You contradict yourself here, as in your first point you say:

Let us all celebrate Eid as it should be done and leave the arguments aside.

We could argue like this for so long but it won't make this Eid,one where we all have it on Wednesday.

There's way's of letting people know information and arguing with them isn't one of the best ways to go about it.

I dont think brother Muadh is contradicting himself, because it all bores down to what the mosque decide. Therefore the argument ends up there. Any way, its not an argument, it is another way of showing people what the truth is. Imagine all those people who fast on a day when it is Haram to fast, and all those who only worship Allah on the 27th of Ramadhan knowing that Laylatul Qadr is on an odd night, but because of this farce, it is on an even night. I hope I make sense.

The point is, "The Ulama of the local mosque dont have a say". (In certain places) The mosque is run by non Ulama.

I hope this makes the picture a bit more clearer.

A narration of Ibn 'Abbas in Sahīh Muslim indicates that local moonsighting alone was the prevailing method in the time of the Blessed Prophet (صلى الله عليه وسلم) and was a part of the teachings of the Blessed Prophet (صلى الله عليه وسلم) to the Sahābah. The narration goes like this:

Sahīh Muslim Book 6
Chapter 5: THERE IS A SIGHTING OF THE MOON FOR EVERY TOWN THE SIGHTING AT ONE TOWN CANNOT BE HELD VALID FOR THE OTHER TOWN SITUATED AT A CONSIDERABLE DISTANCE FROM IT.

Kurayb narrates that Umm al-Fadl sent him to Mu'āwiyah in Sham for something.
Kurayb says, "I went to Sham and finished the job. I was in Sham when the month of Ramadān began and we saw the moon the night of Friday. When I reached Madinah at the end of the blessed month, Ibn 'Abbas asked me about Sham. (After answering him) He then asked me when we saw the moon.
I said, 'We saw the moon the night of Jumu'ah.' He asked, 'Did you see it as well?' I said, 'Yes, I saw it too and many others saw it and we all kept fasting and so did Mu'āwiyah (that is according to that moonsighting).' Ibn 'Abbas said, 'But we saw the moon on Saturday night, therefore, we will keep fasting for thirty days according to that unless we sight the moon on the 29th.' I asked, 'You don't think the moonsighting of Mu'āwiyah and his fasting is enough for you?' Ibn 'Abbas replied, 'No, this is how the Blessed Prophet (صلى الله عليه وسلم) taught us.'"

This hadith is clear evidence. When Ibn 'Abbas was informed by the person who himself sighted the moon that the people of Sham had begun Ramadān one day before, he responded that it was not only his opinion, but also the teachings of the Blessed Prophet (صلى الله عليه وسلم) that the moonsighting of another locality was not compulsory upon them.

Are we of Ahle Sunnah Wal Jama'ah or are we "Ahle Committee wal neighbourhood".
It looks like we all come under the committee umbrella. Allahu Alum.

Maybe contradict was the wrong word..

Yes I've noticed he's put commas but the point that I wanted to make was made bold (see post) via brother Muadh's words.

You need to be specific and precise when you speak or type and avoid errors like:

If it's not an argument why did you yourself say it was?

You could have just deleted that line... not let it get posted?

Anyway I'm full of faults too can't post a decent post and I suppose it's easier to see the faults of others than your own even if we have more faults ourselves.

May Allah grant us all onto the siratul mustaqeem forgive our faults and I ask you guys to forgive me if I have caused any hurt.

I'll just stick to reading in future.

Jazakallah for pointing that out.

Please dont just stick to reading and arguing with the computer, take it out on the forum, we all make mistakes and I'm the first one to apologies.

Sometimes I am typing from my phone, so I dont realy look at what has been typed out. Sorry about that.

all points need to be understood, this way, we know where we stand. I like to be corrected so that I learn more, otherwise I will always be making the same mistake and making that a part of me and my way. I dont want that to happen.


Just to point out Jolly Soul did say "leave the arguements aside" Hence the reason for me also using that word.

