Getting up late to start fasting

If I get up late in the morning to fast after Fajr Salaat , can I still say neeyat and start fasting?

One can make the intention after Subah Sadiq (Fajr time) as long as one did not eat food etc. However, It is virtuous to make Niyyah of fast during Subah Sadiq. (Al Fiqhul Hanafi Wa Adillatuhu Vol. 1 Pg. 363)
