In order to disagree with something you need to understand it thoroughly, ask questions try your best. You will make mistakes because you are human but you try your best. Shaykh (Mufti) A.S. Desai (HA) usually gives Fatwaas on Dhaahir Riwayah and the closest example of such a Deobandi Mufti in our times is Shaykh (Mufti) Rasheed Ahmed Ludhyanwi (RA).
Guess what? Shaykh (Mufti) Rasheed Ahmed Ludhyanwi (RA) was also condemened by many Deobandees for being harsh and unreasonable (and still does)...Every Deobandi always says that he is harsh and guess what? Every Deobandi who reads English also says that Shaykh (Mufti) A.S. Desai (HA) is harsh :)
Shaykh (Mufti) Rasheed Ahmed Ludhyanwi (RA) goes to elaborate details about his Fatwaas and reasons while Shaykh (Mufti) A.S. Desai (HA) just sticks to the point.
For the English speakers another example is Shaykh (Maulvi) Mohammad Yusuf Al-Kindi Hanafi Makki who is also solidly on Dhahir Riwayah.
All 3 of these Ulamah generally and almost exclusively rely on Dhaahir Riwayah. The other common trait in all 3 of these Ulamah is SOLID "Al-Wala Wal-Bara'...Not many Western Ulamah come even close to Shaykh (Mufti) A.S. Desai (HA) for speaking Haqq at the cost of personal safety and he has proved it by even going to Jail but not backing down for his stance!
You may disagree with the Fataawa of Shaykh (Mufti) A.S. Desai (HA) but you CANNOT refute or rebuke him publicly when he is on Dhaahir Riwayah while other Ulamah (whom you are following are not) that's unfair, unjust and shows shallowness of your knowledge in Fiqh.
Where I have disagreed with Shaykh (Mufti) A.S. Desai (HA) in 2-3 things is in matters where he has departed from this Manhaj done Ijtehaad and also gone on a different path to other Ulamah of Deoband.
As I say one cannot argue or refute him simply because he disagrees with other Ulamah; that's just plain foolish.
Shaykh (Mufti) Hussain Kadodia (HA) has gone to great lenghts on Sunniforum to explain why Dhaahir Riwayah isn't always Mufti Bihi opinion (i.e. upon which Fatwa is given), nevertheless it's a rock solid classical approach of many Ulamah.

This cannot be undone and I am sure it will be greatly appreciated.
