Women travelling for Hajj

if a woman has her own money for hajj and a mahram available to take her, but husband says she cant go. Does she have to listen to husband or can she go for hajj

Respected questioner,



A woman travelling over the Shar'ee travelling distance must be accompanied by her husband or Mahram (unmarriageable kin).



This is a requirement for Hajj to become compulsory upon her.



This Mahram must be a male, mature and have a stable mind.



If a Mahram is available & all the other prerequisite conditions of Hajj are met then a husband can not stop her from performing her OBLIGATORY Hajj.

It states in Al Fatawa Al Hindiyyah:



وَعِنْدَ وُجُودِ الْمَحْرَمِ كَانَ عَلَيْهَا أَنْ تَحُجَّ حَجَّةَ الْإِسْلَامِ، وَإِنْ لَمْ يَأْذَنْ لَهَا زَوْجُهَا، وَفِي النَّافِلَةِ لَا تَخْرُجُ بِغَيْرِ إذْنِ الزَّوْجِ، وَإِنْ لَمْ يَكُنْ لَهَا مَحْرَمٌ لَا يَجِبُ عَلَيْهَا أَنْ تَتَزَوَّجَ لِلْحَجِّ كَذَا فِي فَتَاوَى قَاضِي خَانْ

[الفتاوي الهندية، كِتَابُ الْمَنَاسِكِ ، الْبَابُ الْأَوَّلُ فِي تَفْسِيرِ الْحَجِّ وَفَرْضِيَّتِهِ وَوَقْتِهِ وَشَرَائِطِهِ وَأَرْكَانِهِ]



It states in Al Jawharah:



ثُمَّ إذَا كَانَ لَهَا مَحْرَمٌ تَخْرُجُ لِحَجَّةِ الْفَرْضِ وَإِنْ لَمْ يَأْذَنْ لَهَا زَوْجُهَا لِأَنَّ حَقَّ الزَّوْجِ لَا يَظْهَرُ فِي حَقِّ الْفَرَائِضِ وَأَمَّا فِي التَّطَوُّعِ وَالْمَنْذُورِ فَلَهُ مَنْعُهَا وَيَجِبُ عَلَيْهَا نَفَقَةُ الْمَحْرَمِ هُوَ الصَّحِيحُ
