Hazrat Shaykh Zakariyya nawwarallahu marqadahu wrote Al Etidal fi Maratib al Rijaal during those testing times, and his words of guidance hold true for the disagreements we see today.

Translation of bayan by Mufti Muhammad Naeem Sahab damat barakatuhu, Chancellor of Jamia Binoria, Karachi.

After khutbah masnoon

"And do not dispute (with one another) lest you lose courage and your strength depart, and be patient. Surely, Allah is with those who are As-Sabirin (the patient ones)."

"And hold firmly to the rope of Allah all together and do not become divided."

Respected Guests:

For some time now, disputes have arisen in the work of Dawat and Tabligh. Two groups have formed. One group calls itself the World Shura, and the other group claims amarat and has distanced itself from the former.

The work of Dawat and Tabligh was such that they had no disputes among themselves and they were a group whose aim was to enjoin good and forbid evil. Today that work has moved from its methodology, and is now divided into two groups. This was the one group globally that was sincere in its efforts for deen and they were united among themselves.

Allah taala has told us that if you dispute among yourselves then you will lose your courage and your strength. In another verse Allah taala tells us not to become divided among ourselves.

Firstly, Darul Uloom Deoband was and still is doubtless an important institution of ours. But it is obvious that the Akabir Ulama who used to be incharge of Darul Uloom Deoband have departed this world. The current Ulama present in Darul Uloom are not of the same caliber as the Akabir, so Darul Uloom Deoband has become partisan, and they have sided with one of the two groups of Tabligh. Because of this, Ulama have also become divided into two groups. Some Ulama have accepted the stance of Deoband, while others have rejected the stance taken by Deoband. This is why Darul Uloom Deoband should have exercised caution and not issued such a fatwa. Before a fatwa can be issued, many factors have to be taken into account. The current fatwa was given without taking all these factors into account, which is why the consequences of the fatwa have not been beneficial. This is why the reputation of Darul Uloom Deoband has suffered as a result of this fatwa, even though Darul Uloom Deoband is a great legacy left behind by our Akabir.

Secondly, regarding the objections that have been raised against Maulana Saad sahab, Maulana Saad Sahab has retracted from his statements both orally and in writing. When Maulana Saad Sahab has retracted his statements, Darul Uloom Deoband should have published his retraction, because this was morally binding on them. Darul Uloom Deoband have still not amended their fatwa to reflect Maulana Saad Sahab's retraction.

Thirdly, Allah taala has instructed Nabi Sallallahu Alayhi Wasallam to "Consult them (Sahaba) in matters," and 'whatever endevor you undertake, consult your companions.' Nabi Sallallahu Alayhi Wasallam was the Ameer and he was instructed to abide by Mashwarah. In another ayah the Quran says, "Their (The Sahaba's) matters are decided by mutual consultation." To say that there will be Shura without an Ameer, and the Faisal of the Shura will change every few days, this is completely against the Shariah, Quran, and Sunnah. No organization can be administered this way, where the Faisal is changed every few days. The end results of such a system will always be detrimental.

The dispute has escalated and each group is unwilling to accommodate the other. The aim of Maulana Ilyas Rahmatullah Alayh was Dawat and Tabligh. These two groups have moved away from this aim and have focused on disputing. When a jamat goes to a masjid, they are asked which group they belong to.

It should be clear that there can be no Shura without an Ameer. The Ameer should also make it binding on himself to consult with a shura. To say that the Ameer should only listen to a select group of people as shura is incorrect. It is incorrect to compel the ameer to such a condition. If the Ameer has designated a shura, like Siddique e Akbar Radiallahu Anhu, Hazrat Umar Radiallahu Anhu, and the other Khulafa, then to compel the Ameer to bind himself to only a select group is incorrect. As long as the Ameer is not openly sinful, he is not openly committing lewdness, in such a situation, in my opinion, to resolve the dispute, the Ameer should be followed.

