JAAHILS OPPOSE ULAMA

If the article below is correct, then it unfortunate and a bad reflection on elders of Dewsbury Markaz. All the Ulama and respected people of should condemn such an attitude of non-Ulama who purport to represent Shariah through mere association of the Markaz. Non-Ulama should never interfere with the rulings and guidance of Ulama. The unanimous ruling of the Ulama in Batley, and well supported by the general Ulama of UK, should be seen as a positive breakthrough for the Muslims of UK, an opportunity for unity and adhering to Shariah. The interference of Jaahils should be condemned and stopped. The Markaz should distance itself from such Jaahils and protect the integrity of the noble work of Da'wah and Tabligh. The muslim public should express their concern to the elders of the Markaz.

-Mufti Ebrahim Desai

.....

Ru'yat e Hilal and Tablighi Jam'aat

Afterthe good news coming out from Batley, where the Ulama Ruled on andtruth after much effort, to follow the correct Sunnah method, it iswith great regret and disappointment that I have to write that thosewho previously advocated following the Sunnah and the way of theSahaabah, and who also advocated that the "Ulama are the inheritors of the Ambiya", and the laymen must follow them, namely the Tablighi JAMAA'AAT,ARE TODAY coming out openly in condemning the decision of the respectedUlama, and are trying their best to over turn the Batley decision.

These ELDERS meaning the members of their shuraa, which does not consist of even one AALIM, are behind the opposition of this revived SUNNAH. This is the same Jamaat that has as its Usool laid down by the founder, the Great Aalim Hadhrat Moulana Ilyas RA , that this Jama'aat of laymen will not interfere in the Masaail, that is the work and responsibility of the Ulama e Kiram.today the condition is such that the whole Shuraa goes to theinfluential people in the Masjid trust telling them to disregard theruling of the Ulamaa, if this happens this would be a sad day for the Ummah. As we should be aware that if one wants to destroy the Deen and theImaan of the Ummah, History has showed us that this will be done by creating a veil between the laymen and the Ulama. It is a pity that this role of creating a veil is being carried out bya group who claim to be propagating the truth and forbidding wrong andsin. A great pity that they have reversed their role and now forbiddingacts of Sunnah (may Allah protect us) Aameen. This is the same Tablighi Jamaatthat used to say that this is a Mas'alah for the Ulama, not for thepublic, it seems that now this Shuraa has relegated the Ulama toposition of laymen and promoted themselves to the position of the Ulama.

Ipersonally think that to go against the likes of Hadhrat Moulana AbdurRauf Saheb DB, Hadhrat Moulana Sulaiman Bodiyat Saheb, Mufti Musa BadatSaheb, Mufti Yusuf Sacha Saheb and Moulana Yusuf Mama Saheb is indeed agrave mistake, and if these people (Shuraa of Dewsbury Markaz) who want to Abandon thecorrect Sunnah, prevail, it would be calling on the wrath and anger ofAllah Almighty to hit the community. A fatwa of Mufti Ebrahim Desaiwhich is on the askimam website, comes to my mind, it states: "It isFardh upon the Ulama and senior people to correct the open wrong offollowing Saudi announcement of the lunar month. It is disturbing to note that responsible people of the Tablighi Jamaatare thwarting the efforts of Ulama e Haq on Nahi Anil Munkar (stoppingthe wrong). This attitude has been one of the twobiggest concerns of Hazrat Maulana Ilyas Saheb (R.A) before his death. He expressed his concerns to Hazrat Mufti Shafi Saheb (R.A) that whennon Ulema lead this effort and non-Ulama are given prominent positionsin Tabligh, they will lead the people astray. (Taqrir Tirmidhi Vol 5).

Inthe discussion of the imbalances of Tabligh Jamaat, in the above quotedreference, Hazrat Mufti Taqi Uthmani Saheb Madda Zillohu states that:

Theignorant people engaged in this effort become Muftis and also issueFatwas. If responsible people of Tabligh Jamaat conduct themselves in airresponsible manner as explained by yourself, then that is a completedisservice to Deen. The elders of the Markaz who are non-Ulama areengaged in "Fatawa" which is beyond their jurisdiction and ability. That is extremely dangerous for the ummat. One can understand theconsequence of following the Fatwas of ignorant people and becoming anobstacle in propagating Haqq and stop wrong. They cannot claim beingcharacterized by Amr bil Maroof and Nahi anil Munkar which is thesalient feature of the noble work of da'wah and tableegh".

