56. Shortening The Prayer On Journeys


190. Imam Malik رحمه الله informed us: "Salih Ibn Kaysan رحمه الله informed me from 'Urwah Ibn az-Zubayr رحمه الله that [Ummul Mu'mineen] 'Aa'isha [Siddeeqa bint as-Siddeeq رضي الله عنهما, the beloved of Rasoolullah صلى الله عليه وسلم and the Mubarraah Minas-Samaa' (the lady whose vindication has been declared in the skies through divine revelation)] said, 'The Prayer was made obligatory, each prayer two rak'atayn, whether travelling or resident, then the prayer of residence was added to and the prayer of travelling was confirmed as it was.'"

193. Imam Malik رحمه الله informed us: "Ibn Shihaab az-Zuhri رحمه الله informed me from Saalim Ibn 'Abdillah رحمه الله that Ibn 'Umar رضي الله عنهما went out to Reem and he shortened the prayer on that journey."

194. Imam Malik رحمه الله informed us: "Naafi' رحمه الله narrated to us that he used to travel with Ibn 'Umar رضي الله عنهما the distance of approximately twelve miles [bareed], and he would not shorten the prayer."

Imam Muhammad رحمه الله said:

"When the traveller goes out, he should pray the complete prayer, unless he intends a journey of three whole days, travelling at a camel's pace or walking pace. If he intends that, he should shorten the prayer when he goes out of his city and leaves the houses behind him. And that is the opinion of Imam Abu Hanifah, may Allaah have mercy on him."

195. Imam Malik رحمه الله informed us: Ibn Shihab رحمه الله narrated to us from Salim Ibn 'Abdillah رحمه الله from Ibn 'Umar رضي الله عنهما that he said, 'I pray as the traveller prays as long as I have not decided in advance upon a stay, even though it should detain me for twelve nights.'"

Imam Malik رحمه الله informed us: "az-Zuhri رحمه الله narrated to us from Salim Ibn 'Abdillah رحمه الله from his father رضي الله عنه, that when Sayyiduna 'Umar رضي الله عنه came to Makkah, he would pray two rak'atayn with them and then say, 'People of Makkah, complete your prayer, for we are a people on a journey.'"

197. Imam Malik رحمه الله informed us: "Naafi' رحمه الله informed us that Sayyiduna Ibn 'Umar رضي الله عنهما would reside at Makkah for ten [days], and would shorten the prayer, unless he attended the prayer with the people, when he would pray as they prayed."

Imam Malik رحمه الله informed us: "Hisham Ibn 'Urwah رحمه الله informed us that he asked Salim Ibn 'Abdillah رحمه الله about the traveller who does not know when he is leaving, saying to himself, 'I will leave today, no, I will leave tomorrow, no [I will leave] now,' and so on, until many nights passed him by. Should he shorten [the prayer], or what should he do? He said, 'He should shorten, even if he were continue in that state for a month.'"

Imam Muhammad رحمه الله said:

"We are of the opinion that the prayer should be shortened once the traveller enters a city even if he is resolved to stay, unless he is resolved to stay for fifteen or more days. Once he is resolved upon that, he should complete the prayer."

199. Imam Malik رحمه الله informed us: "Ataa' al-Khurasani رحمه الله told us [this]. He said: 'Sa'eed Ibn al-Musayyab رحمه الله said, "Whoever decides in advance upon a stay of four days, let him complete his prayer."'"

"We do not adhere to this. The traveller should shorten the prayer until he determines upon a stay of fifteen days; that is the verdict of Ibn 'Umar رضي الله عنهما, Sa'eed Ibn Jubayr رحمه الله and Sa'eed Ibn al-Musayyab رحمه الله."

"We adhere to this if the Imam is resident and the man is travelling. It is the verdict of Imam Abu Hanifa, may Allah have mercy on him."
