Due to the strong stance of the main madrasahs pretty much most of the mosques and madrasahs in the uk are united on this issue. Though there'll always be a minority to cause friction and disunity and implicitly cast doubts on the intelligence of the vast majority of ulama. Unity is the most important factor in these difficult times. Shaikh Taha's stance makes sense from a lot of angles.

Please learn the difference between 'identical' and 'similar' before blurting out whatever comes to your mind. If I say that a certain quality or qualities of yours are similar to another person's it doesn't exactly mean that the shape and colour of your nose is the same as that persons.

Now read back carefully over this thread, including Shaykh Taha's exposition on the necessity of taking into account essential factors such as unity and fiqh of minorities before declaring Eid. And if after repeated attempts you still fail to understand where you lost the plot, then simply adopt some humility, acknowledge your own inability, and move on without making such a drama that merely exposes your own limitations.

Unity in itself is not a principle of Islam in any shape, form or fashion. In fact this was one of the arguments of idolaters of Makkah that Nabi (Sallallaho Alaihe Wassallam) had actually broken the unity of Makkah so they proposed a compromise of a sort but Allah (SWT) revealed this!

If an Islamically valid position exists then there is no harm in being “united”. In UK the position to follow Saudi Arabia year round is INVALID position from various different perspectives as follows:

 

  1. Saudi Scholars who oversee and reguilate their own moon sighting DO NOT give a Fatwa for others to follow them in fact their position is OPPOSITE
  2. Saudi moon sighting is only done for Ramadhan and Eidain and rest of the year precalculated Ummul-Qura is followed. If there is moon sighting for 9 months of the year then there is NO SHARIAH ACKNOWLEDGED SYSTEM of informing British Muslims at all!
  3. During the months where actual moon sighting occurs it VIOLATES The principles of Hanafi Madhab of Jame-e-Ghafeer, forget 50 or 500 not even 10 people come forward!
  4. A valid moon sighting needs to conveyed in a valid Shariah ACKNOWLEDGED system as per the Madhab there is NO SUCH SYSTEM in Britain either by Darul-uloom Bury or Hizbul-Ulama
  5. Saudi moon sighting is not only NOT followed in India, Pakistan but actually DENOUNCED as per various Fatawaa. In fact Shaykh (Mufti) Taqi Usmani (HA) writes that if we had confidence in their system then we (in Pakitan) would follow it

Now lets evaluate Shaykh (Mufti) Taha Karaan (HA)'s position:

  • It is the position of Imam Nawawi (RA) to have united Matal'e for a geography where Salah times (and sunrise/sunset) don't vary much which is the dominant position of the Shaf'ae Madhab

Shaykh (Mufti) Taha Karaan (HA) is not TWISTING his Madhab or following a WRONG position for the sake of unity!

Everyone with an ounce of common sense will see the difference and note that there is no similarity between Darul-uloom Bury and Shaykh (Mufti) Taha Karaan (HA) at all!

Simple advice for the laymen - no need to delve into the intricacies of deriving rulings. Just trust the ijtihad of the vast majority of ulama and ignore the incoherent ramblings of the growing number of internet self-styled mujtahids who love to show off and act as if they know something the Ulama don't.

I can’t talk on behalf of others. As for Odeh criteria, there is a refereed published paper about it , so you can refer to it. Odeh criteria shows that it was possible to see the crescent from South Africa on Sunday because there were crescents in past with similar values and they were seen. You can find it in the paper.

Salam Dear Br.

I agree with you, seeing the crescent by naked eye was not possible! The only possibility was seeing it by optical aid and with difficultly as well. We know from Scheafer’s paper that there is 15% false honest mistakes usually done by crescent observers.