"HazrathMoulana Inamul-Hasan Saheb (RA), the former Ameer of Tabligh hascategorically emphasized that an effort should be made to follow thecorrect criteria of moon-sighting. His letters have been widelycirculated and could be seen on the website. It is the responsibilityof every Muslim of UK, Ulama, Trustees of the Masaajid Organizationsand masses to be firm on Haq and not to compromise on this. Following Saudi is a Munkar and an open wrong".

Furtherthis all seems to be politics played at the highest level, as thisopposition from Markaz is only due to their open Enmity with MoulanaYaqub Saheb Qasmi DB. They are ready to forsake the haq and truth fortheir own worldly gains, there is not an element of Shariah behind thethinking of these Shuraa members. Do they really want us to follow theJamiat? Whose Aqaaid areopposite the Aqaaid of the Akaabir Ulama of Deoband as they do notbelieve that our great Prophet PBUH is alive in his grave? The Holy Qur'aan mentioning the qualities of the Believers States" The believers men and women, they are 'Auliyaa' of one another, they enjoin good and forbid evil.." Al Towbah V 71

Regarding the Munafiqoon, the Qur'aan states in the same surah verse no 67: "The hypocrites, men and women, they enjoin Al Munkar, (sins Disobedience) and forbid from doing good"

What road are these supposedly Daa'ees taking? The path of the Al mu'minoon or the path Al Munafiqoon? By encouraging people to forsake the opinion of Deobandi Ulama of great calibre, and follow a group of Misguided Mamaatees (elders of Jamiat ul Ulama Britain). By encouraging the people to forsake the Fardh Alal kifaayah of local sighting, and telling the people to follow a precalculated calendar, these people I am afraid are going astray and leading other people astray. Itwould be devastating to see those who were at the fore front of theTablighi Jama'at from the early days to fall in the trap of Shaitaanthe accursed, may Allah protect us and them. Aameen.

Mymessage to my fellow Ulama is very simple, it is now time to stay firm, our Deen does not allow us to follow the Shariat of any otherindividual other than the Shariat of Muhammad Rasoolullah PBUH, hencewe must come out and openly condemn those who are preaching wrong, remembering the fact that respect and humiliation is in the hands ofAllah alone, hence there is no need to fear no one. As for the laymen,I strongly advise that you remain steadfast and follow the Ulama e Haq, who have an Aqeedah conforming to Akaabir Ulame Deoband.

May Allah guide us and give Hidayah to anyone who strays away from the truth Aameen.

....
I say this calls for a boycott!

Assalamu 'Alaykum Warah Matullahi Wabarakatuhu

Any fair minded person reading this post, will Insha-Allah Ta'ala think twice about the contents of the article in question. It is no wonder that Hazrat Mufti Ebraheem Sahib started off his answer with "if this is true". In other words, claims are totally and horrifically unsubstantiated.

In fact, there are several inconsistencies contained in this particularly venomous article which need addressing.

1. There are at least two 'Alims on the Dewsbury Shuraa that I know of, and ironically Hazrat Maulana Yaqub Qasmi is one of them. He is part of the original Shuraa. Masha-Allah I know he has a lot of Muhabbat for the Markaz Akkaabireen and vice versa. The differences of opinion (whatever they may be) are not ones imbued with malice but one full of Muhabbat, as the Ikhtilaaf between our Akaabireen are known to be. Hazrat Haafiz Sahib and other Shuraa members regularly have contact with Hazrat Maulana Yaqub Qasmi Mz Al-hum-Du-Lillah .

2. The entire Shuraa are not based in Dewsbury, but all over the UK. There are Shuraa
members from London, Preston etc. so the story of the entire Shuraa going to each masjid is awfully dramatic to be perfectly honest.

3. To accuse that the Respected Shuraa are "coming out openly in condemning the decision of the Respected Ulama", is incredibly bold, to put it very lightly. Where is the evidence of this statement? I know for one that Hazrat Maulana Abdur-Rauf Mz who regularly frequents Dewsbury Markaz, and one of the close confidantes of Hazrat Haafiz Sahib Mz. is not at loggerheads with the Shuraa. There is no break-up which is even remotely perceivable in Batley or Dewsbury as is suggested here.
More importantly, with such a serious accusation, where is the evidence? Why the scaremongering

4. Notwithstanding, the Dewsbury Shuraa consists of Hazrat Haafiz Sahib Mz who without Mubalighaa (exaggeration) is one of the Major Shuyookh of the UK. He is the Khalifah of erudite 'Ulamaa like Hazrat Maulana Yusuf Motala Mz, and Hazrat Maulana Abdul Hafeez Makki Mz. Such Eminent 'Ulamaa who have great trust in Hazrat Haafiz Sahib Mz. To aim such virulent epithets like these are not only greatly distressing but are a source of great dissension, and unnecessary fault finding.