I am not saying that brother Muadh_Khan has a ego,i am just stating a bit of critisism,dose person a good,it keps them down to earth.

You mean An Ego. We are all Learners here with a Capital "L". I havent told Brother Muadh this, but now he knows, I look up to him, I learn a lot from him and I dont even know him. Personaly I believe he deserves the respect I have for him, and that goes to all the Authorizers and Admin too, and thats just my opinion, I am new to this site's forum, although I joined many years ago, I never came to the forums, I was only posting on the Blogs. Any way lets try to keep to the subject. Jazakallah

Salaam, have I missed something? Who is proving who wrong? Brother Muadh and I are in agreement about this issue. We are both giving our views and experiances. This year Eidul Adha should have been on the 17th but instead, every one is doing it on the 16th because of Saudi Arabia. Did you not read the Hadith above?

Not Seen (Cloudy): HiMY SYeD (MCW member) from Toronto Ontario reported: Shortly after praying Maghrib at home, under overcast skies I walked around the neighbourhood to look for the moon on Saturday, Nov 6. Unfotunately due to low hanging clouds almost right across the western horizon, it was not possible.

India
Not Seen: Syed Thanveer Peeran (MCW member) from Kolkata reported: On Saturday, November 06, 2010, We could not see the MOON in Coimbatore, India. We tried to look from sunset to moonrise , but could not see the MOON. Skies were not clear it was cloudy here.

Indonesia:
Not Seen: AR Sugeng Riyadi (MCW member) from Surakarta, Java reported: The New Crescent of Dzulhijjah 1431 AH was NOT SEEN from Surakarta - Central Java - Indonesia, on Saturday, November 6th, 2010 because the sky was totally cloudy.
According to information, the Government of Indonesia will hold a hearing itsbat on Monday, November 7th, 2010 at 10:00 am. 'Iedul Adha 1431 AH in Indonesia would be difference, because the Muhammadiyah had set down on Nov 16th, 2010, and the Government according to the criteria "Imkan Rukyah" will very likely set a Dhu al-Hijjah 10th, 1431 AH = November 17th, 2010.

Pakistan:
Not Seen: Sultan Alam (MCW member) from Karachi reported: Today, on my request, nearly 100 persons ( members of the moon-sighting committees of our institute "JAMIA-TUR-RASHEED" + my friends + their companions) tried to sight the moon all over Pakistan at more than 21 places but the moon could not be sighted, as it was astronomically expected tonight. Almost it was clear sky all over Pakistan.
My 2 respected teacher and friend are this time in Madinah (Saudi Arabia). They tried to sight the moon by naked eyes but not sighted as it was expected astronomically. Sky was clear.


Saudi Declared: Riaz Husain from Luxembourg (mother in Karachi) reported: While talking to my mother in Karachi, she told me the local TV there is reporting that Saudi Arabia has declared that the moon for Zil Hajj has been sighted and that 1 Zil Hajj will be on Sunday 7 November.

South Africa:
Not Seen: Rashid Motala (MCW member) from Durban reported: The Hilaal was not sighted this evening in Durban, S. Africa. Monday will be the 1st.

Not Seen: Dr. Abdurrazak Ebrahim (MCW member) from Cape Town reported: The Dhul Hijjah Hilaal was not sighted in Cape Town or in other areas of Southern Africa on this Saturday evening, 06 November 2010 [end of the 29th Dhul Qada]. The official first day of Dhul Hijjah will correspond with Monday, 8 November 2010, and the Day of Sacrifice will be observed on Wednesday, 17th November 2010.

Saudi Arabia:
Official Announcement: Mrs. Lubna Shawly (MCW member) from Jiddah reported: The Arafat day (Hajj) in Makkah will be on November 15 after Saudi authorities announced on Saturday. Eid al-Adha is set for Nov 16, Tuesday.

UK:
Not Seen: Hamid Chaudry from Blackburn reported: On Saturday 6th November, 2010, the moon was not sighted in Blackburn. Sighting was tried around sunset, from 6:30 to 6:40pm.

