19. Tayammum With Dust

71. Imam Malik (رحمه الله) informed us: "Nafi' (رضي الله عنه) informed us that he had come up from al-Jurf with 'Abdullah Ibn 'Umar (رضي الله عنهما). When he reached al-Mirbad, 'Abdullah Ibn 'Umar (رضي الله عنهما) got down and did tayammum with pure earth and wiped his face and his arms to the elbows, and then prayed."

72. Imam Malik (رحمه الله) informed us: "'Abdur Rahman ibn al-Qasim (رحمه الله) informed us from his father that Ummul Mu'mineen 'Aa'isha (رضي الله عنها) said, 'We went out with the Messenger of Allah (صلى الله عليه وسلم) on a journey and when we reached al-Bayda or Dhat al-Jaysh, my neckless broke [and was lost]. The Messenger of Allah (صلى الله عليه وسلم) halted to look for it, and the people halted, with no water nearby and no water with them. The people came to Abu Bakr (رضي الله عنه) and said, "Do you not see what 'Aa'isha (رضي الله عنها) has done; halted the Messenger of Allaah (صلى الله عليه وسلم) and the people, with no water nearby and no water with them?"'

She (رضي الله عنها) said, 'Abu Bakr (رضي الله عنه) arrived while the Messenger of Allah (صلى الله عليه وسلم) was sleeping with his head on my thigh. Abu Bakr (رضي الله عنه) said, "You have detained the Messenger of Allah (صلى الله عليه وسلم) and the people, with no water nearby and no water with them."'

She (رضي الله عنها) said, 'He reproved me and said whatever Allah (سبحانه و تعالى) willed him to say, and started jabbing me in the hip with his hand; the only reason I didn't move was because I had the head of the Messenger of Allah (صلى الله عليه وسلم) on my thigh. The Messenger of Allah (صلى الله عليه وسلم) slept until morning and he was without water, and so Allah (سبحانه و تعالى) sent down the ayah of tayammum. They performed tayammum and we performed tayammum; hence it was that Usayd Ibn Hudayr (رضي الله عنه) said, "It is not the first of your blessings, family of Abu Bakr (رضي الله عنه)."'

She (رضي الله عنها) said, 'We roused the camel which I had been on, and we found the neckless underneath it.'"

Imam Muhammad Ibn al-Hasan (رحمه الله) said: "We adhere to this. Tayammum requires two light blows: one for the face and one for the arms to the elbows; that is the verdict of Imam Abu Hanifa (رحمه الله)."

20. A Man's Having Sexual Intercourse With His Wife Or Lying Skin To Skin With Her During Her Mentrual Period

73. Imam Malik (رحمه الله) informed us: "Nafi' (رضي الله عنه) informed us that 'Abdullah Ibn 'Umar (رضي الله عنهما) sent to Ummul Mu'mineen 'Aa'isha (رضي الله عنها) asking her, 'May a man be skin to skin with his wife during her mentrual period?' She (رضي الله عنها) said, 'She should tie her izar [the large cloth wrapped around the lower half of the body] around her lower body, then he can lie skin to skin with her if he wants.'"

Imam Muhammad Ibn al-Hasan (رحمه الله) said: "We adhere to this; there is no harm in doing that. That is the verdict of Imam Abu Hanifa (رحمه الله) and our fuqaha' in general."

74. Imam Maalik (رحمه الله) informed us: "A man I consider trustworthy informed us that Salim Ibn 'Abdullah (رضي الله عنهما) and Sulayman Ibn Yasaar (رضي الله عنه) were asked whether the husband of a woman in period may have sexual intercourse with her once she has seen that she is clean, but before she does ghusl; they said, 'No, not until she does ghusl.'"

Imam Muhammad Ibn al-Hasan (رحمه الله) said: "We adhere to this; a woman in her period should not be made love to, in our opinion, until the prayer is allowed for her or is incumbent upon her. That is the verdict of Imam Abu Hanifa (رحمه الله)."

75. Imam Malik (رحمه الله) informed us: "Zayd Ibn Aslam (رضي الله عنه) informed us that a man asked the Prophet (صلى الله عليه وسلم), 'What part of my wife is permissible to me while she is in her period?' The Prophet (صلى الله عليه وسلم) replied, 'She should put on her izar [the large cloth wrapped around the lower half of the body], then your concern is with her upper half.'"

