Muslims arrived in Europe during the reign of Caliph Al-Walid ibn Abd al-Malik (RA), but it was not until the arrival of Tariq ibn Ziyad with an army of 7,000 men at Gibraltar on 30 April 711 that Muslims truly arrived in Europe.
Over the next 700 years, Muslims truly became Europeans, and for many, their love of "their land" began to exceed their love for Islam. Slowly, this nationalistic poison seeped into the hearts of the Muslims. Their attachment to the land grew as their power weakened, until most of the lands upon which Muslims had lived for centuries were eventually lost.
Great scholars were produced in these lands from diverse backgrounds. Imam Al-Qurtubi Al-Maliki (RA) and Ibn Hazm Al-Zahiri (RA), despite standing at opposite ends of Islamic jurisprudence, remained united in their praise and love of "their land".
Ibn Hazm (RA) fell in love, married someone else, and wrote his masterpiece on romance and love, Tawq al-Hamamah (The Ring of the Dove), in which he describes the beauty of the women of "his land" .
Imam Al-Qurtubi Al-Maliki (RA), although diametrically opposed to Ibn Hazm (RA) in jurisprudence, is likewise full of praise for the architecture, scholarship, and intellectual gatherings of "his land".
The decline of Islam had already begun during the lifetime of Ibn Hazm (994–1064) and was in full view by the time of Imam Al-Qurtubi (1214–1273).
One by one, Muslim territories were lost and Muslim populations found themselves living under non-Muslim rule. Treaties promising protection of their rights and religious practice were routinely violated, yet scholars continued issuing fatwas of compliance in an attempt to safeguard the Muslim masses.
The celebrated Fatwa:
The height of this "compliance jurisprudence" came with the fatwa of Abu al-Abbas Ahmad ibn Abi Jum'ah al-Maghrawi al-Wahrani Al-Maliki (RA), known today as the Oran Fatwa.
Sadly, Muslims no longer possess the original text. The only surviving manuscript is preserved in the Vatican, but enough translations remain for us to know its essential contents.
This Fatwa became very popular among Andalusian Muslims because it gave them "permission" to remain on "their lands" and yet compromise aspects of Islam and this is why we still have more surviving manuscripts of it in Spanish then original Arabic.
- Prayers: Normally, prayers involve standing, bowing, and kneeling. The fatwa said it was okay to pray by just making small movements. If they couldn't pray at the right times, they could make up the missed prayers at night.
- Washing: If clean water wasn't available for ritual washing (wudu), they could do a "dry ablution" (tayammum) using clean earth or stone. If even that wasn't possible, just pointing their hands or face towards clean earth was acceptable.
- Charity: They still had to give charity (zakat), even if it was just by being generous to a beggar.
- Full Body Wash: The fatwa said the full body ritual wash (ghusl) was still required, "even though by plunging into the sea."
- Christian Worship: If they had to bow to Christian "idols," they should secretly intend to perform their Islamic prayer. They should focus their thoughts on Allah, not the idol.
- Forbidden Actions: If they were forced to say things against Islam, like cursing Prophet Muhammad or saying Jesus was the son of God, they should do it. But they should try to secretly change the meaning. For example, they could mispronounce Muhammad's name or intend to curse someone else with a similar name.
- Forbidden Food and Drink: The fatwa allowed them to eat pork and drink wine, which are normally forbidden. But they should not enjoy these things and should reject them in their hearts.
- Marriage: A Muslim man could marry a Christian woman because both Muslims and Christians are considered "People of the Book." But a Muslim woman should avoid marrying a Christian man unless she was forced. Even then, she should believe in her heart that it was forbidden.

Accusations of Taqiya by Tommy Robinson?
Today, when hoards of Islamophobes marching through the streets of London under Stephen Christopher Yaxley-Lennon (aka Tommy Robinson) accuse Muslims of Taqiyya and everyone is bewildered about this accusation, they are directly taking it from the Fatwas of our Ulama and practice of European Muslims who allowed Muslims to live a "dual-life" of a Muslim-Christian.
It wasn't Shia but Sunni European Muslims of Europe who deemed it permissible to attend Churches, worship Jesus, eat pork and drink wine but inwardly remain Muslim.
2018: Hijab is not necessary in America

According to Shaykh Hamza, as per the advice of Shaykh Abdallah bin Bayyah, if a woman is certain or feels a high probability of danger when outside of her home, particularly in some areas of this country, then the best place for her at this time is in her home. If she must go out by necessity and feels a real sense of fear, then in such circumstances, especially if she does not have a male to protect her, she is permitted by shari’ah to protect herself. Necessities have their own rulings. Much of the Prophetic Law of Islam is based upon maslahah, or the Common Good, and it is rational and merciful. The essential reason for the ruling of hijab is to protect women. Since wearing the hijab may not serve that purpose these days in some areas and may in fact put a woman in danger, then the ruling changes under such circumstances.
Hindus are Ahlul-Kitaab
Qazi Sanaullah Panipati (1765–1847) (RA) was a great scholar and predecessor of what we call "Deoandees", he declares Hindus to be Ahlul-Kitaab in his famous Tafseer "mother of all Deobandi Tafseers" in 9:29 which you can read from page 162 here .
Just read what he says about Hindus and Jizyah in an era where Muslims have no power to enforce Jizyah on Hindus or British who have already conquered some of the Muslims lands in India.
He (RA) is expressing this view based on his research but he is singular in his opinion but the Fatawa of later generations deserve some attention
Ulama issued these Fatwaas due to sincerity towards safety and security of Muslims, where will millions of Spanish Muslims migrate to? Will the Ottoman Empire take them? So they have no choice but to try to survive in "their own homeland" even if rules of Islam have to be bent!