Not Seen: Qamar Uddin (MCW member) from York reported: On Saturday 6 November 2010 (29 Dhul Qaidah 1431 AH) many people from throughout UK have attempted to sight the crescent moon (Hilal) of Dhul Hijjah after sunset. None of the groups were able to sight the Hilal even though some places had clear sky. We have not received any reliable sighting news (Muhaqaq Ruyat-e-Basari) from any countries east of UK/Morocco either (including negative sighting report from South Africa). Therefore, the Ulama in UK (including Wifaq/Bately) have decided that the month of Dhul Qaidah 1431 AH will complete 30 days and the month of Dhul Hijjah 1431 AH will start from Monday 8 November 2010 (i.e. Eid ul Adha will be on Wednesday 17 November 2010), Insha-Allah.
Please note that I have spoken with a member of six Saudi Hilal Committees; unfortunately none of the committees could sight the Hilal with binoculars or telescopes, but the usual persons from near Riyadh (Saqra) claimed sightings and hence the Saudi supreme court accepted their reports as it matched the pre-calculated Umm Al Qura calendar! According to Moonsighting.com, this sighting is not authentic.



Not Seen: Mohammad Ali Javed (MCW member) from Luton, Bedfordshire reported: On Saturday 6th November 2010 many people including myself in Luton have attempted to sight the Hilal of Dhul Hijjah after sunset. The skies were clear but we were not able to sight the Hilal. The month will complete 30 days and Dhul Hijjah 1431 will start on Monday 8th November 2010. So Eid-ul-Adha will Insha'Allah be on Wednesday 17th November 2010.

USA:

Not Seen (Cloudy): Mustafa Eroglu (MCW member) from Denver, CO reported: On Saturday November 6th in Denver Colorado I was unable to sight the new moon for zhul hijjah due to partial cloud coverage in the area of the moonset.

Not Seen: Javad Torabinejad (MCW member) from Blacksburg VA reported: This evening (Saturday, November 6, 2010), the crescent moon of Thul Hijjah was not sighted in Blacksburg, VA, using optical aids (binoculars: 7X50 and 10X50). I arrived at my sighting location at 5:54 (sunset: 6:18 pm EDT) and started looking for the crescent in the expected area within a clearing streak in a mostly cloudy western horizon. I stayed there till 6:34 pm (moonset: 6:28 pm EDT). At 6:20 pm, the temperature, dew point, relative humidity, and pressure were 35.6 F, 21.2F, 56%, and 30.28 in, respectively. Earlier today, using binoculars I attempted a daytime sighting with no success. The sighting effort was on and off for a period of about 4 hrs starting around noon. Venus was sighted at 12:25 pm first with a pair of binoculars and then with naked eye. At 2:00 pm, the temperature, dew point, relative humidity, and pressure were 42.8 F, 24.8F, 49%, and 30.20 in, respectively.

Not Seen: Imam Salim Chishti (MCW member) from New Lebanon NY reported: The crescent for Dhul Hijjah was not seen in New Lebanon, New York, the evening of Saturday, November 6. There were many clouds on the western horizon in the approximate location where the crescent could have been. In New Lebanon we will follow the FCNA ruling.

Seen: Engr Manzoor A Mian (MCW member) from Melbourne, VIC reported: I am please to report that crescent was sighted in Melbourne today 7/11/10 Sunday eveving, Therefore tomorrow, Monday 8th November will be 1st of Dhul Hijja. 'Eid ul-Adha will fall on Wednesday 17th November, 2010.

India:
Cloudy in Godhra, but seen in many parts of India: Iqbalhusen Bokda (MCW member) from Gujrat reported: On Nov 7, weather was cloudy here in Godhra, but moon easily seen in many parts of India including Surat, Bhopal, Delhi, Valsad and other cities of India.

Not Seen: Mohammed Ali Qazi (MCW member) from Mumbai reported: The Sky was clear still Dul-al Hajj MOON NOT seen by naked eye on evening of Sunday 07-11-2010. We will wait for any announcement for by Local Moon Sighting Committee.