Imam Muhammad (رحمه الله) said: "This is the verdict of Imam Abu Hanifa (رحمه الله). Something easier than this has come from Ummul Mu'mineen 'Aa'isha Siddeeqa (رضي الله عنها), who said, 'He should avoid the place of blood, and he may have whatever else.'"

21. When The Two Places Of Circumcision Meet, Is It Incumbent To Do Ghusl?

76. Imam Malik (رحمه الله) informed us: "az-Zuhri (رحمه الله) informed us from Sa'eed Ibn al-Musayyab (رحمه الله), that 'Umar (رضي الله عنه), 'Uthman (رضي الله عنه) and Ummul Mu'mineen 'Aa'isha Siddeeqa (رضي الله عنها) used to say, "When the place of circumcision touched the place of circumcision, doing ghusl is obligatory."

77. Imam Malik (رحمه الله) informed us: "Abu'n-Nadr (رحمه الله), the mawla of 'Umar Ibn 'Ubaydullah (رحمه الله) informed us from Abu Salamah Ibn 'Abdur Rahman (رحمه الله), that he asked Ummul Mu'mineen 'Aa'isha Siddeeqa (رضي الله عنها) what makes doing ghusl obligatory, and she (رضي الله عنها) said, 'Do you know what your likeness is, Abu Salamah? Like the chick: when it hears the cocks crow, it crows with them. When the place of circumcision passes the place of circumcion, doing ghusl has become obligatory.'"

78. Imam Malik (رحمه الله) informed us: "Yahya Ibn Sa'eed (رحمه الله) narrated to us from 'Abdullah Ibn Ka'b (رحمه الله), the mawla of 'Uthman Ibn 'Affan (رضي الله عنه), that Mahmood Ibn Labeed (رحمه الله) asked Zayd Ibn Thabit (رضي الله عنه) about the man who has sexual intercourse with his wife and then flags [does not ejaculate]. Zayd Ibn Thabit (رضي الله عنه) said, 'He should do ghusl.' So Mahmood Ibn Labeed (رحمه الله) said to him, 'But 'Ubayy Ibn Ka'b's (رضي الله عنه) opinion is that there is no [obligatory] ghusl.' So Zayd Ibn Thabit (رضي الله عنه) said, "He retracted [this opinion] before he died.'"

23. A Woman Sees In Her Sleep What A Man Sees, [i.e. She has a nocturnal emission]

81. Imam Malik (رحمه الله) informed us: "Ibn Shihab az-Zuhri (رحمه الله) informed us from 'Urwah Ibn az-Zubayr (رضي الله عنه), the Umm Sulaym (رضي الله عنها) said to the Messenger of Allaah (صلى الله عليه وسلم), 'Messenger of Allaah (صلى الله عليه وسلم), a woman sees in her sleep what a man sees. Should she do ghusl?' and the Messenger of Allaah (صلى الله عليه وسلم) said, 'Yes, let her do ghusl.'

So Ummul Mu'mineen Hadrat 'Aa'isha Sideeqa bint as-Siddeeq (رضي الله عنها) said to her, 'Woe to you! And does a woman see that?' So the Messenger of Allaah (صلى الله عليه وسلم) turned to her and said, 'May your right hand be covered in dust! So from where will the resemblance come?'"

Imam Muhammad Ibn al-Hasan (رحمه الله) said: "We adhere to this; it is the verdict of Imam Abu Hanifa (رحمه الله)."

24. A Woman With Extra-Long Mentrual Bleeding

82. Imam Malik (رحمه الله) informed us: "Nafi' (رضي الله عنه) narrated to us from Sulayman Ibn Yasir (رحمه الله) from Ummul Mu'mineen Hadrat Umm Salamah (رضي الله عنها), the wife of the Prophet (صلى الله عليه وسلم), that there was a woman in the time of the Prophet (صلى الله عليه وسلم), who used to have blood [continuously] flow from her. Umm Salamah (رضي الله عنها) asked the Prophet (صلى الله عليه وسلم) about it on her behalf and he said, 'Let her look at the nights and days she used normally to bleed in the month before what happened to her happened, and so leave the prayer that much every month. When that much has passed her by, let her do ghusl then trust herself with a cloth and pray.'"
