My wife helped me All my life. While I am still alive I want to give her every thing, all my assets as a gift


بسم الله الرحمن الرحيم

الجواب حامداومصليا

It is permissible whilst alive you can gift all your property wealth to your wife.

If however, your in your final stages of life and made Wasiya (will) of the property wealth to your wife, it will not be permissible as she is already an heir.

Prophet (صلي الله عليه وسلم) said, “Allah has Himself given everyone, who has a right, his right. So there is no will for any inheritor.”

If other inheritors agree then only 1/3 of wealth can be given.

(إلا بإجازة ورثته) لقوله عليه الصلاة والسلام: لا وصية لوارث إلا أن يجيزها الورثة

سنن الترمذي ت شاكر (4/ 434)

2121 – حَدَّثَنَا قُتَيْبَةُ قَالَ: حَدَّثَنَا أَبُو عَوَانَةَ، عَنْ قَتَادَةَ، عَنْ شَهْرِ بْنِ حَوْشَبٍ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ غَنْمٍ، عَنْ عَمْرِو بْنِ خَارِجَةَ، أَنَّ النَّبِيَّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ خَطَبَ عَلَى نَاقَتِهِ وَأَنَا تَحْتَ جِرَانِهَا وَهِيَ تَقْصَعُ بِجِرَّتِهَا، وَإِنَّ لُعَابَهَا يَسِيلُ بَيْنَ كَتِفَيَّ فَسَمِعْتُهُ يَقُولُ: «إِنَّ اللَّهَ أَعْطَى كُلَّ ذِي حَقٍّ حَقَّهُ، وَلَا وَصِيَّةَ لِوَارِثٍ

و رواه أيضا ابو داود و أحمد و ابن ماجة و غيرهم

حاشية السندي على سنن ابن ماجه (2/ 159)

(فَلَا يَجُوزُ لِوَارِثٍ وَصِيَّةٌ) لِأَنَّهَا صَارَتْ بِمَنْزِلَةِ الزِّيَادَةِ عَلَى الْحُقُوقِ الَّتِي قَرَّرَهَا، وَلَا يَنْبَغِي ذَلِكَ