Not Seen: Furqan Abdussubhan Dadan on behalf of Abdussubhan Dadan (MCW Member) from Mumbai reported: I wish to inform you that Dhul-Hijjah crescent has been sighted in MUMBAI from the minnarah of Jamma Masjid, Mumbai today 7th November after Magrib (at 6:40 pm) The beginning of Dhul-Hijjah (1st Dhul Hijjah) has been officially declared by the Mumbai Jamma Masjid Hilal Committee. Hence, Eid-Ul-Adha will insha-Allah be celebrated on Wednesday, 17th November 2010.

Iran:
Seen: Mohamad Soltanolkotabi (MCW member) from Esfahan reported: Although it was hazy, I could observe the crescent first by binoculars and later by naked eyes too. The first observation was at 17:07 through 20*90 binoculars. Apparent Sunset: 17:07.

Kuwait:
Seen: Abdulaziz Al-Sumait (MCW member) from Kuwait reported: On Nov 7, I saw hilal of Dhul-hijjah in the Medical Herbal Islamic Center north west of Kuwait City right after Maghreb Prayer from 17:15 until 17:25 where it was obsecured by clouds; horns were at 12:30 and 6:30; hilal was sharp and magnificent, seen by binocular. Sun set in Kuwait was 16:59, moon set 17:49. But Eid Aladha is set for Nov 16, based on Official decision.

Mauritius:
Seen: Goolam Tegally (MCW member) from Port Louis reported: Hilal was sighted this evening, Sunday 7 Nov here in Mauritius despite clouded sky. We will therefore celebrate Eid on Wednesday 17 Nov.

Morocco:
Seen: Ehsan H. Hajar (MCW member) from Casablanca reported: I saw the moon around 1800LT, in the SW horizon sharp and magnificent; sky was obsecured by clouds most of the evening; horns were at 12:30 and 6:30 well lit. Hoping on Official decision of ministry of Habous to announce beginning of ZHJ as Monday Nov 8th 2010.

Norway:
Not Seen: Imran Mushtaq (MCW member) from Oslo reported: On Saturday and today Sunday, the moon was not sighted in Norway. Islamic Council of Norway, according to the Hijri calender agreement, declares the start of Dhul-Hijjah in Norway as The 1st of Dhul-Hijjah on Sunday 7th November 2010 and Eid-ul-Adha will be InshaAllah in Norway on Tuesday 16th November 2010.

Pakistan:
Not seen by me / Easily seen by others: Asif Hussain (MCW member) from Hyderabad reported: On Sunday 7th November 2010, I with my fellows at two different places in Hyderabad, Pakistan, tried to see the moon from sunset 05:42 pm to moonset 06:33 pm but moon was not seen. Skies were foggy. But moon sighted successfully at different places of the country. Government officials declared through television media that moon has been sighted at numerous places of the country, therefore the 1st of Dhul-Hijja 1431 Hijra will be on Monday 8th November 2010. It means the Eid-ul-adha in Pakistan will be celebrated on Wednesday 17th November 2010 inshaALLAH.

Not seen by me / Easily seen by others: Sultan Alam (MCW member) from Karachi reported: On my request, Today (Sunday, 7 November 2010 = 29 Zul-qa'dah 1431 in Pakistan) more than 100 persons (Members of the moon-sighting committees of our institute "JAMIA-TUR-RASHEED" + my friends + their companions) easily sighted the crescent at more than 7 places countrywide. As it was very hazy in Karachi hence I and my other friends could not sight the moon in Karachi.
Note: Chairman of central official moon sighting committee of Pakistan mufti Munee-bur-Rahman told me on my mobile phone that they have sighted the moon in Islamabad and have received many positive reports countrywide thus he officially announced that 1st Zul-hijjah 1431 will be on Monday 8 November 2010 in Pakistan after ending the 29 days of Zul-qa'dah 1431.

