Chapter: Taking Churches As Masjids
It was narrated that Talq bin 'Ali said: "We went out as a delegation to the Prophet (ﷺ); we gave him our oath of allegiance and prayed with him. We told him that in our land there was a church that belonged to us. We asked him to give us the leftovers of his purification (Wudu' water). So he called for water, performed Wudu' and rinsed out his mouth, then he poured it into a vessel and said to us: 'Leave, and when you return to your land, demolish your church, and sprinkle this water on that place, and take it as a Masjid.' We said: 'Our land is far away and it is very hot; the water is far away and it is very hot; the water will dry up.' He said: 'Add more water to it, for that will only make it better.' So we left and when we came to our land we demolished our church, then we sprinkled the water on that place and took it as a Masjid, and we called the Adhan in it. The monk was a man from Tayy', and when he heard the Adhan, he said: 'It is a true call.' Then he headed toward one of the hills and we never saw him again." [Sunan an-Nasa'i]

بہتر تو یہ ہے کہ اسے مسلمان خریدلیں، پھر اسے منہدم کرکے مسجد کی تعمیر کرکے نماز شروع کریں، اور اگر ایسا ممکن نہیں ہے تو بدرجہٴ مجبوری کسی ایسے کمرہ میں جہاں حضرت عیسیٰ علیہ السلام یا حضرت مریم کی تصویر نہ ہو، یا کوئی مجسمہ اور فوٹو نہ ہو تو وہاں نماز پڑھ سکتے ہیں۔ لیکن مسجد کے لیے کوشاں بھی رہیں۔

Question:
In a city in the United States, Muslims have been given permission to offer their prayers in a church because there is no mosque nearby where they can perform their prayers. In this situation, is it permissible for Muslims to pray there or not? Please provide the answer with references so that our students can know the ruling along with its basis.

Fatwa: 926 = 873/B
The preferable course is that the Muslims purchase the church, then demolish it and build a mosque in its place, and thereafter begin offering prayers there.
If this is not possible, then due to necessity, they may offer prayers in a room where there are no images of Prophet Jesus (peace be upon him) or Mary (peace be upon her), and no statues or photographs. At the same time, they should continue striving to establish a mosque.
And Allah, the Exalted, knows best.

نعم يجوز شراؤها وجعلها مسجداً وتجب إزالة الصلبان والصور المعلقة والمنقوشة فيها ، وكل ما يشعر بأنها كنيسة ، ولا نعلم مانعاً يمنع من ذلك
Yes, it is permissible to buy it and make it into a mosque, but they have to remove all the crosses and images that are hanging or engraved in it, and everything that indicates that it is a church. We know no reason why this should not be allowed.

Is there any Hadeeth about a church being made into a mosque? Can we pray in that mosque?
All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.
Indeed there is evidence in the Sunnah that it is permissible to build mosques in places of Shirk [associating partners to Allaah], and churches are included in this, after changing the slogans of disbelief.
Imaam An-Nawawi may Allaah have mercy upon him said: 'It is permissible to build a mosque in a place where there is a church, a synagogue, or grave if bones or corpses where removed from it. It is confirmed that Anas may Allaah be pleased with him narrated that the Prophet's sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) mosque contained graves so they were unearthed. In relation to churches and synagogues, it is confirmed that the Prophet sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) commanded a mosque to be built for the people of Taa'if where they used to worship their idols [after having destroyed them].' [Abu Daawood]'
Moreover, when the companions may Allaah be pleased with them conquered Damascus, they built a mosque in the place where there was a church called the church of John. Ibn Katheer may Allaah have mercy upon him said: 'Where this mosque was built, there was a church called the church of John, and when the companions may Allaah be pleased with them conquered Damascus, they took the east part of the church and they transformed it into a mosque and the west part of it remained a church from 14 A.H until today [meaning 87 A.H.]. Al-Waleed, may Allaah have mercy on him, [who was the caliph at that time] was decided to take the remaining of the church from the non-Muslims, so he gave them instead the church of Maryam [Mary], may Allaah exalt her mention.'
Therefore, it is permissible to transform a church into a mosque and there is no harm to pray in a mosque which was originally a church. Moreover, it is also permissible to pray even in the church according to the view of many righteous predecessor scholars may Allaah have mercy upon them like Al-Hassan and 'Umar Ibn 'Abdul-'Azeez, Ash-Shu'bi and others may Allaah have mercy upon them. The evidence for this is the saying of the Prophet sallallaahu `alayhi wa sallam ( may Allaah exalt his mention ) said: "Whenever the time of the prayer comes, pray as wherever you are is a mosque." [And this is a general statement] [Al-Bukhari and Muslim]
However, some other scholars may Allaah have mercy upon them disliked praying in a church because of the pictures that it contains.
