Let me elaborate on that the method the Iraqi's are using to cut the head off leaves the victim alive until the very end. Slicing through the wind pipe and trachea will cause extreme pain and eventual death, as will the severing of the arteries.

Unfortunately for the person being beheaded death won't be instant and they'll live more than long enough to experience the beheading up until the point that the nerves/spine is severed. Practically until the beheading is completed.

Now keep in mind that these people who have been beheaded for the most part have been Civillians. There was talk of some of them being mercenaries but I think we can rule the latest victims out of that.
Beheading is permissible as a "Hadd" (Prescribed by Sharee'ah).

It is not permissble because a common person does not have the authority to sentence anyone to execution. It is not their responsibilty. Only a Qaadhi (Judge) can sentence one to execution.

Therefore, it is not Jaaiz Mutlaqan.

And Allah knows best.

Another question.
Say the iraq mujahideen (zarqawi lot) get hold of some one (like they are doing nowadays). Is it Jaiz to Kill the person?
Because there arent any qadhis nowadays in countries where there is war going on.

In addition to the above if the Iraqi's (Zarquawi lot) do get ahold of someone and that someone happens to be Muslim but working with the west would the permisibility of killing them differ?

Also let us assume for a moment that the care workers and civillina engineers that have been captured and killed by the Iraqi's are in reality just what the media claims them to be (charity workers, contractors, etc) do the rules concerning the killing of civillins apply?

In which case is it permissible to condemn the acts?

And is zarqawi lot classed as 'common person'?
Because there isnt an islmi hukoomat there...And he is the leader of some of the Iraqi mujahideen.

"They are not hostages but prisoners and according to Islamic law, they can be exchanged, set free or executed. All those who were killed were agents and partners of the occupation."

"The war effort is not restricted to those who just carry weapons. The war effort includes transport and supplies. Aren't supply lines part of military activity?"

"An Iraqi interpreter working for an American soldier - isn't that part of the war effort? Undoubtedly, all those killed were not civilians."

Regardles of civillian or not many of the prisoners/hostages they are killing are Muslim.

The method of execution is also far from Islamic, though I'll await the Ulema's verdict on this.

???

There's no proof that he's even in Iraq let alone him doing the beheadings. It's all media propaganda. We should research thoroughly and give our brothers/sisters in Islam the benefit of doubt.

I think most of what Ulamaa said covers everything. If you check all answers, they have in it answers for questions which are still being asked. The guest who posted the second post before this one... saying Far from Islamic, I think the media has got to the person because all Muslims know and realize that the propaganda is severe and sadly, the main victims of the propaganda are the minds of Muslims.

I think i'll gather the 3 or 4 different answers of the Ulamaa and post it later... InshAllah, it will clear up a lot of things.

Pardesi has also mashaAllah said very wise things.

Here are the 3 answers of Ulamaa I said i'd paste. Subhanallah it covers most things and above all, it leaves no ill feelings towards Muslim brothers and sisters who on one hand suffer, and on the other hand suffer the taunts of the likes of the previous post Guest.

Ulamaa ID 06 wrote:
In general, beheading in such a manner is not even permitted on animals let alone a human whether Muslim or Kafir. InshaAllah this should answer the question.

However, in matters of Jihad & war, many aspects of viewing a ruling significantly changes.
Ulamaa ID 02 wrote:
In the matter of Iraq, we do not have enough knowledge of who they were, who the executed ones were, who ordered the execution to take place and for what reason they taped the incident.

This is a political issue and the media do not give accurate or even close to accuarte information on what happened or why.

The incident in Iraq does not change any ruling in Fiqh regarding beheading.

Therefore, we can not judge whether it is Jaaiz (permissible) or not.

May Allah سبحانه وتعالى guide and help all the Muslims who are tortured and May Allah سبحانه وتعالى help all the Mujahideen who are being attacked night & day.

Wassalam
Beheading is permissible as a "Hadd" (Prescribed by Sharee'ah).

However, not in the way animals are slaughtered. in Hadd, when beheading, the person should be executed in one stroke.

The principal is to avoid any pain.

And Allah knows best.
