Breaking fast in ramadhaan to have relations but we are musafir is kaffarah necessary

السلام عليكم ورحمة الله I would like to ask a question In ramadhaan my husband and I went overseas.While we were fasting we broke our fasts to have relations my husband says because we were musafir at that time we don't have to keep kaffarah is this correct جزاك الله خيرا

الجواب حامداومصليا

When one intends to fast whilst traveling one should not break it but if one breaks it then only a Qadha will be necessary and not Kaffara.

ولو نوي مسافر الفطر…
قوله قال في البحر وكذا لونوي المسافر الصوم ليلا وأصبح من غير أن ينقض عزيمته قبل الفجر ثم أصبح صائما لا يحل فطره في ذالك اليوم ولو أفطر لا كفارة عليه اه
