TheCouncil of Islamic Ideology (CII) has ruled that the construction ofMosques on encroached land is illegal and un-Islamic. A CII report saidthat without written permission from the owner of the land or without asale-deed, a mosque's construction was not only illegal, but alsoun-Islamic. It said that similar was the case with a Mosque built ongovernment-owned land in the absence of written permission. There are anumber of Mosques in Islamabad that have been built on encroached land,and during a project to expand Muree Road, the Capital DevelopmentAuthority had to demolish three such mosques. Firstquestion that comes to the reader's mind is that: Who are theprestigious scholars that are part of the so called "CII"? Are theyeven Scholars? Did they ever go to a Islamic School? If their statementis so true and definite, why are they hiding behind the title: CII? Didthe CII ever wonder about the Islamic rulings stated for the Mosquesand the Madrassas that are ALREADY in existence now? No, they didn't,because if they had, they would have realized that the destruction ofsuch places is not Islamic either!
Secondly,a great deal of confusion arises from the event's description. If onelooks at the history of these Mosques and Madrassas, one realizes thatthese places have been running peacefully for over 30 to 40 years. Ifthe places where the Mosques are built are illegal or somebody alreadyowns them, than why did it take the government 30 or 40 years torealize that fact? If what the government says is true, why was theconstruction of the Mosque allowed there in the FIRST PLACE? Was thegovernment sitting blind for 30 to 40 years and now all of a suddenthey had an epiphany or a dream that all those places are illegal? Allof these questions are legitimate and deserve a sound answer.
Forexample, Jamia Faridia's foundation was laid down in 1966. After someyears, the administration of the Madrassa hired F-6 flats toaccommodate more students. More students kept coming, so a place in themeadows of the Margalla Hills in Sector E-7 was acquired with the helpand cooperation of Seth Haroon Jafer (Late). This piece of land wasattached to an old Mosque, which was Waqf, gifted, land of anindividual. Consequently a Madrassa was constructed and started itsoperation. Finally, in 1984, the Madrassa was shifted in what is thepresent building of Jamia Faridia. Even if the official years of theMadrassa's existence are counted from 1984, the Madrassa has existedpeacefully for about 12 years; and now all of a sudden it has becomeillegal? What was the government doing during these 12 years? How cansuch a big building be constructed and be allowed to run for 12 yearsillegally? Were these buildings allowed to be built just so thegovernment can later have the pleasure of demolishing them?
Moreover,if there is such a case, in which the government thinks that a Mosqueis built on illegal grounds, a case should be filed at a court showingall the evidence that stands against that Mosque or Madrassa. Thegovernment has no right to go over and demolish the building withoutany proof. Of course the people will be appalled at such actions of thegovernment. Its common sense!
Anotherimportant aspect is that the Ulema said that the CDA(CapitalDestruction Authority) had given legal status to the Christian slumsand churches which had been built on encroached land, and the authoritywas discriminating against the Mosques and Madrassas by demolishingthem. Thesedemolishing plans are part of the same plan that included the bombingof the Madrassa in Bahjoor. The plan of the government is to destroyany traces of authentic Islam left in Pakistan. The government claims,even today, that the people killed in the Bahjoor Madrassa wereterrorists, but what the eye witnesses saw cannot be denied. They were7 to 20 years old children. They came to the Mosque to learn how toread Quraan. I guess learning how to read Quraan is an activity that ishighly popular among terrorists. If the government officials are sosure in their decisions, why is it that they never show any proof?
