if there is any precedence in this behaviour from the salaf, madhab, ulama, then please post it. if there isnt then this is the same thing that we accuse the salafis of doing. except that this is advocating doing an act that is haram/bidah. the salafis are on the other side of the spectrum and do their own ijtihad to try and eradicate haram/bidah

there are many people who have moved away from the established deen due to various reasons. we call them deviants at best. if there is no precedence in this in the deen, then it is nothing but deviance. if there is some sort of precedence then does that allow just anyone to make their ijtihad?

Yes it happens all the time. New times, new rulings. For example the fuqaha were unanimous that pictures of animate objects are haraam. Our akabireen who lived for many decades during proliferation of digital pictures also unanimously gave same fatwa. Mufti Taqi was the first one to rule differently and now majority of ulama follow him with increasing number allowing photographs as well based on new circumstances and new needs. Reputable organizations such as Ummah Welfare Trust run by hundreds of ulama are making very good use of photography in their leaflets.

Another example is issue of women going out to masjids. The unanimous ruling has always been since the early centuries that it is impermissible due to widespread conditions - just like niqaab eventually became unanimously obligatory century based on conditions. However, even though conditions have become far far worse, the ulama today are allowing women to go to masjids and some have also started to say that niqaab is not so necessary. New circumstances, new rulings.

Our akabireen had also said unanimously that Meelad un nabi, though originally permissible, is completely bidah because of widespread conditions. But even though those conditions have become far far worse, more and more ulama are allowing meelad, sometimes also called seerat un nabi to avoid controversy, in order to attract the awaam of the streets and into Islamic environment. Similar reasoning is used by ulama today allowing gatherings on auspicious nights such as laylatul qadr and shab-e-baraat. These were all regarded as bidah by the akabireen. So clear examples of bidah changing rulings based on new times and needs.

Then there's fiqh aqilliyat which is fiqh of minorities which is now being mentioned as required by reputable ulama such as Shaykh Taha Karaan. This fiqh allows change of rulings in societies were Muslims are a minority.

There are many many examples of rulings changing due to new times. And if you go outside the closed circle of deoband, you will find the other ulama of the world are much much more adept at changing rulings based on new circumstances and times.

Either move with the times, or remain a bigoted, narrow-minded, orthodox relic of the past.

@Guest: All these were derived by research scholars after applying traditional set of principles. These examples should not be abused by laymen to mould the rulings of Shariah, when ever they feel there is a reason for it. Do you think any reliable scholar would ever give a Fatwa in favor of what brother sharif is advocating?

This is far worse then ghayr muqallidiyat as every person will now overlook and condone the bidah and shirk of his "near and dear" one based on this bid'ah of "dynamic ijtihad".
