In hilal judgement on moonsighting page 47 it is written

"Due to the weather being overcast the moon is not visible in most instances due to which difficulties are faced in establishing the dates of Ramadhaan and the two Eids. It is no hidden secret that according to the Fatawaa records of Daarul Uloom Deoband approximately 70 years ago Haz.Moulana Ashraf Ali Thaanwi ﺡ and Maulana Yusuf Binnori ﺡ ,Mufti Muhammad Shafi`a ﺡ , Mufti Vali Hasan Toanki ﺡ , Mufti Rashid Ahmed Ludhyanvi ﺡ and many others had advised the Muslims of Britain to adopt the sighting of other countries as it is highly difficult to near-impossible to sight the moon locally because of bad weather. The responsible Ulama from the Majlisul Ulama UK, which was renamed to Jami'atul Ulama Britain after consultation with Senior Scholars from Indian subcontinent, sent a detailed questionnaire over 35 years ago to the Daarul Iftaa in Deoband and in response it was mentioned that the sighting decision of the closest Muslim country, Morocco, should be adopted and there would be no problem in adopting the sighting of Saudi Arabia also since the announcement of a sighting is done in the correct manner. on page 49 it is written

"
(C) When the problem of Ramadhaan being commenced on different dates as well as Eid being celebrated on different dates in Morocco came to the fore and only a few Masaajid in Britain were such that they still followed the sighting of Morocco then the officials of Hizbul Ulama UK sent out a detailed query on 25 August 1986 seeking a Fatwaa from the Muftis of the Indo-Pak subcontinent specifically to Daarul Iftaa Daarul Uloom Deoband. All of them including Daarul Ifta Deoband had ruled that it was permissible to adopt the sighting decision of Saudi Arabia and some of them had even advised that the sighting decision of Saudi Arabia should be formally adopted permanently. (It should be noted that the Daarul Iftaas and all their Muftis are affiliated to the Hanafi Math-hab (School of thought). This should be an advisory guide to those who state that the Saudis are not Hanafis thus we should not adopt their sighting. If it was not permissible to adopt the sighting of Saudi Arabia due to the people not being Hanafi or if their sighting was based on the forecast and calculations of astronomy them all these Muftis including Daarul Uloom Deoband, Daarul Uloom Saharanpur and even Hadhrat 50Shaikh Zakariyyah ﺡ , Moulana Rashid Ahmad Gangohi ﺡ despite being Hanafis, did not prevent the following of the Saudi sighting. Some of them had in fact ruled it necessary for those living in India should fulfil any fasts missed in comparison to the Saudi sighting.) However maybe it would be best to avoid fighting and leave the matter to the ulama... i will follow this principal inshallah...

Quote:
Academic issues should be confined to the Ulama and Muftis who are expected to address these issues within their ranks with decorum and honour.

The layman is not tasked by Shariah to engage on academic issues. They are ordered to follow their Ulama.

When the Ulama differ, don't interfere. Never ever condemn any Alim or humiliate him.

Simply place your trust in your Alim of trust and abide by his decision.

There is no point in questioning his decision as you cannot be his judge.

If anyone, be it your friend or family, places his trust in one Alima nd abides by his decision, then respect his decision. If you care for your roohaniyat of Ramadhan or enjoyment of Eid, you will not confront him on his decision.

Bad weather is a one off. This month, the moon has been highly visible from everywhere in the UK.

When the moon cant be seen, I always thought that the month should be completed as 30 days.

What happen to the Hadith that state that the moon is for each locality.

OK,so we live in an advanced world. But thats what the kuffar tell us. They say this is the 21st century, why are we, the muslims, following an old system.

The way of the Prophet is from the first century till the last.

Asslamo Allaikum Dear Respected brother,

When you are done posting the references please let me know so they can be addressed, Insha'Allah. I will wait for you to complete so there is no doubt left in your mind that you are given a chance to put your side of the story with impunity.

In respect to the Fatwa of Shaykh (Mufti) Ebrahim Desai (HA) if you are an Alim, simply state so and I will back out of this discussion and Insha'Allah attempt to have an Alim reply to your references.

Afterwards all I request from you is "fear of Allah (SWT)" in judging the matter and the same request from everybody else reading this thread. If you are of the opinion that you can show me fatwa after fatwa and ruling from the madhab and I will NOT do anything and I am simply wasting time then I request that in the month of Ramadhan stay away from this discussion to safeguard your eemaan.

Jazakullah Khairun

Asslamo Allaikum,

I will give the User "Guest" 1 more day to add anything else of pertinence to the list before tackling all of this evidence in one go. It is a a series of misquotations and spin of the highest order.

Jazakullah Khairun

Salam i am not that knowledgeable about this subject and am not an alim but what i am saying that these are Knowledgeable god- fearing alims. Some are also ]friends of Allah.

If they honestly thought that following saudi was wrong (and remember this is not 4 or 5 ulama we are talking about here.) Why would these god-fearing friends of Allah

1) Follow Saudi.

2) Allow so many people to be deceived and follow Saudi.

They must have some legit reason why they follow Saudi and allow others to.

Plus as stated before this is not a few knowledgeable ulama, there are many and some are WaliAllahs, surely they believe following saudi is okay.

I am not arguing who is right because i am just laymen but surely we can trust these god-fearing Ulama. Finally ill quote Mufti Desai. ( I know im repeating myself but just read the bold and underlined bits.

It's a case of "Alaa bhalaa, Ghardan-e-Mullah". This is a pushton saying which I think means "Its on the neck of the Mullah"

This is very dangerous, as it is like shopping for a fatwa. You chose what suits you.

(This is not a personal statement upon anyone, just an addition to the thread)

Asslamo Allaikum,

With the greatest respect...

I am not looking for a debate either BUT when facts are pointed out that Shaykh (Maulana) Saleem Dhorat (HA) & Shaykh (Mufti) Taqi Usmani (HA) are being lied and slandered about and their position misrepresented to "make a point" and I am pretty sure that you are intelligent and knowledgeable enough to see that.

Read with the “Fear of Allah (SWT)” and be cognizant of the fact that you will stand in front of Allah (SWT) and made to answer for your deeds.

If you can see that Ulama are being lied and slandered then THE LEAST you can do is STOP propagating the group who is guilty of such transgression if you are not courageous enough to say something (which Islam DEMANDS from you), the least you could so is BACK  OUT to save your AAKHIRA!

If you can see that Ulama are being lied and slandered BUT still continue to say, “I am not knowledgeable enough” then I am Sorry but you are playing games with the truth! “

Unfortunately this is the problem...Most people SEE and REALISE a problem but they are MORALLY BANKRUPT to stand up and be counted for the truth.

Which is fine, nobody is calling anyone to stand up and go on a Crusade.

BUT the sign of true believer is that:

  1. When matters are made clear to him/her
  2. The least he/she should do is to remove himself/herself from supporting a group whose error has been made clear and manifest.

You have “MIS”quoted some Ulama in defence of following Saudi moonsighting in UK, it becomes our duty to remove the slander from these Ulama and to defend them so their position is NOT misrepresented.

And if you genuinely believe that you are not knowledgeable enough then you shouldn’t be posting on a subject which you have no knowledgeable of.

I feel very strongly about this. If someone thinks that its their right to “MIS”quote our Ulamah-e-Kiraam then it becomes our duty to set the record straight.

It may sound harsh to some but in the month of Ramadhan, thats how I feel!

PLEASE DO NOT MISQUOTE, TWIST, LIE, SLANDER ULAMAH!

TO CREATE A POSITION IN FIQH TO MIS-LEAD THE UMMAH!!!
