The question reiterated for you is that "Once the Islamic Institutions of a country are unanimous or near unanimous or in overwhelming majority in an opinion (i.e. Pakistan) then why should Muslims of that land consider the opinion of another singular Alim (from a foreign land) i.e. South Africa"?

You are right that not everyone in this forum is from Pakistan so replace "Pakistan" with "India" or "Britain" or any of the other countries in the list already provided to you and the question still remains. Which principles of "Taqleed" are you referring to?

The issue isn't about disrespecting someone's "personal opinion" but according to rules of Taqleed it is INVALID for Muslims to follow the lone opinion when it contradicts with unanimous or near unanimous or in overwhelming majority of opinion of Ulama.

You are welcome to disagree but in that case quote the principle (Usool) of the Madhab.

You are also free to follow any wrong or erroneous understanding (personally), all we are asking for is our notions of Taqleed to be corrected by you. We understand that there is no requirement in Islam to abandon the unanimous or near unanimous or in overwhelming majority of opinion of Ulama and make Taqleed of a singular Alim from a faraway land but if you don't believe us, please educate us.

In the Hanafi Madhab, distancing is allowed due to a valid excuse, in the books of Fiqh if there is an valid reason (obstruction, damage etc) distancing in rows is permitted.

From day one "Mufti Taqi Usmani (HA)" has said that according to Ulama Coronavirus classifies as a "valid excuse". Nobody is asking you to agree with the unanimous Ijtehaad of Ulama of Pakistan (for example) but repeatedly asking the same question again and again is absurd.

Thus once the excuse is removed, it will no longer be valid. Books of Fatawa are filled with queries like the pillar is in the way or the path is narrow and row cannot be formed in an adjacent manner.

The question which you guys are not answering is when there is a unanimous opinion and agreement of Ulama (e.g. Pakistan) then under which Usool (principle of Taqleed) should Muslims (of Pakistan) abandon the unified position of their Ulama and follow a singular Alim in South Africa?

Lastly, imagine if (this excuse) is invalid and void...The Salah in the Hanafi Madhab is still valid.

Read and argue from Fiqh and principles and not from your imagination and we are here for you and remember to quote the principles of Taqleed in your response.

I only want to know whether there has been such a precedent in islam.

As you know plagues and like diseases have occured in earlier times. So surely there must have been recorded history of what the ulema did during those periods.

Yes on social media may scholars were sharing historical acounts of how previous nations dealt with plagues. I think hafiz Ibn Hajar al asqalani r.a wrote a book on plagues as he lost some family members in some plagues.

I dont know because the current rulings that are being given by the darul ulooms, i have not read and heard.

I dont know any sahabas that practised this distancing in salaat during the plague of amwaas.

I dont know any tabieen or taba tabieen and any of our predecessors who have prayed in this new manner.

Plague broke out in thana bhavan during the times of hazrat maulana Ashraf Ali Thanwi rah. but i do not know about any such ruling given by him.

Just give an instance from history when such diseases broke out and the ulema told the awaam to practise this type of distancing in salaat.

Kindly note that i am earnestly asking and not challenging or debating

What was their understanding in their respected eras of how the plague/sickness that was afflicting them is transmitted? And based on that understanding would physcial distancing have reduced transmission?

For us muqallideen, it is sufficient that the majority of righteous scholars (ulama) have consensus that such distancing is permitted (and in some cases even required) and prayer will be valid.

For the sufi mizaaj among us:

'Hasanatul Abrar Sayyi'atul Muqarribin' (The good deeds of the righteous ones are considered as sins for the proximate ones). I would class those who disagree with distancing to be among the muqarribin.

Question: Does infection spread via Viruses?

Some of our brothers are speculating that infection does not spread via pathogens (virus, bacteria etc), we would like for them to respond to clear evidence as to why these precautions were taken if pathogens are infective.

Here, we are not saying that pathogens (virus, bacteria etc) are independent of the will of Allah Ta'ala because that would be Shirk so keep that in mind.

Part 1: Coronavirus (COVID-1) Quarantine and Isolation

Establishing quarantine is obligation for Muslims in areas which are hit by an epidemic and this is not a matter of dispute among Scholars at all.

Part 2: Coronavirus (COVID-1) Adopting Precautions

We have direct statements and actions from the Sahaba (RA) were they distanced themselves (will discuss during Salah later) because of fear of catching diseases.

ولم يرتفع عنهم الوباء إِلا بعد أن وليهم عمرو بن العاص، فخطب النَّاس، وقال لهم: أيُّها الناس! إِنَّ هذا الوجع إِذا وقع إِنما يشتعل اشتعال النَّار، فتجنَّبوا منه في الجبال، فخرج، وخرج النّاس، فتفرقوا حتّى رفعه الله عنهم، فبلغ عمر ما فعله عمرو، فما كرهه.


Distancing was enforced by Sayyiduna Amr Ibn Al-‘Aas (RA), when he took over as the commander-in-chief of Muslim forces in Syria. He publicly addressed the people, “O People, this (plague) is like wild fire so go to the mountains to safeguard yourself.” He then acted and so did the people, and everyone s
pread far and wide and placed (physical) distance between themselves
.

Policy of distancing was enforced by moving the entire military garrison further away from the population and into the hills. When Caliph Sayyiduna Umar (RA) heard about these measures (after the plague was countered), he did not object.

  1. We adopt 20 Rakaat of Taraweeh because it was endorsed by Sayyiduna Umar (RA)
  2. We are you not adopting distancingbecause it was also endorsed by Sayyiduna Umar (RA)?


Part 3: Coronavirus (COVID-1) Patients and Congregational Salah

Those who are suffering from a communicable illness should not come to the Masjid as Nabi (Sallallaho Alaihe Wassallam) has stated that being ill is an excuse to not come to the Masjid.

Part 4: Coronavirus (COVID-1) At-Risk and Congregational Salah

If you are advised to be at-risk of transmission (to yourself) or others then you have the duty to protect yourself (or others) as directly commanded by Nabi (Sallallaho Alaihe Wassallam)

These are valid excuses and reasons which are acceptable in the "Hanafi Madhab" and if you disagree please justify it from the Hanafi Madhab. I am not saying that these are all "obligations" but I am saying that they are acceptable in the Madhab for asymptomatic patients or in other words for those who do not actually have Coronavirus (COVID-19).

In the West, we are a step beyond this because the Government is forcing the closure of the Mosques and it isn't a Fatwa but an imposition upon Muslims.

I will leave this for 48 hours for people to argue/debate before turning to the issue of distance in Salah.

The Coronavirus pandemic is here.

We have to do the following

Turn to Allah by repenting from all sinful activities, leaving them immediately and making a firm determination of not committing them ever again.

Continuing the good devotional activities.

Taking expert medical advice seriously. It is a religious obligation to maintain health.

Remember all gatherings have to be avoided.

It is the time for seclusion (uzlah).

May Allah facilitate all for us and stop this pandemic with afiyet. Ameen!