Not seen by me / Easily seen by others: Yousuf Rajput (MCW member) from Rawalpindi reported: On Nov 7, although the weather of Rawalpindi was at the time of Magrib is clear, little dust on horizon, but Moon could not be able to see through naked eye.
As per Royet-e-Hilal Committee of Pakistan, the MOON of Dhul-Hijjah 1431 has been sighted. ALHAMDU LILLAH So Eid will be on 17th November 2010 in Pakistan, Inshah Allah.

Qatar:
Seen: Muhammad Imran Paracha (MCW member) from Doha reported: The Dhul Hajja hilal was sighted by myself and wife here in Doha on Sunday at around 5:10 p.m. (20 minutes after sunset) on Nov 7. It was a very thin crescent peeking over the thin clouds dispersed over the horizon. It was spotted by naked eye but we confirmed with binoculars as well.

Saudi Arabia:
Seen: Luqmaan Williams (MCW member) from Ta'if reported: I spotted the hilal in Ta'if to welcome in Dhul Hijja on Sunday, November 7, 2010. It was very faint because it was cloudy. I was alone. Ok, So this guy was alone

Sri Lanka:
Overcast, but seen in other towns: Nular Bary (MCW member) from Colombo reported: On Sunday (7/11/2010), 29th of Dhulkahda 1431H in Colombo Sri Lanka the western sky was overcast, but there was reports from Weligama a town down south of Sri Lanka clear sighting of Dhulhaja crescent this was confirmed by our Hilal committee head Molavi Riyal. Hence the committe have decided to start the Month of Dhul-hijja 1431 on 8th. Monday & celebrate Eid ul alha on 17th November 2010, "Inshaallah"

Sweden:

By the way, The Anjuman-e Al Baiyinaat, Sweden has declared that they will celebrate the Eid-ul Adha 1431 Hizri on Wednesday, 17th November 2010, Inshallah. Eid Mubarak.
Note: All Scandinavian countries like Sweden, Denmark, Norway, Finland (which will not be able to sight the crescent moon in this Arabic month Mahe Jeelqadd 1431 Hizri even in 30th day because of regional variation) should follow their nearest Muslim country which follow the actual crescent moon sighting like Morocco, not the official announcement of High Judiciary Council of Saudi Arabia based on fake and impossible sighting report. Alhamdulillah, Morocco have sighted the crescent moon today Sunday, 7th November, 2010.

Seen: Javad Torabinejad (MCW member) from Blacksburg VA reported: Today (Sunday, November 07, 2010), my daughter, and I were able to sight the moon in Blacksburg, VA. Upon arrival at our sighting location, we sighted the crescent at 5:36 pm EST (sunset at 5:17 pm EST). At 5:44, the crescent was about 4.5 degrees above the horizon. The horns were at 1:30 and 6:30 O'clock (1:30;3:30;6:30). At 5:40 pm, the temperature, dew point, relative humidity, and pressure were 42.8 F, 23.0 F, 46%, and 30.25 in, respectively. We left at 6:00 (moonset at 6:19 pm EST). The sky was clear with some haze.
Earlier in the day, around 11:32 am EST, I tried a daytime crescent sighting with success. At 11:50, I was able to see Venus, first using a pair of binoculars (7X50) followed by naked eye. Eight minutes later, at 11:58 am EST, I sighted the crescent using the binoculars. The horns were at 11:45 and 3:45 (11:45;1:45;3:45). Later, my daughter, son, and wife sighted the moon using the binoculars. At 12:00, the temperature, dew point, relative humidity, and pressure were 42.8 F, 24.8, 49%, and 30.37 in, respectively. It took three more hours before I was able to see the moon with naked eye at 2:58 pm. At 3:00 pm, the temperature, dew point, relative humidity, and pressure were 44.6 F, 23:00, 43%, and 30.27 in, respectively. I stopped following the moon at 3:16 pm. The sky was mostly clear with passing clouds and hazy. Note: I used the Sky & Telescope Interactive Sky Chart.

Seen: Hussain Almohri from Lexington VA reported: I sighted the Hilal at 5:19 PM EST on the I-81 highway after Lexington, VA. The Hilal was visible at least until 5:50 PM EST. The moon looked like from 12 to 7 clockwise and it was at 7 degrees of elevation.

