Urgent Inquiry Regarding Hajj During Iddah

Salaam, My father recently passed away, and my mother's iddah has now begun. Prior to this event, she had purchased a Hajj package and made full payment. The Hajj season falls within her iddah period, and we are seeking guidance on whether there is any flexibility that would allow her to travel. A key concern is that she had made a vow to perform Hajj, which is now obligatory upon her. She has already completed her first obligatory Hajj, and this is a separate vow that must be fulfilled as soon as possible. Additionally, she has spent a significant portion of her savings on this trip. Other considerations include: - I (her son) have also purchased a non-refundable Hajj package, and the funds for all our packages have already been deducted. - Due to personal constraints, I will not be able to perform Hajj in the future. - There will be no one available to accompany my mother for Hajj after this year. - She is aging and becoming physically weaker, making future travel more challenging. Given the difficulty of our situation, is there any dispensation within the Hanafi school—or another school—that would permit her to proceed with Hajj despite being in iddah? We would greatly appreciate your guidance on this matter. JazakAllah khair

It is necessary for your mother to complete the Iddat period. It will not be permissible for her to go Hajj. The vow she has made she can make someone do it on her behalf or make a Wasiyat (will).

ومع عدم عدة عليها أي فلا يجب عليها الحج إذا وجدت…..أية عدة كانت أي سواء كانت عدة وفاة أو طلاق بائن أو رجعي …العدة المانعة من سفرها
