We ( Me and my husband) have been in touch witha mufti sahab for every small issue in our lives for the last four years .. Any masla we call mufti sahab. alhamdulillah.. He has been using nokia x3 from the time we know him.. We decided last year to gift him with htc that has android application and he can download anything. Alhamdulillah we sent it across from dubai ( without warranty:( ) . Initailly he was so reluctant to accept that he told my husband although its a sunnah to accept gifts but thes kind of things are too advanced for him to undersatnd and use and if he ahs to use he has to depend on someone else to help him each time. And he doesnt like being dependant on anyone. But my husband convinced him that its given with full sincerity with no expectation from him of any kind. This is done only for allah. any masla/ fatwa that he gives inshallah we too will get the reward and any thing he does deeni we too get the reward. So looked he was a little convinced but told us I will accept it after ive done istikhara. we too agreed. alhamdulillah he accepted but waited for us to go to india and he could understand this from my husband . We went in sept last year and he showed my husband the cell fone that we gave him but there wer major problems with that fone there was no android market in that :( and since no warranty we could do nothing but took to every person dealing in htc but none could fix the prob :( . anyways that fone was eventually used only to receive calls. Now again a few days back me and my husband decided to buy another fone for him samsung and this time ask someone to get it from india for us with warranty and we download all applications and then send it to india with someone with warranty ... Now my question if we tell him that we wanna gift u another fone he mite feel embarassed which we dont want or might feel we are doing obligations which is not true again.. so , is it permissible that we tell him we spok to the htc company and by providing imei number they said this device was a faulty one and wer ready to refund and so with that money we got u this fone.. altho htc is not with us its with him in india... Our main idea is not to lie but jus that he does not feel embarassed.. I know his wife personally through him but I know if i speak to her she too will not agree.. what can I do about this... so confused

MashaAllah.

I don't think there's is a need for you to lie to him. Just be honest and tell him you, yourself are feeling guilty and you can't get over it, therefore you have something in its place that will remove the guilt and allow you to fulfill your main intentions.

Honesty is the best policy.

You could ask him another question and this time tell him the whole scenario of giving a gift but it turned out to have a defect and how you feel, then ask him what advise he would give.

Would he advise replacing the gift or would he advise lying about it.

Only this time when you are asking him the question, replace the mobile with cd player and tell him that this is an example.

If all fails, give to him as an eid gift with no ifs and buts.

Someone has suggested the following;

Quote:
Sister and her husband can update the ROM on the phone and will get market without getting a new phone + apps can also be downloaded on PC and transferred....no need to buy a new phone

See if the handset can be taken to experts who update softwares etc, taking it to HTC themselves may not help.
