Only Muslims and Dhimmis are protected by law and their killing is called murder which is a very big sin as the Qur'an says. All others are not protected and their killing is this not such a big sin. It might be a big sin to kill a non-Muslim non-Dhimmi without a reason but in this case of an apostate (anyway) who supposedly insulted the Prophet it would be a minor sin at best (or better worst).
Also the situation depends on whether we have an Islamic state or an infidel apostate state like Pakistan. In the first case the sin is vigilante justice. In the second it might be invalid action of Jihad. It MIGHT be.

Scholars tell people not to do these things extrajudicially, But if done, we can't condemn them like conventional killers. Here is a News Panel discussion at the time of Taseers remarks what is clear that Taseer rather then acting out of some humanitarian concerns was acting at the behest of America who at the time were putting pressure on Pakistan to repeal Blasphemy laws. youtu.be/HJcLpOdcOTo

Here are the remarks of the late Maulana Ishaq an ahle Hadith Scholar concerning the family background of Salman Taseer and His Father and their anti_Islam views , Maulana Ishaq was regarded as being moderate and Pro-Barelvi and Pro-Shia ..... youtu.be/E0gBda2HIvQ

At the time this incident happened doing research into this Taseer character their were photos of Taseer chilling in a Swimming Pool at a resort with his grown up daughters dressed in Bikinis, there are also photos of his daughters dancing and partying, at university.... This is how the enlightened and progressive Salman Taseer lived his life and the kind of lifestyle and liberal Islam he wanted to promote in Pakistan....His son Aatish Taseer wrote that his father dranked scotch Whisky and openly ate pork.

Note: Just doing further research there are photos of Salman Taseer and his fellow rich people along with their families at a party with bottles whisky and wine openly sitting on the dining table. With glasses filled to the brim in front of them.

Justice (r) Nazeer Ahmed says that punishing Qadri rh is unlawful because when a person commits murder, law asks about the provoker, and in this case the provoker was Salman himself. So Qadri's rh hanging is unjustified.

Someone asked me about this 2 days ago and they had an opinion. I told them that since this concerns the honor of Sayyidina (Rasul-ullah) Sallallaho Alaihe Wassallam) save your Eeemaan and remain quiet.

It is not required for anyone to issue a Judgement on this. In every sense and purpose a Muslim should obey the Law but when it comes to the honor of Sayyidina (Rasul-ullah) Sallallaho Alaihe Wassallam) Shariah does make an exception if someone gets emotional and riled up (even due to a misunderstanding). He will be punished but Qadhi will look at the circumstances (and the misunderstanding)

We simply cannot discuss this in detail here.

The Shaykh of Islam, Ibn Taymiyyah (may Allah be merciful to him), said the following in his book "Al-Sarim Al-Maslul `ala Shatim Al-Rasul" p. 3:
Quote:
"The first issue: Those who revile the Prophet (peace be upon him), whether a Muslim or Kafir, must be killed. This is the view of the majority of scholars."

Mullah Muadh Khan, we have to make distinction between the Islamic laws that are binding for an Islamic state which you mentioned and those for an infidel state like Pakistan. There is no Qadi in an infidel state. We cannot talk about this the same way we talk about the rules in an Islamic state. This is a matter of Jihad and not justice.

Allah knows best what is the best stance. But one thing that i can see from this whole episode, that it has turned out to be a double edged sword. Two targets have been shot with one arrow.

1. An open abuser to this deen and potentially to our beloved Prophet S.W, met his fate

2. If Qadri was openly declared a super hero and pardoned with flying colors, this could have huge implications on the super emotional, polarized Pakistani nation. This would set a new acceptable tone in the masses. Next thing you would see ahle hadeeth, deobandis getting openly shot, why because they supposedly uttered something, which was gustakhi of Rasool. Or for that matter other liberal secular people as well. So this is how things could spiral out of hand.

Please maintain respect for each other and Ulamaa (if topic is about a scholar) by avoiding accusations and slanderous comments. Also remember that in order for criticism to be constructive, it must be channeled in the right direction. If there is any doubt in a matter, it is better to ask, clarify or to remain silent rather than to speak ill of another person.

The reason people of Pakistan are behaving in this manner is due to two reasons:

If you followed Pakistani Media you would note that those protesting had very legal and straightforward demands as follows...

a) If Raymon Davis can be pardoned so can Mumtaz Qadri

b) If Assiya Bibi who is convicted then appealed and still convicted can have her death sentence curtailed by a memorandum (last appeal on 26/Mar/16) then the same precedence should have been applied to Mumtaz Qadri.

Nobody denies that he killed someone, if you listen to legal and Fiqh arguments they have sound basis in Pakistani legal framework.

What you see at his Janazah Salah is outpouring due to Justice being denied.

Both under Shariah and Pakistani constitution there is ample provision for his Death sentence to have been overturned to a Life Sentence. <<< This is the final position of Legal Experts..
