Performing Tahajjud Prayers In Congregation (Jama'ah)

Question:

What is the ruling of praying Tahajjud in a Jama'ah according to all the four Madhhabs?

Answer:

In the name of Allah, Most Compassionate, Most Merciful,

According to the Hanafi Madhhab, it is disliked (makruh) to offer Tahajjud and other Nafl prayers in congregation (jama'ah), except for the Tarawih prayer (in Ramadhan), eclipse prayer (kusuf) and drought prayer (istisqa).

The Hanafi jurists (fuqaha) have explained that, this is when Nafl prayers are offered in a large congregation or a habit is made of doing this.

The great Hanafi Imam, al-Haskafi (Allah have mercy on him) states: "One should not offer Witr and Nafl prayers in congregation, as this is Makruh. This is when the congregation is large such that up to four people join the Imam." (Durr al-Mukhtar)

Allama Ibn Abidin (Allah have mercy on him) states in his commentary: "If a habit is made of offering Nafl prayers in congregation, then it will be regarded as an innovation (bid'a), thus Makruh.......And performing Nafl in congregation is not recommended, as the Companions (Allah be pleased with them) did not offer Nafl (in congregation) outside Ramadhan." (Radd al-Muhtar).

Imam al-Kasani (Allah have mercy on him) states: "Performing Nafl prayers in congregation is not something that is Sunnah, besides the Tarawih prayer in Ramadhan." (Bada'i al-Sana'i)

The reason for it being disliked is that the Messenger of Allah (Allah bless him & give him peace) encouraged the offering of Nafl prayers at home.

Zaid ibn Thabit (Allah be pleased with him) narrates that the Messenger of Allah (Allah bless him & give him peace) said: "O people! Offer your prayers at home, as the most virtuous prayer for an individual is that which is offered at home, except for the obligatory (fard) prayers." (Recorded by many Hadith Imams)

Sayyida A'isha (Allah be pleased with her) reports that "the Messenger of Allah (Allah bless him & give him peace) used to perform his non-obligatory prayers at home." (Sahih Muslim)

Due to the above two and many other narrations, the Hanafi Fuqaha state that the main feature of Nafl prayers is offering them at home and individually. This is the reason why it is more preferable to perform them at home and not with people in the Masjid. Contrary to the Fard prayers, for they (fard prayers) are based on gathering, and this is the reason why they were ordered to be offered in the Masjid in congregation.

Therefore, offering Nafl prayers in congregation entails going against that which is legislated, which is that the obligatory prayers are prayed in congregation, and voluntary prayers alone. The transmitted exceptions relate only to small congregations, and were rare occurrences. (See: I'la al-Sunan, 7/89)

This is also, more or less, the ruling in the Maliki Madhhab, in that it is disliked to offer Nafl prayers in a congregation. (See: al-Mawsu'a al-Fiqhiyya)

With regards to the Shafi'i Madhhab, the great Shafi'i Faqih, Imam Khatib al-Shirbini (Allah have mercy on him) states: "It is from the Sunnah that Nafl prayers are not offered in congregation. However, if one did offer them in congregation, it will be permissible without it being Makruh." (Mugni al-Muhtaj, 1/333)

According to the Hanbali Madhhab, it is perfectly okay to offer Nafl prayers in congregation, as the Messenger of Allah (Allah bless him & give him peace) offered them individually and in congregation. However, his usual practice was to offer them individually.

The Hanbali Jurists (fuqaha) support their view with incidents in which the Messenger of Allah (Allah bless him & give him peace) performed Nafl prayers in congregation, such as with Ibn Abbas, in the house of Atban ibn Malik, with Anas and his mother, etc... (See: Ibn Qudamah, al-Mugni, 2/142)

However, this does not contradict the Madhhab of Imam Abu Hanifa (Allah be pleased with him), as offering Nafl prayers in a small congregation and without making it a habit is also permissible in the Hanafi Madhhab.

The Hanafi Fuqaha interpret these incidents as isolated incidents that had, at the most, four people including the Messenger of Allah (Allah bless him & give him peace). And this, as mentioned previously, is permissible according to the Hanafi Madhhab also. Yes, if a habit is made of performing Nafl prayers in congregations or a large congregation is organized, then this will be Makruh.

In conclusion, According to the Hanafi and Maliki Madhhabs, it is disliked (makruh) to perform Tahajjud and other Nafl prayers in a congregation. The Shafi'i Madhhab regards the Sunnah in offering them individually, whilst according to the Hanbali Madhhab, offering a Nafl prayer in congregation is totally permissible.

