This thread is related to the majlis so I would like to state that NO ONE has tried to force down the view of majlis down anyone's throat. Show me one such instance please. I guess it is the repellency of the nafs to the harsh fatwas that materialize into the notion that others are forcing their opinion or acting arrogant.

Since when does merely posting a fatwa of an alim means that it is being forced on others? Another thing I noticed is the general tendency to say "I dont agree with this view". According to my interpretation (which can be wrong ofc) it means I dont like this fatwa neither do I want to follow it. It doesnt mean an academic disagreement because for that you need to be academically qualified.

An example is that of a doctor. Some views here were strengthened and taken as fi al words with the argument that 2 doctors agree to this view and you are not a doctor nor do you have the necessary qualifications to argue with us.

Why cant the same methodology be applied to the fatwa of an alim?

Is it because deen holds no value for us?

(This is a general statement without any slanders or accusations)

They package the matter has “its too hard for me and I am not spiritually ready to follow such harsh choices etc.”. Their INACTION is based on superficiality.

My principle isn’t based on softness/harshness but based on issues where Hazrat Shaykh (Mufti) A. S. Desai (HA) has veered off the pretty much unanimous Fatwaas of Ulama of Deoband.

So in effect a whole range of people are disagreeing.

  1. Our dear respected Hazrat Deoband Saheb (Damat Barakatuhum Mudda Fuyuzuhum) doesn't hide the fact that he is NOT following some Fatwaas
  2. Sister Ummi Talib doesn't hide the fact that she is NOT following some Fatwaas
  3. Br Arslan doesn't hide the fact that he is NOT following some Fatwaas and even disagrees with some
  4. etc.

The roof has been brought down simply because I happen to let the cat out of the bag by blogging (thus making the issue visible) and when I did this (many others) felt that way also thought about disagreeing.

The premise of this Sister is about HOW DARE you question his Fatwaas? Don't you know he is an Alim? Don't you know his Taqwa levels?

So the original premise is UNISLAMIC, BLAMEWORTHY and smacks of HYPOCRISY and DOUBE-STANDARDS!

If there were threads about Shaykh Al-Albani (RA) and disagreements all of these Brothers/Sisters and their ilk will be pleased and chipping in with their "opinions" on the matter regardless of the fact that Shaykh Al-Albani (RA) was ALSO a Scholar.

The incredible dehumanised, insensitive hypocrisy and double standards is for all to see here!

I am willing to refute this allegation based on the Malfoozat of Shaykh (Maulana) Ashraf Ali Thanwi (RA) provided that the brother is also held to the same standard i.e. when others ask him for proof he should also be FORCED to respond!

  1. Nothing to do with harshness/softness
  2. There is no Usool (principle) in the Hanafi Madhab about judging Fatwaas on harshness/softness

No, the opinion in the Sunnah is that when permissable EASY (SOFT) option should be adopted!

Sorry for not translating. It wasnt futile in itself (li aynihi) rather futile because of external cause (li ghayrihi).

For example wudhu is wajib li ghayrihi (wajib because of namaz) not wajib li aynihi (wajib in itself).

Ulama please correct me if I have mistaken.

Respected brother muadh khan. This thread or other threads are not about following his fatwas neither anyone is forcing you or anyone else to follow his fatwas but .... I categorically state that I agree and will follow from now on every single fatwa of mufti as desai. I already follow 80-90% of his fatwas. So now you give me the right judge/slander/blame/question everybody else?

Personally I would go for the Hadith

'Aa'ishah (may Allaah be pleased with her), in which she said: The Messenger of Allaah (peace and blessings of Allaah be upon him) was never given the choice between two things but he would choose the easier of the two, so long as it was not a sin; if it was a sin he would be the furthest of the people from it Narrated by al-Bukhaari (3367) and Muslim (2327)

In the light of this hadith I make everyone witness here that I am leaving off this argument (for obvious reasons) on this thread. On the day of qayamat inshaAllah ta'ala when I will be granted the house I will remind all those who read this that I got this house because of leaving off an argument.

By stating "although I believe myself to be on the haqq" you have left a splinter before leaving especially by mentioning muadh khan specifically.
