240. Imaam Maalik رحمه الله informed us: "Az-Zuhree رحمه الله narrated to us from Abu Salamah Ibn 'Abdur Rahmaan Ibn 'Awf رضي الله عنه, that the Messenger of Allaah صلى الله عليه وسلم used to encourage people to stand for prayer in Ramadaan, without making it an obligatory command, saying, 'Whoever stand for prayer, for the month of Ramadaan, out of conviction and deliberation, will be forgiven whatever wrong actions he has committed.'
Ibn Shihaab said, 'So the soul of the Prophet was taken leaving the matter as it stood, and the matter remained like that during the khilaafah of Sayyiduna Abu Bakr as-Siddeeq رضي الله عنه, and up to the beginning of the khilaafah of Sayyiduna 'Umar رضي الله عنه.'"

241. Imaam Maalik رحمه الله informed us: "Ibn Shihaab رحمه الله informed us from 'Urwah Ibn az-Zubayr رحمه الله from 'Abdur Rahmaan Ibn 'Abdin al-Qaariyy رحمه الله, that he went out with Sayyiduna 'Umar Ibn al-Khattaab رضي الله عنه, one night in Ramadaan, and found the people seperated in groups, one man praying, and a few praying with him.
Sayyiduna 'Umar رضي الله عنه said, 'By Allaah, I believe that if I gathered these behind one reciter it would be more fitting.'
Then having made up his mind, he gathered them behind Sayyiduna Ubayy Ibn Ka'b رضي الله عنه. I went out with him on another night, while the people were in prayer with their reciter and he said, 'What an excellent innovation this is! That during which they sleep is more meritorious than that during which they stand,' meaning the latter part of the night. The people were standing for the first part of it."
Imaam Muhammad رحمه الله said,
"We go according to all of this; there is no harm in praying in the month of Ramadaan, the people praying voluntarily with an Imaam, for the Muslims have already decided upon that and they regard it as good. It has been narrated from the Prophet صلى الله عليه وسلم that he said, 'That which the believers regard as good is - with Allaah سبحانه و تعالى - good. That which the Muslims regard as ugly is - with Allaah سبحانه و تعالى - ugly."
73. The Excellence Of Praying Fajr In Congregation, And The Matter Of The Two [Voluntary] Rak'ahs Of Fajr
243. Imaam Maalik رحمه الله informed us: "Ibn Shihaab رحمه الله informed us from Abu Bakr Ibn Sulaymaan Ibn Abi Hathmah رحمه الله that Sayyiduna 'Umar Ibn al-Khattaab رضي الله عنه missed Sulaymaan Ibn Abi Hathah رحمه الله in the Subh prayer. Sayyiduna 'Umar رضي الله عنه went out early in the morning to the market - and the dwelling of Sulaymaan رحمه الله was between the market and the mosque - so he passed by Sulaymaan's mother, ash-Shifaa' رحمها الله, and said,
'I did not see Sulaymaan in the Subh prayer.'
She said, 'He retired for the night, praying, and sleep overcame him.'
Sayyiduna 'Umar رضي الله عنه said, 'That I attend the Subh prayer is preferable to me than that I stand a night in prayer.'"
244. Imaam Maalik رحمه الله informed us: "Naafi' رحمه الله informed us that Sayyiduna Ibn 'Umar رضي الله عنهما informed him that Ummul Mu'mineen Hafsah رضي الله عنها, the wife of the Prophet صلى الله عليه وسلم, told him that when the mu'adhdhin for the dawn prayer went silent and the dawn appeared, the Messenger of Allaah صلى الله عليه وسلم would pray two brief rak'atayn before the prayer was held."
Imaam Muhammad رحمه الله said:
"We adhere to this; the two rak'atayn before the prayer of Fajr should be made brief."
245. Imaam Maalik رحمه الله informed us: "Naafi' رحمه الله informed us that Sayyiduna 'Abdullah Ibn 'Umar رضي الله عنهما saw a man pray the two [voluntary] rak'atayn of Fajr and then lie down. Ibn 'Umar رضي الله عنهما said, 'What is he doing?' Naafi' رحمه الله said, 'I said, "He is making a separation between his prayers." Ibn 'Umar رضي الله عنهما said, "And what separation is better than saying 'as-salaamu 'alaykum'?"'"
Imaam Muhammad رحمه الله said, "We adhere to the verdict of Ibn 'Umar رضي الله عنهما; it is the verdict of Imam Abu Haneefah, may Allaah have mercy on him."
