News has just come in that one police officer was a muslim.....I love islam but not the actions of the kuffar who always feel they can provoke us until they get a reaction from someone, and when it happens THEY play the victim. Stop bashing ISLAM full stop, WE don't bash any Prophet [AstaghfirULLAH] so who gives them the right to do it. ONLY ALLAH knows to what extent we are allowed to protect the honour of our LAST PROPHET SallALLAHU Alayhi Wassallam....we as muslims should pray for this ummah because it seems to me that NOT is all as it seems. THESE Governments always have a playing hand in these type of incidents...[my opinion].

May ALLAH protect this ummah and help us all follow the Quraan and Sunnah correctly and may we all be saved from the fitnas of this dunya Aameen

But if you do not have this power, and it is evident that you do not, then have Sabr. In the position of weakness ,if you do what you are doing, and undergo harm , you won’t be able to withstand it. And one should not launch oneself into harm that you are unable to withstand , or that causes you great affliction,.

Q:In the ayah of Jihad it says “Min Quwwatin” , and it is nakirah(indefinite). And we do have the power to goto jail etc.

Shaykh (Maulana) Ashraf Ali Thanwi (RA): This is not the intended meaning of power. What is meant is that where there is harm to your enemy and no *certain* harm to yourself

Q: There is no harm in going to jail. And it causes agitation to the enemy, so what’s the harm?

Shaykh (Maulana) Ashraf Ali Thanwi (RA): If Qudrah was this then we have the power today to spit upon the enemy, and this causes them discomfort , but because we understand that in fact this causes us harm, we do not do so. …. What is meant by Qudrah is causing the enemy certain harm and not causing oneself certain harm , and it is obvious that going to jail is a harm to yourself and of no real harm to the enemy.

Listen well. There are two types of Qudrah.

  1. We have the power to do a certain task but after doing it we do not have the power to withstand the negative consequences that result.
  2. We have the power to do the task and we have the power to successfully ward off the harms that will result when we undertake it.

The first condition is called ISti’taat Laghwiya and the second is isti’taat Sharriya’. And for self defence to be waajib the first type of isti’aah is not enough, the second type of isti’taah is the condition. The following hadeeth clarifies

Man ra’a mikum munkaran fal yu ghayyirhu be yaddi’ f aillam yasta’ti fa bi lisaani fa illam yastati fa bi qalbi

Well, it is evident that everybody has the power to address munkar with the tongue at all times. So when will the situation come when we are unable to do so?

If it was enough to have the physical ability to do it for it to be fardh , and being able to defend oneself from the negative consequences that would result is not a condition, Then to address munkar with the tongue would be Fardh in all times and places. (because we all have the physical power to waggle our tongues)Then what would it mean for the Prophet(saw) to say that if you don’t have the power to change it with your tongue, then hate it with your heart? This proves isti’taah means that as well as having the physical power to do it, there is no danger that one faces harms that one would be unable to repel (As far as normal cause and effect expectation and prediction goes)
Another condition is that after this defence a greater evil does not result .

Q Then what options remain to help the muslims of Kashmir

Shaykh (Maulana) Ashraf Ali Thanwi (RA): Go there. Make tableegh, and call them to unite amongst themselves. And when you have the power(as detailed above) then QItal is permissible

Q But they stop us at the gates, and arrest us. They don’t even let us in

Shaykh (Maulana) Ashraf Ali Thanwi (RA): So you tell me if this is the condition then how do you expect to help them? You don’t even have the Qudrah to reach there. The multitudes end up being caned, end up in jails and on hunger strikes. Hunger strikes are akin to suicide. Even if a benefit results from suicide it’s still not a permissible course of action. What then of suicide where there benefit for anyone? If it becomes known that committing suicide will affect and harm the kuffar , will suicide become permissible? IS going to jail and having hungerstrikes not on a par with suicide? If a benefit becomes apparent from suicide , the act of suicide in itself is such a tremendous harm that has no recompense. Not every supposed benefit is to be relied upon. Its like someone saying , so-and-so’s life will be spared if you jump into a well and drown. So is it permissible for me to jump into the well(NO)

Q So should we fight?

Shaykh (Maulana) Ashraf Ali Thanwi (RA): By all means. But the codition for this is that you have sufficient power and resources that would be expected to conventionally overcome their forces. Mere wishfully thinking that we will win ,so let’s fight- This is not enough.

Q: But fighting entails harm. Is it not greater harm that lives are lost?

