Abstract

A certain Mufti claims that the images appearing on Television and Digital Media are not Images in terms of the Shari'ah. He has also extended an invitation to be guided on this issue. In response thereto this treatise discusses why such images are impermissible. The Explicit Texts from the Ahadith are first presented as a backdrop to the specific issue of these new forms of imagery. The Mufti's analogy with a reflection of the mirror is explained, and it is shown why these new forms of imagery do not resemble a mirror reflection. Islamic Law Semantics is applied to the question on hand and it is demonstrated why the Ahadith apply to modern imagery. The possible relevance of Qiyaas is considered, with special reference to the requirements of the 'illah, and it is established that even if Qiyaas applies, it would confirm the prohibition of such modern imagery. The fact that a Mufti can err is dealt with, and a supporting fatwa is presented to support the assertion.

Author: Mufti Emraan Vawda

I recently learned that Mufti Emraan is also the cousin and son-in-law of Maulana A.S. Desai, according to Maulana Huzaifah (Hafizahumu-llaah).

On the Books page and the Books section on the MuftiSays Android app, the download option is taking the user to the sunniforum HTML webpage rather than the PDF link.. can this please be fixed?

Jazaakumu-llaahu khayran.

Not exactly sure what you mean, but for me its taking me to a dropbox link and starts to download. I haven't tried it from the app though, just from the link above for the books page.

I'm talking about this, the box that says HTML:

The other books in the list correctly have the PDF box, for some reason the system thought that the sunniforum link in my post was the link to the book. In the same way on the MuftiSays app, if you click on this book, it asks you if you want to download the HTML of the sunniforum web page I linked to. I hope that's more clear.

I don't think that's even a thread, the system truncated the thread name from the sunniforum link and it takes you to a non-functional web page.

(P.S. I see you have caught on to the underline-link trend. I was thinking about posting the suggestion to the forum, because without the underline, the font color of links makes it difficult to distinguish from normal text)

Possibly because you have 2 links in the OP.

I just tried removing the sunniforum link from the OP.

For those looking at the thread in the future, the last line was originally:

"I recently learned that Mufti Emraan is also the cousin and son-in-law of Maulana A.S. Desai, according to Maulana Huzaifah (Hafizahumu-llaah)."

So now the HTML has been removed, but there is no download icon. Next step would be to PM admin with a link to here and explain the situation, inshaAllah that will rectify the issue.

3. The act of creating, i.e. producing something from nothing, is the exclusive
preserve of Allah . Therefore the image-maker is attempting to imitate
Allah  in respect of one of His exclusive attributes. This is akin to shirk
(polytheism), hence the gravity of this sin.

pg. no. 11

Have not read the full book yet. But I've a question. Long time back I read in a book that watching TV is shirk cos of images. Later on I found out that book was of brailvis, but brailvi too follow hanafi madhhab. Is there really anything like this in hanafi madhhab or is it just brailvis fatwah?

As-salamu alaikum sister, I've read the fatwa you posted but I don't get the answer, I mean it's certinaly an impermissable act ok, but is it shirk/kufr or not? I don't think the mufti gave a clear answer about this question, because there are many other things in islam that are impermissible but not kufr and shirk, and the mufti mentioned only that tv is impermissible, didn't he?!.. or is it me who didn't get the answer?! can somebody clarify this better, please? Jazak Allahu Khiar.

wa `Alaykumus Salaam. I am a male.

The `Ulamaa' in the link did not say that watching television is necessarily shirk or kufr. Thus, one can say that those actions are worse than the act of watching television, although neither are permissible.

I had actually read the fatwah you posted before posting my Q, I thought by 'watching shirk or kufr on tv' the questioner meant watching people doing acts of shirk or kufr e.g worshiping idols etc. I mean, watching a film for entertainment whilst people do acts of shirk or kufr in it.

But khair, my understanding was wrong.

Jazakallahu khairan.