Nabi Sallallahu Alayhi Wasallam had made Hazrat Usama bin Zayd ameer, and some companions objected because Hazrat Usama was the son of slave. It is not necessary that the Ameer should be of high birth, the best character, most charismatic. In my opinion, to resolve the dispute, the Amarat should be accepted. The Shura's assertion that there should be no fixed Ameer is completely against Islam and Shariah, and this stance is very disastrous. In this matter, the Akabir of Dawat and Tabligh should abandon their personal objectives and should forgive what has transpired, so that this matter can be put to rest, so that we do not become agents of division, but we become agents of unity.

In his last speech, Maulana Yusuf Sahab Rahmatullah Alayh had said, "Unite as an Ummah." This meant to forge unity and abandon disputes. This was his last sermon. If we were to read his last sermon once again, this would suffice for us.

Hazrat Ali's attacker Ibn Muljim was very punctual with exerting himself in prayer. Nabi Sallallahu Alayhi Wasallam had said Ali's assassin would be the worst person of the Ummah, because he caused division in the Ummah.

It is my sincere request that we abandon our disputes and find some way to unite. If we do not do this, we will become agents of strife in the whole world.

Wa Akhiru Da'wana Anil Hamdullillahi Rabbil Alameen.

پاکستان کے علماء کرام بھی ہمارے تاج ہے اور ہندوستان کے علماء بھی۔

لیکن ہر ایک کے میدان کا ایک دائرہ کار ہوتا ہے۔ جب پاکستان کے کسی مسئلہ کے بارہ میں ہندوستان کے علماء کی راہ معتبر نہیں۔ ٹھیک اسی طرح ہندوستان کے اندرونی معاملات میں پاکستان کے علماء کا فیصلہ معتبر نہیں ہاں اگر دونوں جگہوں پر جانکاری اور مشاہدہ ساتھ ہوجائے تو اور بات ہے۔

مفتی زرولی خان صاحب اور مفتی نعیم خان صاحب ہمارے محترم ہیں مگر ان کا ارباب شوری اور مادر علمی کی ذات پر حملہ کرکے ان کو ذاتی اغراض کا لیبل لگا کر مطعون کرنا قابل افسوس بھی ہے اور خلاف توقع بھی۔

مولانا سعد صاحب ہمارے بڑے ہیں اور ان سے اختلاف کرنے والے بھی ہمارے بڑے ہیں۔

دارالعلوم دیوبند نے صرف مولانا سعد صاحب کے غلط افکار و نظریات کی تردید کی ہے۔ ورنہ باقی امارت و شوری کے بارہ میں انکا موقف اول یوم سے یہ ہے کہ ہم اس میں کسی مداخلت کے روادار نہیں اور نہ ہی اس مسئلہ میں (جو کام کرنے والوں کا اندرونی مسئلہ ہے) حصہ لیتے ہیں۔

رہی بات دارالعلوم نے مولانا سعد صاحب کے رجوع کی تشہیر کیوں نہیں کی تو اسکا جواب یہ ہے کہ مولانا نے پہلے اس طرح رجوع نہیں کیا جس طرح ان کو رجوع کرنا ضروری تھا یعنی عوام میں (چونکہ جن باتوں اور بیانات کے بارہ میں انکی گرفت ہوئی تھی وہ انہوں نے عوام الناس کے کثیر التعداد جلسوں میں کی تھی) وہ انہوں نے کیا نہیں بلکہ پھر بار بار وہی غلطیاں کرتے رہے تو دارالعلوم نے ان کو اعتدال و جمہور سے ہٹ کر کام کرنے والا بتا دیا۔

یہ نہ تو مولانا سعد صاحب اور مولانا احمد لاٹ صاحب کا جھگڑا ہے اور نہ ہی کسی اور صاحب کا ذاتی معاملہ۔ یہ دعوت و تبلیغ کے مبارک کام کا مسئلہ ہے جو دن بدن اپنے حقیقی نہج و اعتدال سے ہٹ رہا ہے۔

اس لئے میری مفتی نعیم صاحب اور شیخ زرولی خان صاحب سے مودبانہ گذارش ہے کہ پہلے دارالعلوم دیوبند کے اکابرین سے مسئلہ کی وضاحت خود سن لیں اور بعد میں کوئی فیصلہ صادر فرمائے۔ ایسا مستعجل ہوکر بیان دینا آپ کے شان کے منافی ہے