( 3 ) صَلَاةُ الرَّوَاتِبِ فِي جَمَاعَةٍ أَوْ فُرَادَى : قَالَ الْحَنَفِيَّةُ : تُكْرَهُ الْجَمَاعَةُ فِي صَلَاةِ النَّوَافِلِ . وَقَالَ الْمَالِكِيَّةُ كَذَلِكَ : تُكْرَهُ الْجَمَاعَةُ فِي النَّوَافِلِ , لِأَنَّ شَأْنَ النَّفْلِ الِانْفِرَادُ بِهِ , كَمَا تُكْرَهُ صَلَاةُ النَّفْلِ فِي جَمْعٍ قَلِيلٍ بِمَكَانٍ مُشْتَهِرٍ بَيْنَ النَّاسِ , وَإِنْ لَمْ تَكُنْ الْجَمَاعَةُ كَثِيرَةً وَالْمَكَانُ مُشْتَهِرًا فَلَا تُكْرَهُ . وَقَالَ الشَّافِعِيَّةُ : تُسْتَحَبُّ الْجَمَاعَةُ فِي التَّرَاوِيحِ وَالْوِتْرِ فِي رَمَضَانَ , وَلَا يُسْتَحَبُّ فِعْلُ سَائِرِ الرَّوَاتِبِ جَمَاعَةً . وَقَالَ الْحَنَابِلَةُ : يَجُوزُ التَّطَوُّعُ جَمَاعَةً وَمُنْفَرِدًا ; لِأَنَّ النَّبِيَّ صلى الله عليه وسلم فَعَلَ الْأَمْرَيْنِ كِلَيْهِمَا , وَكَانَ أَكْثَرُ تَطَوُّعِهِ مُنْفَرِدًا , وَصَلَّى بِابْنِ عَبَّاسٍ مَرَّةً , وَبِأَنَسٍ وَأُمِّهِ وَالْيَتِيمِ مَرَّةً وَأَمَّ أَصْحَابَهُ فِي بَيْتِ عِتْبَانَ مَرَّةً , فَعَنْ
عِتْبَانَ بْنِ مَالِكٍ - رضي الله عنه - أَنَّهُ قَالَ : يَا رَسُولَ اللَّهِ إنَّ السُّيُولَ لَتَحُولُ بَيْنِي وَبَيْنَ مَسْجِدِ قَوْمِي , فَأُحِبُّ أَنْ تَأْتِيَنِي فَتُصَلِّيَ فِي مَكَان مِنْ بَيْتِي أَتَّخِذُهُ مَسْجِدًا , فَقَالَ : سَنَفْعَلُ , فَلَمَّا دَخَلَ قَالَ : أَيْنَ تُرِيدُ ؟ فَأَشَرْت إلَى نَاحِيَةٍ مِنْ الْبَيْتِ , فَقَامَ رَسُولُ اللَّهِ صلى الله عليه وسلم فَصَفَفْنَا خَلْفَهُ , فَصَلَّى بِنَا رَكْعَتَيْنِ

MEELAAD AND SEERATUN NABI JALSAHS

In all truth when the original soul of a nation de-parts then it strives to hoodwink the world with excuses fit for a child. Thus the whole year round the Shariah and Sunnah of Rasoolullah (Sallallahu alaihi wasallam) are treated like how a villain and enemy treats them and then a night is set aside for Meelaad gathering and Seraah Jalsah to trumpet the „love‟ for Rasoolullah (Sallallahu alaihi wasallam). Is there greater hypocrisy than this? The History of Islam bears witness that as long as Muslims were fortunate of being given the taufeeq of following the Shariah, the entire Ummah was a paragon of the Shariah and every Muslim‟s life, appearance, actions and accomplishments were embodiments of the Shariah of Islam, the love for the Rasool and explicit following of the Sunnah. At that time there was neither the need for the Seerah gatherings in vogue and nor any reason for Meelaadun Nabi. Thus one will never find in the era of Hazrat Abu Bakr Siddeeq (Radhiyallahu anhu) or in the era of Hazrat Umar Faarooq (Radhiyallahu anhu) or in the era of Hazrat Uth-maan (Radhiyallahu anhu) any gathering enacted for Meelaadun Nabi [and Seeratun Nabi]. Were the people of Khairul Quroon devoid of love for the Rasool (Sallallahu alaihi wasallam)? Were the hearts of Muslims in the ages attested as the noblest of all ages, void of love for Allah Ta‟ala and Rasoolullah (Sallallahu alaihi wasallam)? Was there no fervour in them to follow the Sunnah? These blessed epochs were unmatched in love for the Rasool, following of the Sunnah, Imaani vigour and strength in Faith. In fact, you will not find Seerah Jalsahs and Meelaad gatherings in any gathering of all the Sahaabah, all the Taabi‟een, the Aimmah Mujtahideen, the Fuqaha of the Um-mah, the illustrious Muhadditheen, the Awliya of Allah and the Mashaaikh of Tasawwuf. A full six centuries down the long corridor of Islam‟s history there is no trace of Seeratur Rasool or Meelaadun Nabi. With the end of the sixth century Hijri, the governor of Arbil inaugurated this Seerat „remembrance‟. Thousands of gold coins were dis-tributed to the poor and needy, clothes were distributed, food was prepared and in this way the custom of Isaal-e-Thawaab for the holy soul of Rasoolullah (Sallallahu alaihi wasallam) was started. But in the centuries that followed, these acts were even discontinued and only the gathering of Meelaad was held. Nonetheless, this state of affairs was on a small scale.