Dhul-Hijjah begins at Maghrib on Sunday, November 7, 2010 based on multiple authentic sighting reports. People have sighted the moon in several towns including New York City, NY, Roanoke, VA, Orlando, FL, Miami, FL, and Elgin, IL. As such, the 1st day of Dhul-Hijjah will be Monday, November 8, 2010. Eid-ul-Adha will be on Wednesday, November 17, 2010. An early Eid Mubarak to all from the Chicago Hilal committee.

Seen: Azat Badretdin from Dickerson, MD reported: I would like to report a successful moonsighting for the month of Dhul-Hijjah. Time of Sighting: 2010/11/07 17:30 Clear with slight haze below the Hilaal. Astronomical parameters according to US Naval Observatory calculations:
Sunset time: 17:00+-0:05
Moonset time:18:00+-0:05
Sun azimuth at the time of the sunset:249.1 deg. Moon azimuth at the time of the sunset: 228.7 deg
Observed azimuth during the time of moonsighting relative to the azimuth of the visible projection of the sun to the horizon matched the calculated angular differential.
Roughly 15 min before and after the time of observing Hilaal, we were not able to see the Hilaal.
Moonsighers: Sheikh Mu'addin, Br. Atif Chaudry Br. Azat Badretdin. All three moonsighters were able to see the Hilaal

Seen: Talib Abu Hamzah (MCW member) from Douglasville GA reported: On Nov 7, by Allah's mercy, the moon was sighted here in Douglasville and Atlanta, GA, again as has been done monthly. Sighted by Abu Hamzah & Um Hamzah Abdul-Malik

So according to the Hadith and the sighting of the Hilal in different places, makes Eid on the 17th. Its not an argument, its a fact. We need to follow the Shariah

Yes Aameen, May Allah accept our worship. But how will we observe the fast listed below. In reality we will be doing Eid on the 9th, so what about our worship that we are asking Allah to accept?

It is particularly encouraged to fast on the ninth day of Dhul-Hijjah, known in Arabic as Yawm Arafah. The Prophet used to fast on this day [an Nisai and Abu Dawud]. Fasting on this day will expiate a Muslim's sins for two years.

Abu Qatadah reported that the Prophet (salAllahu alayhi wasalam) said:
Fasting the Day of Arafah will be credited with Allah by forgiving one's sins of the previous year and the following year.

One of the wives of the Prophet (salAllahu alayhi wasalam) said: Allah’s Messenger used to fast the (first) nine days of Dhul-Hijjah, the day of Ashura, and three days of each month.

The day of Arafah is the day when the pilgrims stand in worship on the Mountain of Arafah. It is the best day of the Whole Year.

Fasting the day of Arafah expiates the [minor] sins of two years: a past one and a coming one. And fasting the day of Ashura expiates the sins of the past year.

Personaly, I realy want my sins to be forgiven, so if I fast on the 9th and everybody else is celebrating Eid, according to them, my fast would be Haram. I am stuck. Get it. It is a big thing to discuss. I pray to Allah that the scholars of each and every country adopt the method of the Prophet(SAW), atleast we get whats on offer by Allah (in simple terms).

Would any one go to the "Sales" a day early or a day late? No I didnt think so, we all want to take advantage of whats on offer at the time.

All these discussions are so unnecessary...all of us are following scholars of the Ahlus sunnah wal jamaa'ah. Its not as though either side are following ignorant, misguided or bad'atee scholars. In any "mujtahad fi" (i think its called) matter, one can follow whichever side one's heart inclines toward or just follow the local imam or the majority or pick the more difficult option based on strong taqwa.

Allah ta'ala is not going to hold us responsible since we are still following scholars of Haqq. He is not going to deprive any us of the benefit of yawmul Arafat or any other day insha Allah

A stupid point  but, (Imagine in a few hundred years, The Muslims evolved into such a belief that January was Muharram, Febuary was Safar, March was Rabbiyul Awwal etc, the we would be doing Hajj in Christmass.)