Shaykh (Maulana) Ashraf Ali Thanwi (RA): But fighting is an objective and is in our texts so this is not considered a “harm” , but these methods and strategems that you have invented are not from the texts , so they will be closely inspected. The reason for the difference is that the ultimate objective is the removal of fitna. Qital is not a fitna, because the heart is not perturbed in war, and there is an inner tranquillity. But these matters involve tumult and the wastage of great time. When formulating their schemes, people rarely consult Fiqh. Its not enough to just look at fiqh with your own opinions. But you have to look at it with the true taste of a seasoned faqeeh, and in doing this everything becomes crystal clear. The art of Fiqh is very very subtle, which is why I always emphasise erring on the side of caution.

Q : Man Qatala doona Idhahu ma maalahu Fa huwa Shaheed. This establishes the permissibility of forgoing one’s life . Strikes and such like seem to be plausible within in this rubric.

Shaykh (Maulana) Ashraf Ali Thanwi (RA): Qatl does not mean suicide. But it means fighting. In other words Fight. Wage war,. The intention is that you save your possessions and your life. Then if by chance you happen to die, then it is shahadat. Qatl Itself is not maqsood(the end in itself). But if it happens in the course of qitaal, then it is permissible. SO Qitaal not Qatl is permitted and then only if all the conditions for it being allowed are found and none of conditions to make it impermissible are present(and these are delineated in great depth in the works of Fiqh). And Qatl not being maqsood is established in the Quran because everywhere we see Yaqtuluna (with seegha majhool) , after this we see Yuqtaloona (be seegha maroof). So we see yuqtaloona is not maqsood but sometimes results as a side effect of yaqtuluna.

Q: We don’t have the full power(qudrah) . But the little that we do possess, how should we utlise it. After all we ought to do something?

Shaykh (Maulana) Ashraf Ali Thanwi (RA): You can tell me what should be done. I don’t know any better than saying that you should do tableegh and teach them the deen and after that fight. I ask you, after the Hijrah , there was great peril for the lives of some of the muslims who were left in Makkah. The people of madina didn’t send any delegations there. Until the ayahs of qital were not revealed, there was no course of action adopted other than Sabr. This is the only form of Islamic struggle we know, all these other innovations are rejected.

Q Perhaps these matters were not known then . Had it been so wars would have been like this

Shaykh (Maulana) Ashraf Ali Thanwi (RA): It becomes evident these are intellectual constructions rather than revealed things. The sahaba too were men of intelligence. Great matters entered their minds, so why did these things not? Did not one of these strategems occur to them? The only thing that did was Qital and that too only when the verses of Qital came. The questions come that in the course of Islamic history why did no-one come up with these ideas. In 1300 years did not such conditions of oppression manifest, then why did no one suggest these things?

The other thing I would mention is that was there not power in the muslims who were left in Makkah post-hijrah. If you say they didn’t have the power to mount an offensive I say you are absolutely mistaken . They had such power that before it the power of the entire Indian Government is completely overshadowed.


Jihad is also an obligation so does this Fatwa apply to the present situation (of slaying someone) who blasphemes Nabi (Sallallaho Alaihe Wassallam).

The responses in this thread are an excellent example of why present day Deobandis are the most stupid sect of Muslims after Wahabbis. Of course the Prophet (SAW) was going to be harsh against those who insulted Islam and betrayed Muslims, traitors and insults against a newly founded religious community, which Allah had willed and whose existence is a mercy for mankind, would be traitors and insults against the Truth itself. The Prophet (SAW) acted the way he did for the preservation of Islam, when it was in its infancy and was an expression of Divine justice.

But by murdering these 12 people, not only has the whole of France seen the cartoons, the whole world has and rather than non-Muslims thinking that they will stop creating these cartoons, they are now more adamant than ever not to let an attack on their "freedom of expression" be curtailed, with much worse pictures in circulation.

You are a pathetic bunch of anti-intellectual donkeys, who only know to quote from scholars who had no profound understanding of the modern world, it's problems and complexities. Traditional ulema are the custodians of the Islamic tradition and its protectors but you can not quote them to be able to confront the West, criticise and with the sword of the intellect and spirit, answer at it's foundation the challenge with which the West confronts Islam.

The worst thing of all is that, the reponse given by Islamic authorities to challenege the West has for the most part hitherto consisted in the presentation of arguments drawn from transitted or religious sciences (naqli) rather than from the rich intellectual tradition of Islam contained in the traditional intellectual (aqli) sciences.

Religious arguments can be presented only to those who already posess faith. Of what use is it to cite a particular chapter of the Qu'ran to reftute an idea held by someone who does not accept the authorty of the Qu'ran? Nearly all the works written by the ulama in this field can be criticised because they address themselves to deaf ears and present arguments that are of no efficacy in the context in question. This is especially saddening when we consider that the Islamic tradition possesses such a richness and and depth that it is perfectly capable of answering, on the intellectual level, any argument drawn from modern European philosophy and science.