When the turn of the worst of ages came then Islam ceased to remain the Deen of the nation. Their „deen‟ became nationalism and, very hypocritically, an outward show of Islam commenced. Beliefs became corrupted; Islamic practice was effaced; hearts became empty of the love for the Rasool; the concept of following the Shariah escaped minds; the vigour of Imaan died down in hearts; and thus as a proclamation of Islam once a year a celebration of Islam was deemed adequate. This is also precisely the case with remembrance of the Qur‟aan-e-Kareem. Practising on the Qur‟aan is considered unnecessary. Some customary burning of lamps and adorning of homes and the Masaajid are practised. Hundreds of thousands of rupees are spent on waste. For the sake of Allah, how can this be righteousness?

Question

Do you say that the commemoration of his (Allah bless him and grant him peace) birth is deemed blameworthy (mustaqbah) in the Shari'ah, from the evil and prohibited innovations (al-bid'at al-sayyi'ah al-muharramah), or [do you believe] otherwise?

Answer

Far be it that any of the Muslims say, let alone we, ourselves, say, that commemorating his noble birth (upon him blessing and peace), rather even commemorating the dust on his shoes and the urine of his (Allah bless him and grant him peace) camel, are deemed blameworthy in the Shari'ah, from the evil and prohibited innovations; for, commemorating the states which have the least connection with the Messenger of Allah (Allah bless him and grant him peace) is from the most desirable of recommended acts (ahabb al-mandubat) and the greatest of preferable acts (a'la l-mustahabbat) according to us, whether it is the commemoration of his noble birth or commemoration of his urine, feces, standing, sitting, sleeping and waking as is stated clearly in our treatise called Al-Barahin al-Qati'ah at various junctures therein, and in the fatwas of our teachers (mashayikh) (may Allah have mercy on them), as [is mentioned, for example] in the fatwas of Mawlana Ahmad 'Ali al-Muhaddith al-Saharanpuri, the student of Shah Muhammad Ishaq al-Dahlawi then al-Muhajir al-Makki, which we will quote in translation, that it may become an example of all [the other fatwas]:

He (may Allah have mercy on him) was asked about the milad function, in which manner is it permissible and in which manner is it impermissible? He replied [saying] that:

Commemorating the noble birth of our master, the Messenger of Allah (Allah bless him and grant him peace) using sound narrations, during times devoid of the obligatory duties of worship, and in forms not contravening the path of the Companions and the people of the three generations whose greatness has been attested to, and [in forms not] containing beliefs that may be conceived of as shirk and bid'ah, and in manners which do not contravene the conduct of the Companions which is the measure of his (peace be upon him) statement, "What I and my Companions are upon," and in gatherings free from abominations of the Shari'ah, is a cause for goodness and blessing, with the condition that it is accompanied by pure intention and sincerity and the belief that it is included within the totality of recommended good remembrances (jumlat al-adhkar al-hasanah al-mandubah), and is not restricted to a time from the times. When it is so, we do not know of any Muslim who rules it to be unlawful (ghayr mashru') or bid'ah. To the end of the fatwa.

