Just bury the body like one would bury trash or something else they want to get rid of. The point is such a ruh disobeyed and rejected Allah. Such a ruh is destined for the fire. Our loyalty, servitude, fear, love, everything is for Allah. Not the dead carcass of a mushrik.

This incident very adequately illustrates why we should be completely seperate from the mushrikeen/kuffar in all aspects of our lives as much as possible. This prohibition set by Allah is for our own good. Yet we think we know better.

Our iman is being eroded by our own hands because we feel we know what is better for us and this world. We should put aside everything we think we know and just follow the quran and sunnah as explained by our ulama.

Just do what Allah tells us to do even if we don't understand. Even if we think it's wrong. Even if we think it's harsh. Just trust in Allah.

This advice is for me before anyone else as I am in need of it more than anyone else.

Maulana said obviously the Muslims cannot participate in religious services of any other religion, they could have buried the person if they wished to offer assistance and there is no way they should be burned another human being.

Having said that since Maulana is Indian himself, he said that there could be two possibilities:

We don't know the situation which compelled them to do something like this
Maybe they were not knowledgable in Shariah

Either way, it is a sin and they should make Taubah.

About the positive publicity for Indian Muslims, Maulana (HA) said that that is upto Allah Ta'ala to bring results from actions and we should concentrate on actions and Muslims should avoid things like this.

I told Maulana that due to the prevailing circumstances of Indian Muslims, I did not want to publicise the issue (negatively) and he also agreed to let the matter rest.

الجواب حامداومصلیا ومسلما امابعد
غیرمسلم کے یہاں کسی کی موت ہوجائے تو اس کے اہلِ خانہ کی تعزیت جائز ہے۔
اورغیر مسلم میت کے گھر والوں کے لیے کھانے وغیرہ کا انتظام کرنا بھی جائز ہے۔(1)
لیکن غیرمسلم میت کو کاندھا لگانا،اس کی ارتھی اٹھا اوراس کی چتا کو آگ لگانا کسی مسلمان کے لیے ہرگزجائز نہیں ہے۔(2)
مفتی کفایت اللہ صاحب ؒفرما تے ہیں کہ:
“غیرمسلموں کی تجہیز وتکفین اورجنازہ کے ساتھ چلنے اور اُس کے جلانے میں شرکت کرنے یا اِس سلسلہ میں اُس کا مالی تعاون کرنے کی شرعاً اِجازت نہیں ہے، اِس لیے کہ یہ چیزیں اُن کے مذہبی شعائر میں داخل ہیں، اگرکوئی مسلمان اس میں شرکت کرے تو وہ سخت گناہ گارہوگا،جس کے لیے اس پرتوبہ و استغفارضروری ہوگا. (3)
اللہ تعالی نے قرآن مجید سورہ توبہ آیت 84میں حضرت رسول اللہ ﷺکو غیر مسلموں کی میتوں کے لیے دعا اور ان کی تدفین سے منع فرمایاہے۔ (4)
علامہ الوسی بغدادی لکھتے ہیں اس آیت میں رسول اللہ صلی اللہ علیہ وسلم کو اللہ تعالی حکم فرماتے ہیں کہ کفارکی میتوں کے پاس دعا کے لیے آپ صلی الله عليه وسلم نہ کھڑے ہوں اور نہ ہی ان کی تدفین کے لیے توجہ فرمائیں۔ (5)
انسانی جسموں کو انسانوں کے ذریعہ چتاؤں میں جلانا انسانیت نہیں بلکہ انسانیت کی توہین اور معصیت ہے، معصیت میں کسی بھی طرح شمولیت گناہ ہے۔(6)
جہاں تک غیر مسلم ارتھیوں کو کاندھا دے کریا ان کی چتاؤں کو جلاکر غیر مسلموں کی ہمدرد حاصل کرنے کی بات ہے، یہ سراسر غلط ہے۔ جوناسمجھ مسلمان غیر مسلموں کی ارتھیوں کو کاندھا دیتے اور ان کی چتاؤں کو جلاتے ہیں اُن مسلمانوں کوچور،اور انتہائی ذلیل غلام سمجھاجاتا ہے۔ غیرمسلموں کی ایسی متعدد پوسٹیں نظر سے گذری ہیں کہ عبدُل نے فلاں غیر مسلم کی چتاکو آگ لگائی ہے،لیکن میت کے ہاتھ میں موجود سونے کی انگوٹھی بھی عبدُل نے چرا لی،مسلمان چوری کے لیے چتاؤں کوآگ لگاتے ہیں ۔
یعنی چتاؤں کو آگ لگانے والے مسلمان اپنے متاع ایمان کا تو سودا کرتے ہی ہیں، ذلیل چوری اور رسواترین غلامی کا قلادہ بھی وہ اپنے گلے میں ڈالتے ہیں۔
ہزاروں سال سے ظلم کی چکی میں پسنے والی چمارقوم غالب اورحکمران طبقے کوخوش کرنے کے لیے شہروں سے باہرندی نالوں کے کنارے انتہائی عسرت وافلاس کی زندگی گذاررہی ہے۔اورظالم وحکمران طبقے کی خوشنودی کے لیے مردہ جانوروں کو شہرسے اٹھا کرلاتی، اس کی کھال نکالتی اورمُردوں کا گوشت کھاتی رہی ہے۔ تو کیاغالب ومستولی طبقہ نے بےچارے چماروں کے مذہب کوقبول کرلیا؟ یاچماروں کےتعلق سے اُن خوش پوشاکوں کے دل میں ہمدردی ومحبت کی روشنی پیداہوئی؟ہرگز نہیں!
یہی حال غیرمسلموں کی ارتھی کو کاندھا دینے اوران کی چتاؤں کوجلانے والے مسلمانوں کا ہوگا۔ یہ نہ گھر کے رہیں گے نہ گھاٹ کے ۔العیاذباللہ

وفی النوادر:جاریھودی او مجوسی مات ابن لہ اوقریب ینبغی ان یعزیہ ویقول ‘اخلف اللہ علیک خیرا منہ واصلحک (ردالمحتارمع الدرالمختارج9ص 556زکریا)
ویستحب لجیران اھل المیت والاقرباء الاباعد تھئیۃ طعام لھم یشبعھم یومھم ولیلتھم۔ (رد المحتار مع الدرالمختار ج 3ص 148زکریا)
(2)عن ابن مسعود رضي اللّٰہ عنہ عن النبي صلی اللّٰہ علیہ وسلم قال: من کثر سواد قوم فہومنہم، ومن رضي عمل قوم کان شریکًا في عملہ۔ (کنز العمال/کتاب الصحبۃ من قسم الأقوال2، 11 رقم: 24730
(3)مستفاد ازکفایت المفتی:ج 4ص203، فتاویٰ رحیمیۃ ج8 ص 180،فتاویٰ محمودیہ ج 14ص292، احسن الفتاوی ج 4ص232)

قال ابن کثیرتحت ھذہ الآیۃ: یأمر تعالی عبادۃ المؤمنین بالمعاونۃ علی فعل الخیرات، وھو البر وترک المنکرات، وھوالتقوی، وینھاھم عن التناصر علی الباطل والتعاون علی المآثم والمحارم (تفسیر ابن کثیر، ج2 ص10) فقط