Sort yourselves out and sort the madrassah system out, it's broken - the pseudo division you've created between "secular" and "Islamic" knowledge is going to result in the fall of Islam. You've sold yourselves out for money. Islam is based on tawheed and unity, there is no such thing as "secular" knowledge. In traditional Madrassahs there used to be a unity of knowledge, not this compartmentalisation, that is, a separation of various forms of knowledge, from each other, so that few matters are known in a complete way.

Anyone justifiying the ruthless murder of these 12 individuals - if even one was innocent amongst them - must be nuts. Shedding blood of these 12 men did not benefit Muslims, the Ummah or our beloved Prophet Muhammad (sallallahu 'alayhi wasallam) in any way, shape or form. Yes, they are provoking us. Yes, they are trembling on our sentiments. Yes, they are playing with our emotions. Yes, they are mocking our religion. But do we have to stoop even lower than their level by murdering totally innocent civilians? Does the slogan of Jihad make each and everything permissible? We are in a pitiful state and we need to fix our affairs. Large portions of Ummah are of the opinion that ISIS and their likes are modern day Khawarij. If we are really convinced of this, then is it the duty of Muslims to counter these Khawarij or someone elses? I wish we had the slightest foresight of Hakeemul Ummah (rahmatullah alayh) in Muadh Khan's post earlier.

And by the way our deepest condolences go out to families and friends of any innocent victims, but I personally don't believe in the "Muslims have to condemn & apologize to please non-Muslims" business. Muslims need to face reality, we have a huge - or rather gigantic - dysfunctional Ummah and WE need to fix that as soon as possible! Even minute actions done in this regard will insha'Allah be much appreciated, even if it's just participating in your local Gusht with this intention in mind to fix ourselves the Ummah at large. Although I don't know if this will suffice, but we need to take the head out of the sand and get active.

All government officials (Muslims), issuing derogatory comments on this issue.

Muslims chose them as their representatives but they failed to protect the dignity of Beloved Prophet saww.
In past, they were unable to do "muzammat" of blasphemy but today crying "Muzammat Muzammat ...."!!
I wander what will they answer Allah JJ and his Beloved Prophet saww hereafter.

May Allah ta'ala guide us to the true path.

There are 3 separate Tiers which need to be investigated separately:

  1. Muslim Governments: The Governments (OIC or O! I see) need to take action under their power and control and utilise everything in their power to challenge the situation.
  2. Muslims in Muslim (majority countries): They don’t demonstrate or do anything effective it’s usually a mob of hooligans pelting stones, burnings buildings and cars!  
  3. Muslims as minorities (India etc): You cannot expect Muslims of India to start shooting/killing RSS activists (as vigilantes) and expect no backlash from Indian Government and BJP Government with the full force of Police, military and paramilitary forces.

An argument I have heard in Pakistani (Islamic Media) is that what if someone made fun of Jesus or Obama or Cameron; the issue is that it is done. In the modern Western society sarcasm, caricature, jest is part of life (this may be intentional towards Islam or maybe because they do it to everyone) because that’s what it is…Does every Comedian who is cracking jokes about Terrorism or Bin Laden actually hate Islam? No many of these people don’t really care about anything and are just trying to make money!

The point is how to stop this or minimise it NOT to provoke it or spread it further. Is the media, people and everyone else (after this attack) now discouraged from repeating these provocations or are they more bellicose and bold and ready to take it to the next level where this sort of insults will become common place???

Lastly, our Fiqh and Madhahib are largely a construct of Islamic Caliphate when we were in power and the injunctions deal with two categories of disbelievers:

  1. Harbi: Kaafir at direct or active war with Islam
  2. Dhimmi: Kaafir paying and living under the protection of Islamic Caliphate

My 77 year old disabled white (British) neighbour fits into neither category!

The idea that whoever is not Dhimmi is automatically a Harbi is written in the books of Fiqh from the time of Caliphate but is it applicable for now? Do we really want 80% Hindus of India (backed by Police & Military) turned into Harbees against 20% defenceless Muslims?

Change India to France, Britain, Sweden, whatever...

I don't condemn all forms of curtailing of free speech, either in the USA or abroad. I support the freedom of all people to speak the truth. I don't support the real legal right or supposed moral right for people to mock and lampoon the prophets, upon whom be peace. I do condemn racism, totalitarianism, fascism, injustice, killing innocents, and the like, worldwide and in a balanced way. If the racist French state treats some of its most disenfranchised and downtrodden people in a subhuman fashion, and then they wake up one day, see something they don't like, and scream about it, I don't feel obliged to show it sympathy for a problem it provoked in the first place; they readily provided another hand to complete the clap sounding off this whole matter.

In general, I feel that there is too much violence in this world and it needs more mercy. I also am not so enchanted by the emperor's new clothes that I feel that that mercy is the sole burden of one group to be carried at its expense to benefit the other.