It is learnt from this that we do not denounce the commemoration of his noble birth. Rather, we denounce the abominable acts that are associated with it as you [may] have seen in the mawludi functions which [take place] in India, of narrating weak and forged narrations, the mixing of men and women, extravagance in lighting candles and decorations, and the belief that it is obligatory, by vilifying, insulting and anathematising those who do not attend their function with them, and other such abominations of the Shari'ah which are almost not found to be absent from them. If they were free of these abominations, far be it that we say that commemorating the noble birth is abominable and a bid'ah. How can this ugly belief be suspected of a Muslim? Hence, this attribution to us is also from the inventions of the deceptive lying deviants (Allah Exalted is He disgrace them, and curse them on land and sea and on smooth and rough land).

Our dear respected and beloved Shaykh (Mufti) Taqi Usmani (HA) also considers these Seerah gatherings permissable provided that no rules of Shariah are broken and"I think" Shaykh (Mufti) Rafi Usmani (HA) describes in his talk at Ebrahim College (London) where he describes that a year or two after the creation of Pakistan his father (Shaykh (Mufti) Shaf'i Usmani (RA)) and some Shia and Barelwee Ulamah used to ride in the same car to attend these

So there are Ulama who permit this and for those who don't the incident quoted by Shaykh (Mufti) Rafi Usmani (HA) is not a good encouragement.

Assalaamu 'Alaykum

It is that time of the year again when these programs are held all over. The 'Ulama that have been questioned about it say that these Jalsahs are not only held in Rabi' al-Awwal however I am yet to come across a Sirah Jalsah at any other time either attended or organised by these 'Ulama.

Another reason that some have given is that it is an alternative to the gathering of the Ahl al-Bid'ah. However, in the past and in other places the influence and spread of the Ahl al-Bid'ah and their gatherings were much more rife and popular hence an alternative was greatly needed then. However, the 'Ulama of the time did not see it fit for an alternative and rather were staunchly opposed.

What other evidence is used for these programs?

Rabi'ul Awwal And Seerah
Question:
There has been much discussion with regards to celebrating 12th Rabī al-Awwal. You must be well aware of all the academic arguments in that regard. Without delving into academic gymnastics, your brief thoughts on this issue will be well appreciated.
Answer:
In the Name of Allah, the Most Gracious, the Most Merciful.
As-salāmu 'alaykum wa-rahmatullāhi wa-barakātuh.
The code of our Imān is لا إله إلا الله محمد الرسول الله. That is to believe in the Oneness of Allāh Ta'ālā and the Nubuwwah of Rasūlullāh Sallallāhu Alaihi Wa Sallam. Belief and reverence for Rasūlullāh Sallallāhu Alaihi Wa Sallam is an integral and inseparable component of our faith. Imān cannot be accepted without believing in and revering Rasūlullāh Sallallāhu Alaihi Wa Sallam.
The actual reverence of Rasūlullāh Sallallāhu Alaihi Wa Sallam is to believe that:
1. Rasūlullāh Sallallāhu Alaihi Wa Sallam came to this world as the greatest human being. This is a reality and not just a fairy tale.
2. Rasūlullāh Sallallāhu Alaihi Wa Sallam was chosen by Allāh Ta'ālā to be the recipient of divine revelation (Wahī).
3. Rasūlullāh Sallallāhu Alaihi Wa Sallam was bestowed the responsibility of conveying the message of Allāh Ta'ālā to humanity, which he fulfilled in the best manner.
4. Among the various Messengers of Allāh Ta'ālā, Rasūlullāh Sallallāh Alaihi Wa Sallam was the leader and most superior.
5. Love of Allāh Ta'ālā and happiness in both the worlds lies only in following the Sunnats of Rasūlullāh Sallallāhu Alaihi Wa Sallam.
The salvation and Najāh of every human being is directly linked with believing in Rasūlullāh Sallallāhu Alaihi Wa Sallam. When one is placed inside the grave, he/she will be asked to recognize Rasūlullāh Sallallāhu Alaihi Wa Sallam. Consider the following narration:
يُقَالُ مَا عِلْمُكَ بِهَذَا الرَّجُلِ؟ (صحيح البخاري, ج 1, ص 28: دار طوق النجاة)
Translation: The deceased will be questioned in the grave: "What do you know about this man (Rasūlullāhāh Sallallāhu Alaihi Wa Sallam)?" (Sahīh Al-Bukhārī, Vol. 1, Page 28: Dār Tauq An-Najāh)
In order for one to be true in revering Rasūlullāh Sallallāhu Alaihi Wa Sallam, the overwhelming thought of Rasūlullāh Sallallāhu Alaihi Wa Sallam should be present every moment of one's life. The demand of love is that the lover yearns to be in the company of the beloved. If this is not possible, then one adopts the beautiful ways and lifestyle of the beloved in order to pacify the uncontainable passion within the heart that would otherwise gush out.
Even if one were to dedicate one's entire life to serve the Sunnats and ways of Rasūlullāh Sallallāhu Alaihi Wa Sallam, this would fall short of doing justice to the reverence that ought to be showed, keeping in mind endless efforts and sleepless nights of Rasūlullāh Sallallāhu Alaihi Wa Sallam for the sake of his Ummah. Merely taking out one day or one month discussing different angles of the beautiful life of Rasūlullāh Sallallāhu Alaihi Wa Sallam is not sufficient. A Mu'min (believer) should spend every day of his life in imitating and spreading the Sunnats of Rasūlullāh Sallallāhu Alaihi Wa Sallam. Nevertheless, we cherish any opportunity we get to talk about Rasūlullāh Sallallāhu Alaihi Wa Sallam and inculcate in us and others the love and reverence of Rasūlullāh Sallallāhu Alaihi Wa Sallam.

