Can anyone provide any evidence to substantiate that its valid to accept helal testimony BEFORE sunset

Hadiths from Sahih Bukhari & Muwatta Imam Malik


Volume 3, Book 31, Number 131: Narrated Abdullah bin Umar:
Allah's Apostle said, "The month (can be) 29 nights (i.e. days), and do not fast till you see the moon, and if the sky is overcast, then complete Sha'ban as thirty days."

Volume 3, Book 31, Number 132: Narrated Ibn 'Umar:
The Prophet said, "The month is like this and this," (at the same time he showed the fingers of both his hands thrice) and left out one thumb on the third time.

Volume 3, Book 31, Number 133: Narrated Abu Huraira:
The Prophet or Abu-l-Qasim said, "Start fasting on seeing the crescent (of Ramadan), and give up fasting on seeing the crescent (of Shawwal), and if the sky is overcast (and you cannot see it), complete thirty days of Sha'ban."


Book 18, Number 18.1.2:
Yahya related to me from Malik from Abdullah ibn Dinar from Abdullah ibn Umar that the Messenger of Allah, may Allah bless him and grant him peace, said, "A month has twenty-nine days in it. Do not start the fast or break it until you see the new moon. If the new moon is obscured from you, then work out (when it should be)."


Book 18, Number 18.1.4:
Yahya related to me from Malik that he had heard that once in the time of Uthman ibn Affan the new moon had been seen in the afternoon and Uthman did not break his fast until evening had come and the sun had set.
Yahya said that he had heard Malik say that some one who sees the new moon of Ramadan when he is on his own should start the fast and not break it if he knows that that day is part of Ramadan. He added, "Some one who sees the new moon of Shawwal when he is on his own does not break the fast, because people suspect the reliability of someone among them who breaks the fast. Such people should say, when they sight the new moon, 'We have seen the new moon.' Whoever sees the new moon of Shawwal during the day should not break his fast but should continue fasting for the rest of that day. This is because it is really the new moon of the night that is

Question: 8393 United Kingdom of Great Britain Assalamolaikum I would like to ask what is the position of shariah with regards to sighting the hilal just before sunset as according to astronomers a crescent can at times be sighted by naked eye before the sun sets. Is it valid if sighted before sunset to determine the new month? or is it necessary to sight it after sunset?

Answer: 8393 Jun 24,2009 (Fatwa: 1350/1134=L/1429) Please, ignore the fatwa that was written under the code mentioned above. (Fatwa: 1002/L=200/TL/1430)

The valid moon sighting is one occuring after sunset. If moon was sighted on 29th day before sunset, it will not be considered valid and thus based upon such sighting the next day will not be regarded as Ramadhan day or Eid day.

Allah (Subhana Wa Ta'ala) knows Best

The Hadith is clear of the days being 29 or 30 days, so we cant have 28 days if it is sighted since there is no daleel for 28 days.

(after edit) no ones questioning wrt validity of 28 days in a month. The sighting BEFORE sunset of the 29th would be in on the 29th not 28th as i incorrectly stated (night comes before the day)

Response from a Maliki Scholar (paraphrasing)

This is what I have found in the commentary of Al-Zurqani (Maliki) on the Muwatta, as well as in Hazrat Shaykh's Awjazul-Masalik, in summary:

 
Hazrat Shaykh essentially made reference to the same information that was in al-Zurqani (quoting from Ibn Abdul-Barr and Al-Baji), and he then added the position of the Hanabila;
 
The gist of what they mentioned is the following:
 
  1. There is no khilaf that when the moon is see in the "Ashiyya": time after zawal and before sunset, then this crescent belongs to the next night, i.e: fasting continues.  The hadith about what happened in Uthman RA's time refers to that.
  2. There is khilaf about if the crescent appears before zawal; a saying of Umar RA related by al-Nakha'i has been narrated to that effect saying: "If you see the crescent after zawal then continue fasting, and if you see it before zawal do not break your fast unless it is confirmed by two righteous witnesses that they saw it the night before; i.e break your fast if you get confirmation of the fact that it is from the previous night" (somethign to that effect, I am writing this from memory of what I read). 
We said earlier that there is khilaf, meaning a group of the 'ulama-and that is the majority- consider that any crescent seen during the day whether before or after zawal, is the next night's crescent.
 
Furthermore the saying of Umar is considered as lacking in authenticity for 2 reasons:
 
  • It's Munqati' (interrupted): al-Nakha'i did not meet Umar RA.
  • The person who narrated from al-Nakha'i is "Majhuul" = unknown.
In conclusion, the crescent that is seen during the day is not to be given consideration.
 
Some of the 'ulama (in the sharh of the Muwatta) have also mentioned that this khilaf is only for the 30th day of fasting, in other words on the 29th day there is not even khilaf that it should be ignored.
 
I think this is all I saw that was relevant.
 

Response from a Hanafi Scholar:

Respected Brother Muadh,

If the moon was sighted on the 30th before Zawal, then this moon will be regarded from the previous day but if the moon was sighted after Zawal, then this moon will belong to the following day. The words following day doesn't mean that the sighting has been regarded as valid, it only means that it doesn't belong to the previous day and there is no doubt, that after completing 30 days, regardless of sighting the moon or not, the new month will start after sunset.



وما نقلناه من هذه النصوص دال على ما قلناه من أن قولهم أنه للليلة المقبلة بمعنى أنه ليس للليلة الماضية لا بمعنى أنا نثبت دخول الشهر بهذه الرؤية وإلا ناقض قولهم لا أثر لرؤيته نهارا على أن الكلام فى رؤيته يوم الثلاثين من شعبان أو رمضان ولا شك أن الليلة التى بعده تكون من الشهر الآخر سواء رؤى نهارا أو لا.   ص244 رسائل ابن عابدين

 Can claims made by people with “super eye sight” be accepted?

[Al-Subki] also said, “Consideration is for the sighting of the person with normal sight, because this [factor] is that in which people are common and difference can be alleviated. No consideration is given to the sighting of only the very sharp-sighted, because [such people] are rarer than astronomers. Therefore, [their sighting alone] will not be a rule of thumb [for establishing the crescent]. Agreement upon [such people's sighting alone] would not be possible, nor is there any certainty or [even] confidence therein except in the situation of cloudiness, combined with the judiciousness of the witnesses, while their testimony does not conflict with definite knowledge [achieved via definite calculations]” (p. 392)

وقال أيضاً : والعبرة برؤية معتدل البصر ، لأنه هو الذي يشترك فيه الناس ويرتفع به الخلاف ولا عبرة برؤية حديد البصر وحده ، لأنه من العالم بالحساب ، فلا يكـون مناطاً عاماً ولا يمكن معه اتفاق وليس فيه قطع ولا ظن غالب إلا في حالة الإغمام مع عدالة الشهود ، وعدم مخالفة شهادتهم للعلم القطعي . ص 392
