with ghair muqallids, maududis, is the ikhtilaf of haqq and batil.

Whenever there is a major problem, then the 4 madhabs are looked at to solve the problem - the by-pass. But this "by-pass" cannot be done by just anyone. Then deen would become like garbage.

Example: When many Muslim men became lost during British rule, war, then the issue arised about the women whose husbands had disappeared and there was not trace of them. Because in hanafi madhab, the women's marriage remains with husband and she cannot get married again. So the ulama were apprehensive about what would happen to the women, who would take care of them, and to save them from haram. So Mawlana Thanvi gathered all the ulama of the country to consult them. After consultation, they decided to use Imam Malik's opinion that after a set number of years, the woman's divorce will automatically take place and she can remarry.

In Haram Shareef, Shaykh Humaid was asked that in Hajj a woman is menstruating but her group is leaving, she can't stay and she can't do tawaf ziyarah. Shaykh answered, in this, Imam Abu Hanifa (radi Allahu anhu)'s view has room for this. She can make tawaf ziyarah and then give damm of a large animal. And the shaykh said "radi Allahu anhu"

But this sort of by-pass cannot be done by just anyone, or any alim. All of the ulama were gathered and consulted, and only then it was accepted. And now the fatwa in India is based on this ruling.

Similarly, in Haram Shareef, Mufti Humaid gave

One of the ghair muqallid/salafi Luqman Azami has written that making one hanafi into ghair muqallid is more rewarding than making 100 hindus into muslims.

So if someone says that what about all the fights between the 4 madhabs in history, and there have been some big fights. The answer is that these fights were not to discuss masail, but it was fights to get the government seats and authority because there were Islamic government in those times. Now there aren't Islamic government, so no more fights. Saudi is all Hanbali, they don't hire non-Hanbali so no fight there.

Techniques of the batil: Ghair Muqallid They use Abu Hanifa vs. Rasullullah (SAWS) they'll never say Abu Hanifa vs. Shafi or Malik or Hanbal so obviously how can anyone hold on to Imam Abu Hanifa

Mawdudis They say "Ittihad, Ittihad - Unity, Unity" What they mean is you be quiet and let us say whatever we want. Your saying is creating division

If this is called unity, that you can't call a "wrong", wrong then that is not unity. Then the prophets are the first ones to create division, because before the prophets calls, their entire nation was united under kufr. But prophets said that this is wrong and it created division.

these people will never discuss "Usooli differences" - they will keep discussing "Masail" differences. Tell them leave the discussion rafa yadain, fatiha... let's talk about usool, but the ulama e haqq need to prepare for this.

Just some of the main usooli differences: We are Ahlus Sunnah and they are Ahle Hadith

1) Is Hujjat (proof) Sunnah or Hadith? If it is Hadith, then give us a Sahih Hadith that tell us to hold on tight to Hadeeth. While there are many ahadith telling us to hold on tight to Quran and Sunnah.

2) Is Hujjat (proof) Saheeh and Daeef Hadith or just Saheeh Hadith? Ahlus sunnah say that Saheeh and daeef will be used as proof, but saheeh has greater rank. When there is no saheeh hadith, then daeef hadith will be used.

Hadeeth and Sunnah are not the same. There is a huge difference between the two

Hadeeth is the name of 3 things: 1) Aqwal - sayings 2) Afaal - actions 3) Taqreerat - taeedat 4) Zaati Awsaf (his description, hair, height)

Sunnah - is at-tareeqatul maslukatul fid deen The path which the Muslims must walk on.

The relationship between the two is "aam khas min wajhin" (gathers eg white and animal white cow - is both white and animal black cow - is an animal but not white white cloth - is white but not an animal

Some some things are sunnah but not hadith Some things are hadith but not sunnah Many things are both Sunnah and hadith

Hadith which are mansukh are hadith but not sunnah For example, talking during Salat was allowed but it was abrogated. (Tirimidhi) But the hadith is still there, but it is not sunnah.

For Ahle Hadith, Daeef hadith means Mawdoo (fabricated) hadith. Their shaykh Nasiruddin Albaani caused such a great harm to this ummah, by writing a book and he titled it "Silsilatul Ahadeeth ul daeefa wal mawdua wal atharuha saaiyye" His title equates daeef (weak) and mawdua (fabricated) ahadith as same indicating that daeef and mawdua hadeeth are same and both are harmful. He has made this mindset of the people that daeef hadith means fabricated. The arab youth have become greatly affected by it. As soon as you say something to them, they say this hadith is weak, and what they mean by it is that this hadith is mawdoo (fabricated)

He was a big scholar. The leaders of every deviant group are always very intelligent and sharp. That's why people follow them. But intelligent doesn't mean anything, because the Shaitan is more intelligent and sharper than these people. Most important is whether people are guided by their knowledge or getting deviant. He also divided Abu Dawud into two parts - Saheeh and daeef.