Im a lil late to this thread but as far as raising of the finger


Shaykh Abu Yusuf Riyadh ul Haq's book, who ends the chapter on this issue as follow:

The raising of the finger

The ulama of the Hanafi fiqh say that the finger should be raised at the point of negation (la ilaha) and then replaced on affirmation (illallah). Some ulama also say that the raising of the forefinger and the clutching of the rest is for the purpose of making duaa after the tashahhud (as is mentioned in the above hadeeth)*, therefore the finger should be kept raised till the end of salah. This is mentioned quite clearly in one hadeeth.

Sayyiduna Shihab radiallahu anhu says, 'I came upon the Prophet sallallahu alaihi wa sallam whilst he was praying. He had placed his left hand upon his left thigh, his right hand upon his right thigh and he had spread his forefinger (as opposed to clutching it) saying,

(Oh He who transforms the hearts! Make my heart steadfast upon Your religion)

A similar hadeeth has been narrated by Abu Ya'laa al Mawsili in his Musnad with the words 'pointing with his forefinger' instead of 'had spread his forefinger'.

Sayyiduna Numair al Khuzai radiallahu anhu relates that he saw Rasulullah sallallahu alaihi wa sallam seated in sal�h. He had placed his right arm upon his right thigh and raised his forefinger, having bent it slightly whilst praying.

Sayyiduna Wail bin Hujr radiallahu anhu reports, 'I prayed salah behind Rasulullah sallallahu alaihi wa sallam and said to myself "I will preserve the salah of Rasulullah sallallahu alaihi wa sallam." When he sat for tashahhud he spread his left foot upon the ground and sat on it, and placed his left palm upon his left thigh and his right arm upon his right thigh. He then shaped his fingers making a circle with the middle finger and the thumb and began praying with the other one (forefinger).'

He also relates, 'I saw Rasulullah sallallahu alaihi wa sallam make a circle with his thumb and middle finger, and lift the one next to it (the forefinger) praying with it in tashahhud.

Sayyiduna Abdullah bin Umar radiallahu anhu relates that when Rasulullah sallallahu alaihi wa sallam would sit in sal�h, he would place his right hand upon his knee and raise his forefinger praying with it, whilst his left hand would be spread out upon his left knee.

This is also the view of the Hanafi Muhaddith Moulana Rasheed Ahmad Gangohi . He says, 'It should be known regarding what some fuquha have said about raising the finger at the time of negation and putting it down at the time of affirmation, that the established (method) in the hadeeth is to keep the finger raised till the end of salah.

The author of al Muhalla the commantary of al Muwatta has mentioned that it has been from some Maliki and Shafiee imam also that the finger should be kept raised till the end of tashahhud. He also quotes Ibn Hajar al Makki al Shafiee who says, 'It is sunnah to keep the finger raised till the end of tashahhud.'

As far as whole quran in one night during ramadan


8. It is permissible to recite the entire Quran in one night on condition that the people are extremely anxious to do this and it will not be difficult for them. If it will be difficult for them and they will be displeased with this, it will be makruh to recite the entire Quran in one night.

In addition from the same book. ..10. It is sunnah to offer taraweeh salaat in the entire month of Ramadaan even if the Quran is completed before the end of the month. For example, if the entire Quran is completed in 15 days, it will be sunnah-e-mu'akkadah to continue offering taraweeh for the rest of the month.

THe issue was not about reciting the entire Quran in one night. Believe you me, everyone present was anxious to this and it was not (too) difficult on us. As you have seen in earlier posts, it was about the speed.
