Pakistan appoints first female judge to sharia court

Pakistan's national sharia court, which hears cases under the country's Islamic legislation, on Monday appointed a female judge for the first time in its 33-year history.

Ashraf Jehan, 56, who was serving as an additional judge at the high court in southern Sindh province, made history as she took the oath in Karachi.

"It was a historic oath-taking ceremony today when an able lady judge had joined the Shariat Court," Agha Rafiq Ahmed, the chief justice of the Federal Shariat Court of Pakistan, told AFP.

The court was established in 1980 during the rule of military dictator Ziaul Haq as part of a sweeping Islamisation of Pakistan's institutions.

It examines the country's laws to check them for conformity with Islamic injunctions and hears appeals under religious legislation known as the "Hudood Laws", which run parallel to the penal code.

"There was no bar in the constitution to make a woman the judge of Shariat Court and there is no discrimination between men and women," Ahmed said.

The chief justice of the Shariat Court, who rarely speaks to the media, said he was pleased to comment on an historic moment.

"I took the initiative as it would send the message in the world that we are enlightened people and would dispel many misconceptions," he said.

I'm not suprised that Pakistan is doing this. I wouldn't be suprised if the next step would be to allow women to lead men in Salaat in Pakistan.

just my thoughts...

they have started doing this in the west along with their new found drive for ultra feminism and homosexuality, but i doubt they would push this agenda in pakistan on a grand scale. i dont think the pakistani people are conditioned enough to accept such a thing. at the moment it seems that the push is more towards modernism in pakistan leading to a dilution of the islamic creed. once (if) they believe that the islamic creed has been compromised enough in pakistan, then they will push similar agendas as those in the west.

In relation to the dilution of Islam in Pakistan, going back to/tying into another thread, is it the government that is looking at importing Islamic educational models from Turkey then? That would do it (unfortunately).

Bro, you don't know how upsetting that is to hear about this crazy woman imam. But then again I know of a place in manhattan where pseudo Sufis go to make five Salaat, khanqah thikr and jumuah. Thinking it to be a masjid, I went inside one day years ago to attend jumuah. I saw a woman giving the athan and men and women praying together shoulder to shoulder. I just walked out of the place disgusted.The ummat is doomed if it doesn't reform.

Pakistan has the nuclear bomb and now a female shariah judge but they have no sewer systems or a basic developed infrastructure. their people live in poverty all over the country but they are worried about being modernized and civilized according to the west who would like the ummat to adopt gay marriage law and other filth that they deem liberating. Authubillah.

السلام عليكم

Being Male is indeed one of the obligatory qualifications of a Qadi (Judge).

Appointing a Female judge in a Shariah court in itself is against the Shariah. It like appointing a non muslim as a qadi, its invalid.

  1. Ashraf Jehan (judge of Shariah court) doesn't wear Hijab
  2. Agha Rafiq Ahmed (Chief Justice of Supreme court i.e. her Boss) doesn't have a beard according to the Madhab!

What the heck will they rule on?

In Umdat us Salik(shafi text) the first qualification mentioned is 'Male Freeman'.
As you mentioned even if they were following the Hanafi rulings, they still do not qualify. I believe being 'upright' is another qualification for a Qaadi.

It seems that this move is to appease the westerners.
