Yes, exactly. The point that needs to be clarified most is are we allowed to follow an Islam of convenience? Meaning only referring to ulema that would give a fatwa of permissibility or non-permissibility upon things which are easier for us to implement in our lives, but the ease has nothing to do with circumstances surrounding us, rather our own lack of will and laziness.

Its about making Taqleed, see the example of HSBC Islamic Mortgage posted earlier:

  • Rejected by Mufti Ebrahim Desai (HA)


I had long discussions with students of Mufti Ebrahim Desai (HA) on behalf of others and the end result was that a "layman" has permissibility to make Taqleed of either of these opinions.

Nobody just picked up an opinion just because it suited them.

This is a very practical scenario and happens all the time. Two well known and renowned Muftees can differ on a matter and it is common. This is ease from Allah Ta'ala and not a problem so don't look at it as a problem. The cheese rennet example is something which laymen can wrap their head around, fairly easily. Mufti Taqi Usmani (HA), Mufti Ebrahim Desai (HA), Mufti Rizaul Haq (HA) all permit cheese made from rennet of an animal not slaughtered Islamically and they do not stipulate any Taqwa clause etc to it. SANHA and other Ulama do not consider it permissible so here Muslims in Sweden (actual question) have the leeway to follow the Ulama whom allow it based on principles of Taqleed after consulting the Ulama which they did!

I like cheddar.

Cheese like cheddar or parmesano are made using rennet.

If Mufti Abu Hajira forbids it then there must be some reason behind that.

I personally feel that such issues immediate go out of Azeemat and Halal only in Rukhsat.

And that is where I am stuck. To go for Azeemat or lapse to mere Rukhsat.

But as a "Layman" you have the choice to make Taqleed of either and you cannot shun those who are making Taqleed of others based on lack of knowledge or Taqwa.

You cannot boast about yourself being a "Muttaqi" for following an opinion, at the end of the day...All sides are making Taqleed of Hanafi Madhab and making Taqleed of Ulama.

Above all, you cannot then exit your Madhab and start accusing other Madahib for lack of Taqwa or lack of knowledge for consuming Shrimp.

You don't want to eat Shrimp that is your personal business.

Examples:

  1. Mortgage is Haram but Mufti Taqi Usmani (HA) and others authorised HSBC Mortgage in UK, so the choice is between "Haram" or making "Taqleed" of Mufti Taqi Usmani (HA). Mufti Ibn Adam (HA) 15 years ago did an entire program on this specific issue for British Muslims.
  2. Most countries do not have a stringent system of labelling food as "Suitable for Vegetarians" but Cheese is a common food a person can consume. What does a Swedish Muslim do when they are living there? They consulted Mufti Taqi Usmani (HA) about Sweden and cheese.
  3. Stunning is not allowed by "HMC" in UK but it is permitted by Mufti Yusuf Sacha, SANHA and Wifaqul Ulama so it is better to find HMC authorised meat but what do you do in towns where HMC meat is not available or facilities where HMC meat is not available like in vast parts of UK (outside of a few cities in England)? www.wifaqululama.co.uk/stunnedlamb/

Just to clarify please.

Does Mufti Taqi Usmani authorise the mortgage of HSBC or was it when HSBC had the Amanah account only?

(someone reading this may walk away with a different meaning)

Less "lenient" position does not always mean more correct or more cautious opinion. One can also be following one desires by always trying to enforce or follow a "strict" opinion. Although lenient and strict really needs to be defined properly.

Taqleed is an obligation.
Taqleed of 4 Madhabs is made obligatory by majority of Ulama in the world, including International forums etc.

You disagree with it that's fine...You disagree with a lot of sensible things so no big deal...