5, What boycott is the person asking for? Al 'yaathu Billahi min Dhaalik!

Disingenuous articles like these clearly serve to cause dissension, and sow malice and hatred in the hearts for our Pious Elite like Hazrat Haafiz Sahib Mz. Clearly this is not palatable, and must be challenged robustly.

Please, more clarification, What is the Haqeeqat of this article of vociferation?

Was-Salaamu Alaykum

Jazakallah khairun, 'peacenow' - a very well expressed response.

Indeed, anonymously penned articles often lack the wisdom of an author who stands by his words and should probably be discarded at best.

If we are taught to reason with the non-muslims with gentleness and wisdom, then surely when dealing amongst ourselves, we have to be even more calm, collected and reasonable. No doubt.

In shaa Allah, those who have read this anonymous article will now benefit from a counter-reply and understand that there is no good in inflaming situations between Muslims in this manner.

May Allah increase our love and mercy towards each other and guide us all towards truth and piety in every sphere of our lives. Aaameen

"There's no smoke without fire"

If there's no truth to this and its just some anti-dawah guy/girl making stuff up for fun and games. Why would Mufti Ebrahim have it up on his website?

There are hundreds of anti-tabligh posts/articles made everyday. What makes this one stand out?

I'm not saying its true. I also refuse to stick my head in the sand like an ostrich and deny the possibility that there is some truth to it.

Either way now it is out in the public domain there should be some kind of official response.

Agreed. 'Sticking one's head in the sand' is not an option.

The issue was that this kind of article is inflaming the situation by firing up the general public. The 'call to boycott' which appends the article highlights that all too clearly.

"Boycott what?" it is rightly asked. The tablighi jamaat movement ? The Jamiatul Ulama ?

In fact that reminds me of a point in the article which confused me somewhat ... the article refers to a 'group of Misguided Mamaatees (elders of Jamiat ul Ulama Britain)'

Is not the Jamiatul Ulama a group of ULAMA ? If so, why are they being referred to as 'elders' as though they are laymen? Any answers?

Yes, Mufti Ebrahim Desai has addressed and agreed with certain aspects of the anonoymous article, but it's his advice that we must take, not consider it a ticket to begin bashing our brethren.

Voice the issue to the people it concerns, not to the masses to rouse them. In the last line of his response, Mufti Desai advised that people should bring it to the attention of the Markaz elders, so that's what we should do.

Khair, alhamdulillah it has been brought to the fore, if somewhat distastefully.

Let us make dua that the matter is settled once and for all, in accordance with the sunnah of Rasoolullah (SAW).

Wisdom doesn't come easy. May Allah grant us all a share of it. Aameen.

Assalamu'Alaykum W.W.B.

I stick to my comments earlier. There is enough facts there to mull upon.
Insha-Allah Ta'ala, very soon the dust will settle, and the Truth will prevail. Watch this space.....

One to ponder on:
Hazrat Sa'eed Musayyib Radhi-Allahu-Anhu says: Hadhrat 'Umar bin Khattab and Hadhrat Uthmaan bin 'Affan Radhi-Allahu-Anhum used to debate a question so vehemently that an onlooker would be convinced they would never be reconciled. However, they always parted ways most amicably (as if nothing had transpired between them).

(Khaateeb, as quoted in Kanzal Ummaal (Vol 5 Pg 241)

This is from the ask imam website
Darul Iftaa received some replies on the above article, and these were forwarded to the writer of the article... following is the reply.

After the email on Tablighi Jamaat, for which I received less than expected critical response, I have to say, the only reason behind that email was to remind those at the top, that they are not immune from any form of criticism, and when ever they step out of line then they WILL be told, whether they like it or not.

What ever the case, I have total respect for Hafez Patel Saheb but I must say, I fear the time after him (I always make dua that Allah give him a long life.), It would be in the best Interest for the Public of UK as a whole, if Hafez Saheb appoints his son, the very Able Aalim e Deen, Moulana Saeed Saheb as his successor in his lifetime, Movlana is a very wise man, and he would I am sure fulfil the great responsibilities attached to the noble work, especially with people like Moulana Darwan Saheb around him. He should be included in the main Shuraa from now, I am confident that with Movlana's presence many unwanted publicity and unwarranted actions would itself be eradicated. I sincerely hope that public and Jamaati brothers endorse this view, and try their utmost to make this happen, so this noble work is protected from the mischief that many are predicting and foreseeing after Hafiz Saheb D.B.

