Brother Arsalan, please do not post the answer yet. Just give us members some more time. I have a book on inheritance somewhere in the house. Unfortunately I do not think I have ever read through it properly. But your question has just lit the spark inside me and I am first going to try and find it and see if I can figure it out.

A31) Brother Arslan. let brother Malak check this (below) with his calculations first insha'Allah when he gets a chance to do it and then once he lets us know here, let us know if it is correct:

base = 24

portions distributed as follows:
24 x 1/8 = 3 to wife
24 x 1/6 = 4 to mother
24 x 1/6 = 4 to father
24 x 2/3 = 16 to daughters (each getting equal amounts)

Total portions = 27

If, after all debts and bequests (to strangers) are paid out $100 remains, it would be distributed as follows:

$100 / 27 portions = $3.70 per portion

$3.70 x 3 portions = $11.11 to wife
$3.70 x 4 portions = $14.80 to father
$3.70 x 4 portions = $14.80 to mother
$3.70 x 16 portions = $59.20 to daughters (each receiving $29.6 since there are only 2)

Very little residue remains and even less if calculated without rounding. Not sure where it would go.

Father remaining wealth


So...... according to my calculations if you were to add the above totals the answer would be 15/24 which would leave the father with 9/24 i.e. 3/8 (the remaining wealth).

I hope I am not miles off!

There is no residue. All portions add up to 27. We use the exact figures, not the rounded ones. There cannot even be a question of residue since the shares of each heir add up to more than 1. Residue only remains when the heirs do not exhaust all the estate.

Malak: The Father needs to get his obligatory share of 1/6th. Then he gets the residue (if there is any).


Good job both of you and brother naqshband. Since sister Acacia ultimately got the correct answer, she should ask the next question insha'Allah.

SubhanAllah, it was a brain buster for me and a nice exercise to get digging into books. You have no idea... I recalled a talk by shaykh Kamaluddin that covered this and tried to find the part where he gave an example but nope, was not able to. Then I opened up Ma'ariful Qur'an and that's where I got my first answer from (it doesn't go into the detail that was required to answer your question). When that didn't work... had to use google but looked for a book that would explain it properly. Insha'Allah, alhamdulillah I learned a lot. JazakAllah khayran for the opportunity brother Arslan.

Okay... brother Naqshband66, since you took a stab at it first, I would like to offer my turn to you insha'Allah.

Fiqh is a very delicate subject, therefore, laymen shouldn't use it in a trivia game (at least) because it might lure us to self education, consequently emergence of brand new Mufti, Mujtahid etc.......

I'm of 3 opinions on this issue Maria canim:

(1) I agree with brother Black Turban that it is a very delicate subject for the reason he has specified; however

(2) as long as we are asking a question based on a reliable sources then insha'Allah these are matters we all should get to know to some degree... so, in that sense, I agree with you sister in that - in this thread, for the intention of sharing beneficial knowledge, it should be okay; and finally

(3) we need to be very mindful of the rules on MS and protect not only ourselves but also our brothers and sisters from doing something that could potentially hurt our akhirah.

Insha'Allah the question brother Arslan. chose was fine (in my opinion). He knew the answer and had the source before he asked masha'Allah. The question was challenging (for me) yet it was relevant to us all in one way or another (i.e. we all face death and various types of inheritance issues).

Now, if a member was to use this thread to try to solicit answers to a question they don't have an answer to... well, then I would say it is a big problem and a bit of a fitnah since it would be deceptive.

Insha'Allah we'll avoid fiqhi questions to level the field a bit and let everyone comfortably contribute.

As for self education etc. It'd depend upon the intention. I don't think anyone here would take it that way. Amen.

Why are there so many discussions on this thread.....this thread is on the light side for a purpose, please continue with the trivia game. Please leave Fiqh for the scholars, and try and enjoy the purpose of this thread جزاك الله خيرا
