Am not asking if Mon or Thurs is possible for it to be Eid or not im asking if the scholar is ulama e haqq and i followed his actions to do eid on the day he does Eid would that be ok?

"InshaAllah.

A stupid point but, (Imagine in a few hundred years, The Muslims evolved into such a belief that January was Muharram, Febuary was Safar, March was Rabbiyul Awwal etc, the we would be doing Hajj in Christmass.)"

If the ulama doing it are "ulama e haqq" then why not?

even though i realise that hardly any or none of the ulama of Muftisays fully agree with following only Saudi (with at the least Mufti Farooq of Muftisays - this websites most senior scholar i assume - also publicly speaking against it and acting upon it also) however if the ulama e haqq scholar i follow is doing Eid azha next week on Mon shouldnt i be allowed to follow in his actions?

It just shows what a pathetic state we are in!

Our discussions may not make a difference to the scholars, but InshaAllah, when others see the VALID points being made, then, just maybe, the others could talk to their Imams and ask them their own view. Its just a way of making ones self heard.

(I have edited this comment, as it was pointed out to me to be an incorrect approach)

If you click on the quote button, it will be easier for others to see where you are coming from.

"He obviously would not be "Ulama e Haqq" would he?"

there are differences of views on many many issues between scholars - these differences are a mercy on the ummah (as u write on your blogs i believe).

Lets not take it out of context please.

The differences are in fiqh not fact.

If our Ulama follow Quran and Sunnah and are called Ulama e Haqq, thats one thing. If the others who say they are also of Ulama e Haqq but go against Quran & Sunnah then thats another thing altogether.

Infact the "NOT" Ulama e Haqq who have adopted this idea of the months being different does exist, they are known as "The Nation of Islam" if you are of them, then i'm sorry for you. If you are not, then please stop being silly.

Asslamo Allaikum,

Differences of opinions need to be evaluated on a case by case basis and not everything which comes out of Scholar can be deemed legitimate or Authentic e.g. if a Barelwee Scholar thinks that the soul of Rasulullah (Sallaho Alaihe Wassallam) comes at a Milad and therefore they stand, would we consider this as valid or Authentic simply because it comes from a “Scholar”?

Once a Scholar gives an answer it needs to be looked, if it indeed a difference of opinion (valid and held in classical Islam) then we look at the strength of this opinion and sometimes you will find that it’s a weak opinion (valid nonetheless but weaker opinion).

In case of moon sighting you need to look at the facts:

  1. Fact 1: Accepting Saudi Arabian moon sighting VIOLATES the conditions set forth by Hanafi Madhab of the number of witnesses required
  2. Fact 2: The conveying of the news of Saudi moon sighting to UK VIOLATES the conditions set forth by Hanafi Madhab in conveying news of sighting
  3. Fact 3: If you answer fact 1 & fact 2 by saying that these sightings are done in a region dominated by Hanbali Madhab and we accept their sightings based on their criteria (i.e. that of Hanbali Madhab) then accepting Saudi sighting for UK VIOLATES the Hanbali Madhab because in their Madhab each region MUST sight the moon locally!

Therefore:

  • First and foremost there are NO MAJOR ULAMA in the world (Hanafi or Hanbali) who are calling for UK to accept Saudi sighting
  • Seconfly, there has NO precdence in the Muslim Ummah for 1400+ years to make moon sighting of 1 area the criteria for another!
  • Thirdly, the local Ulama who follow Saudi sighting are basing their opinion IN CONTRADICTION to both Hanafi & Hanbali Madhab therefore their opinion CANNOT be accepted as “valid difference of opinion”.

If you agree with Taqleed then do Taqleed i.e. follow your Madhab and in case of difficulty another Madhab with its conditions. In this case those who are calling to follow Saudia are recommending a "botch-up model of two Madhabs and cherry-picking".

Fortunately we follow Islam & not Catholicism so the verdicts of the Scholars have to be evaluated and judged and not simply implied because in Islam Ulama are not considered infallible.

Argument 6 (British Deobandees):

I am an American and I can assure you that no other Deobandees in the world follow Saudia for their moon sighting anywhere in the West or East.

So where do the British Deobandees get this from? particularly when there is no Fatwa or precdence for this action and insist on their position being right?
