10. Doing Wudu because of Madhy [Prostatic Fluid]


42. Imam Malik رحمه الله informed us: "Salim Abu'n-Nadr رحمه الله, the mawla of Umar ibn Ubaydullah ibn Mu'ammar at-Taymi رحمه الله, informed me from Sulayman ibn Yasar رحمه الله from al-Miqdad ibn al-Aswad رضي الله عنه, that Ali ibn Abi Talib رضي الله عنه told him: to Ask the Messenger of Allah (صلى الله عليه وسلم) about what a man should do who approaches his wife and madhy [prostatic fluid] issues from him; for it is his daughter with me and I shy away from asking him.' Al-Miqdad رضي الله عنه said, 'So I asked him and he said, "If one of you finds that, let him wash his private parts with water and do wudu in the same way as for the prayer."'"

43. Imam Malik رحمه الله informed us: "Ziyad ibn Aslam رحمه الله informed me from his father رحمه الله, that Umar ibn al-Khattab رضي الله عنه said, 'I find it falling from me like small beads, so when one of you finds that let him wash his private parts and do wudu in the same way as for the prayer.'"

Imam Muhammad رحمه الله said: "We accept his [report]; he should wash the site of the madhy and do wudhu as he does for the prayer. That is the verdict of Abu Hanifa, may Allah have mercy on him."

44. Imam Malik رحمه الله informend us: "As-Salt ibn az-Zuyayd رحمه الله informed us that he asked Sulayman ibn Yasar رحمه الله about some wetness which he sometimes experienced and he said, "Sprinkle what is under your garment [with water] and forget about it."

Imam Muhammad رحمه الله said: "We adhere to this, should it happen a great deal to a person and shaytan plague him with doubt concerning it; and this is the verdict of Abu Hanifah, may Allah have mercy on him."

11. Doing Wudu' With Water From Which Predatory Animals Drink And Lap


45. Imam Malik informed us: "Yahya ibn Sa'eed رحمه الله informed us from Muhammad ibn Ibraheem ibn al-Harith at-Taymi رحمه الله from Yahya ibn 'Abdur Rahman ibn Hatih ibn Abi Balta'ah رحمه الله, that 'Umar ibn al-Khattab (رضي الله عنه) rode out in a group among whom was 'Amr ibn al-'Aas (رضي الله عنه), until they came to a pond, whereupon 'Amr (رضي الله عنه) said, 'Companion of the pond, do predators come down to your pond?' Whereupon 'Umar ibn al-Khattab (رضي الله عنه) said, 'Companion of the pond, don't tell us, for we come down to water after predators and they come down after us.'"

Imam Muhammad (رحمه الله) said: "If the pond is very large such that when the water on one side of it is disturbed, the ripples do not reach the other side, then no predatory animal which laps from it or filth which falls in it befouls that water, unless it causes its smell or taste to change. If the pond is small such that when the water on one side of it is disturbed the ripples reach the other side, then when predators lap from it or filth falls in it, it should not be used to do wudu. It should be noted that 'Umar ibn al-Khattab (رضي الله عنه) did not want him [the owner of the pond] to tell him about it and prohibited him from doing so; Imam Abu Hanifa's verdict is in accordance to all of this, may Allah have mercy on him."

12. Doing Wudu' With Sea Water


46. Imam Malik رحمه الله informed us: "Safwan Ibn Sulaym رحمه الله narrated to us from Sa'eed Ibn Salamah Ibn al-Azraq رحمه الله from al-Mughirah Ibn Abi Burdah رحمه الله from Abu Hurayrah (رضي الله عنهم), that a man asked the Messenger of Allaah (صلى الله عليه وسلم) saying, 'We go to sea taking only a little water with us; so if we do wudu with it we will go thirsty. Shall we do wudu with sea water?' The Messenger of Allaah (صلى الله عليه وسلم) said, 'Its water is pure and its dead are halaal.'"

13. Wiping Over Leather Socks (Khuffain)

47. Malik informed us: "Ibn Shihab az-Zuhri informed us from 'Abbad ibn Ziyad from one of the children of al-Mughirah ibn Shu'bah (رضي الله عنهم), that the Prophet (صلى الله عليه وسلم) went to relieve himself during the expedition of Tabuk. He [al-Mughirah - رضي الله عنه] said, 'So I went with him, carrying some water.' He continued, 'Then the Prophet (صلى الله عليه وسلم) came and I poured [the water] for him. He washed his face, and then he tried to bring out his arms but he could not, due to the narrowness of the sleeves of his long robe-like outer garment [jubbah]; so he brought them out from under his outer garment and washed his arms and wiped his head and wiped over the leather socks [khuffain]. Then the Messenger of Allah (صلى الله عليه وسلم) came and 'Abdur Rahman ibn 'Awf (رضي الله عنه) was leading them, having already made one prostration with them, so the Messenger of Allah (صلى الله عليه وسلم) prayed with them and then prayed the remaining rak'ah. So the people were alarmed at that. Then he said to them, "You have done well.""