Further, on the moon issue I am now looking at the eye witness account of the great sheikh Zakariya R.A, where he mentions that he saw the waning crescent with his own eyes on the 29th of Ramadhan before Fajar Salah, yet the authorities announced on the same night that the Hilal of Shawaal had been sighted. This is impossible. A further proof that the 'Ihtiyaat' that that should exist is just not there.(See below)

I was told that the eminent Sheikh Yusuf Motala D.B. in the first meeting of Jamiat/Hizb ul Ulamaa, that took place in Bury was also originally not happy with the decision of following Saudi, and with Movlana Yaqub Kavi Saheb, made it known to the other Ulama (who had come well prepared to declare Saudi as the country to follow) that he disagreed with their view. That first meeting was then thrown into chaos, in the second meeting when Movlana Yaqub was not present, and even Hadhrat initially not there, Hadhrat agreed reluctantly just for the sake of unity. ( at that that all the information we have now was not available, nor was technology that advanced, the communication structure we have today was not there) I am also told that some prominent members at that time directed their anger towards Hadhrat for siding with Movlana Yaqub Saheb Kavi, after which Hadhrat vowed that he will never involve himself in this moon mas'alah again. (to date this great man has stuck to what he had said). It is a pity that people left right and centre jump to take his name, when ever this issue crops up. If one is aware of the love Hadhrat has for his great Sheikh, then one can fully understand his view, yes he is totally not in favour of 'Saudi bashing' if you want to call it that. I am certain that if all the politics could be left behind, a correct formula based on sound Hanfi Fiqh was put in place Hadhrat despite sticking to his original vow to remain silent would not at all mind. It is this sound formula that we need to work for, although I must say Mufti Zubair Butt Has that, the Batley moon sighting committee has also come up with a sound formula, the Wifaq Ul Ulama in London has had one in place for the past two years. It is upto us now to have the guts to put in place this Sharia compliant formula in Yorkshire and other cities and towns, and it is about time that we showed the strength of our Imaan in practicing upon 'Wa Laa Yakhaafoona Lowmata Laa'im' In making our Ibaadat as correct as possible.

I am afraid we are going to have to work, and totally ignore those who oppose without knowledge, Now the truth is apparent, London and now Batley has showed us the way, it HAS BECOME EASIER FOR EVERYONE ELSE, and now we know, if this Mas'alah was correctly put forward to the public, the public will accept, as has happened in other places. In Bradford, where we have very able Ulama, we should also move forward and push for a 'Muhataat' ruling hoping that, what the Batley Ulama has achieved, we can as well.

May Allah help us and give us towfeeq. Aameen.

Note:

If any of what I have written is incorrect then do let me know, but please don't do what a misinformed brother did by sending me an email saying that every major decision of the Dewsbury Shuraa goes through Moulana Yaqub Kavi Saheb, and that he is consulted before any major decision. (if that was the case this moon situation would not exist in U.K.). what the brother wrote is 100% FABRICATION.

Wassalam

Some words from Mufti Ebrahim Desai Saheb regarding this account of Moonsighting:

" Kindly take note of the eye witnesses' account of Shaykhul Hadith, Hadhrath Moulana Muhammad Zakariyya Kandhalvi (RA). A brief explanation of the article is -

Hadrath Shaykhul Hadith states that he was in I'tikaaf on Masjidun-Nabawi. On the 29th Ramadan Sehri time he saw the moon setting, on the same night after Taraweeh the Imam announced in a soft voice "The crescent has been sighted and tomorrow and tomorrow is Eid". Hadrath states thus, the moon setting on the sehri of the 29th Ramadan and the same evening the crescent of Shawwal being sighted is impossible and insanity. This is against logic, Shariah (naql) and even against science.

Alhamdulillah, it is encouraging to note that now many honest and sincere Ulama are fulfilling their role of academic honesty in the moon issue and calling for a change. An Aalim of Deen and responsible people see facts and decide; emotions are not the path of an Aalim of Deen and responsible people.

Muftisays 5 Assalamu Alaykum

The statement above forms the end of the Moonsighting Criteria for Batley. I hope these serve to reiterate that in short, we are all working on the same side, and differences of opinion, by the majority at least, are amicable and conducted with academic eloquence, as per Sunnah.
