Allah is my witness that I have not slandered you. You are very quick to accuse people of slander, I've noticed. Its easy to play the victim card Hadhrat.

Hazrat (HA),

Do I have the Islamic right to ask as to where I have slandered or even mentioned you? Do the rules of Shariah only apply to me or you too (to some extent)? If you can show me your name or referrence I would be most grateful.

If you can't then why is it "These Brothers" didn't make anybody else jump? Could it be presumption on your part?

Asslamo Allaikum,

Original Fatwa of about the Kuf'r of Shaykh (Maulana) Tariq Jameel (HA) [dated around October 2013]:

Question

I think you heard about Maulana Tariq Jameel of the Tabligh Jamaat. He went to a Shiah Masjid and prayed there, ate food with them and took pictures with them. Then he invited them to the Tabligh Ijtima and some came. He says that they are not kaafir. He also says some negative things about the Sahaabah who were not of the Ahl-e-Bait. My Shaikhul Hadith (in Pakistan) is ready to issue the fatwa of kufr on Maulana Tariq Jameel. Please comment.

Answer

We do not know who this chap Tariq Jameel is. However, we have been hearing lately of his vile and haraam antics. If what you have attributed to this character is correct, then undoubtedly, he is a bedfellow of the kuffaar Shiahs. When your Shaikhul Hadith issues the necessary Fatwa, do forward a copy to us.

The Majlis, Vol 22 No 3, pg. 3

Clarification issued [11JAN2014]

Please feel free to discuss further.

The point I was making is very clear:

  1. A South African Alim is saying that he DOES NOT even know someone called Tariq Jameel [sic], he omits the name "Maulana" and not me
  2. And YET issues a Fatwa that he is bedfellow of Kuffar!

Its indeed difficult to accept this.

Maulana Tariq Jameel is a wellknown Tablighee Maulana.
Anyone heard his incidents in Madina Munawarrah?

Our Beloved Rasool Allah Sallahu Alaihi Wassalam sent Salam to him!
(Twice, thats how much i know, there may be more )

And, Maulana Tariq Jameel, Mufti Taqi Usmani and Maulana SaleemUllah Khan Sahab are the head of Bait Us Salam Madrassa and few days ago there was His ( Maulana Tariq Jameel s) bayan at the Musjid.

Sister, you are studying to be an Alimah and someone asks a fatwa about you saying you are an "Alima". They omit:

  1. All titles of respect and honour and refer to you as a "Girl"
  2. Admit that they know nothing about you at all
  3. Believe the email and issue a Fatwa with a "IF"

Does respecting an "Alim" only applies when comes to Shaykh (Mufti) A.S. Desai (HA) when I disagree with him or should he also respect other Ulamah?

And what is his excuse for calling a South African Alim a "Reverend"? Should I call you a "Nun" or a "Pandit" or whatever???

Does Islam have standards which apply to everyone OR just to some people?

Hadhrat, I apologize for thinking you meant me and Deoband by "These brothers". Although, I will hold my belief that this was an understandable mistake on my part. Even though you refused to clarify to me what you meant by "these brothers" over PM, I will leave the matter to Allah and apologize from my side.

Please forgive me for any errors I've made.

Your brother in Islam.

salaam

is it acceptable in the shariah to pass fatwa of kufr or fatwa of suspicion of kufr on a muslim without properly investigating the matter?

Generally, whenever there is doubt in something resulting in disbelief or not, the Fuqahā' do not issue a fatwa of disbelief. Instead, the Fuqahā' state that if there are 70 clear reasons to issue a fatwa of disbelief upon someone and 1 vague and unclear reason to prove he is a believer, the Muftī must issue a fatwa of the person being a believer and disregard the 70 clear reasons.[3]