48. Malik informed us: "Sa'id ibn 'Abdur Rahman ibn Ruqaysh (رضي الله عنهم) narrated [this] to us. He said, 'I saw Anas Ibn Malik (رضي الله عنه) come to Quba'. He urinated, and then water was brought and he did wudu'. He washed his face and his arms to the elbows, wiped his head, wiped over his leather socks, and then prayed.'"

49. Malik informed us: Nafi' and 'Abdullah ibn Dinar narrated to us that 'Abdullah ibn 'Umar came to Sa'd ibn Abi Waqqas (رضي الله عنهم) at Kufa, and he was then its governor. 'Abdullah (رضي الله عنه) saw him wipe over leather socks and he reproved him for it, so he said to him, 'Ask your father when you see him.' But then 'Abdullah (رضي الله عنه) forgot to ask him until Sa'd (رضي الله عنه) arrived and said, 'Did you ask your father?' He said, 'No.' So 'Abdullah asked him and he [Umar - رضي الله عنه] said, 'If your feet were in a state of purity when you put the leather socks on, then wipe over them.' 'Abdullah (رضي الله عنه) said, 'Even if one of us has just returned from relieving himself?' He said, 'Even if one of you has just returned from relieving himself.'

50. Malik informed us: Nafi' informed me, that Ibn 'Umar (رضي الله عنهم) urinated at the market and then did wudu'. He washed his face and arms and wiped his head. Then, he entered the mosque, he was called to someone's funeral that he might pray [the funeral prayer] for him, so he wiped over his leather socks and then prayed.

51. Malik (رحمه الله) informed us: Hisham ibn 'Urwah informed from his father, that he saw his father (رضي الله عنهم) wipe over leather socks on their upper sides, without wiping ther under sides, then lift his turban and wipe his head.'

Imam Muhammad (رحمه الله) said: "We adhere to all of this, and it is the verdict of Imam Abu Hanifa (رحمه الله). We are of the opinion that wiping may be done by a resident for a day and a night, and by a traveller for three days and nights. Imam Malik (رحمه الله) said that a resident should not wipe of leather socks, whereas the majority of these reports which Imam Malik (رحمه الله) narrated concerning wiping are concerned with none other than residents, and then he said a resident should not wipe over leather socks."

14. Wiping Over The Turban And The Headscarf


52. Malik (رحمه الله) informed us: "A report reached me from Jabir ibn 'Abdullah (رضي الله عنه), that he was asked about [wiping over] the turban and he said, 'No, not without the water touching the hair.'"

Imam Muhammad (رحمه الله) said: "We adhere to this; it is the verdict of Imam Abu Hanifa (رحمه الله)."

53. Malik (رحمه الله) informed us: "Nafi' (رضي الله عنه) narrated [this] to us. He said, 'I saw Safiyyah bint Abi 'Ubayd (رضي الله عنها) doing wudu', she pulled off her headscarf then wiped her head.' Nafi' (رضي الله عنه) said, 'and I was a young boy at the time.'"

Imam Muhammad (رحمه الله) said: "We adhere to this; the headscarf should not be wiped over, nor the turban. It has been narrated to us that wiping over the turban was practised, then abandoned. This is the verdict of Imam Abu Hanifa (رحمه الله) and our fuqaha' in general."

15. Ghusl Because Of Sexual Intercourse Or Ejaculation (Janabah)

54. Malik (رحمه الله) informed is: "Nafi' (رضي الله عنه) narrated to us that when Ibn 'Umar (رضي الله عنهما) did ghusl after sexual intercourse or ejaculation, he would pour water onto his right hand and wash it, then wash his private parts, then rinse his mouth, blow water out from his nose, wash his face and sprinkle water in his eyes; he would then wash his right arm, then his left, then wash his head, then wash himself all over, pouring water over his skin."

Imam Muhammad (رحمه الله) said: "We adhere to all of this, except the sprinkling of water in the eyes, for that is not incumbent upon the people where sexual intercourse or ejaculation [janabah] is concerned; and that is the verdict of Imam Abu Hanifa (رحمه الله), Imam Malik (رحمه الله), and [our] fuqaha' in general."

16. Concerning A Man Who Has Sexual Intercourse Or Experiences Ejaculation (Janabah) At Night


55. Malik (رحمه الله) informed us: "'Abdullah Ibn Dinar (رحمه الله) informed us from Ibn 'Umar (رضي الله عنه), that 'Umar (رضي الله عنهما) mentioned to the Messenger of Allaah () that he had sexual intercourse or experienced ejaculation [janaabah] at night. He said, 'Do wudu, wash your penis and sleep.'"

Imam Muhammad (رحمه الله) said: "And were he not to do wudu', nor wash his penis before he sleeps, then there is no harm in that either."
