40. Muhammad said, "Abu Hanifa informed us saying, Hammad narrated to us that Ibrahim said concerning a man who cuts his nails or trims his hair [after doing wudu]. "Let him pass water over it.""

Muhammad said, "I heard Abu Hanifa say, 'Sometimes I cut my nails, trim my hair and do not pour water [over them] again until I pray.'"

Muhammad said, "We adhere to this and this is the verdict of al-Hasan al-Basri."

13. THE TOOTH STICK


41. Muhammad said, "Abu Hanifa informed us saying, 'Abu Ali narrated to us from Tamam from Ja'far ibn abi talib that the Prophet (salallahu 'alahyi wa sallam) said, "How is it that I see you coming to me with yellow teeth? Use the tooth stick (Miswaak). If it were not that I would cause my community hardship, I would tell them to use the tooth stick for every prayer."'"

Muhammad said, "The tooth stick is, in our view, a part of the Sunnah and ought not to be abandoned."

42. Muhammad said, "Abu Hanifa informed us from Hammad that Ibrahim said, 'Both men and women in ihram can use the tooth stick.'"

Muhammad said, "We adhere to this and this is the verdict of Abu Hanifa."

14. A WOMAN'S WUDU AND WIPING OVER HER HEAD COVERING


43. Muhammad said, "Abu Hanifa informed us from Hammad that Ibrahim said, 'Women wipe the hair on their heads, and it is not enough to wipe over their head-coverings.'"

Muhammad said, "We adhere to this and it is the verdict of Abu Hanifa."

44. Muhammad said, "Abu Hanifa informed us saying, Hammad narrated to us that Ibrahim said, 'It is not enough for a woman to wipe her temples alone, she must also wipe her head as men do.'"

Muhammad said, "As for us, we say that if she wipes the site of her hair and wipes that to the extent of three fingers then it suffices her, but we prefer for her to wipe [the entire head] in the same way as men do, and that is the verdict of Abu Hanifa."

15. GHUSL BECAUSE OF SEXUAL RELATIONS (JANABAH)


45. Muhammad said, "Abu Hanifa informed us saying 'Hammad narrated to us from Ibrahim taht, A'isha, the Mother of the Mu'minun, رضي الله عنه said, "When the two circumcised parts meet, ghusl becomes obligatory."'"

Muhammad said, "We adhere to this and it is the verdict of Abu Hanifa."

The term circumcised is used as this was the custom of the Arabs before Islam, women are not circumcised in Islam. This refers to the male and female sexual organs.

Muhammad said, "Abu Hanifa informed us, 'Abu Ishaq as-Sabi'i narrated to us from al-Aswad ibn Yazid that A'isha, the Mother of the Mu'minun, رضي الله عنه said, "The Messenger of Allah (salallahu 'alahyi wa sallam) would make love to his wife at the beginning of the night and sleep without touching water. Then if he woke in the latter part of the the night he would do it again and take a ghusl."'"

Muhammad said, "We adhere to this. There is no harm when a man makes love to his wife if he sleeps before taking a ghusl or doing wudu, and that is the verdict of Abu Hanifa."

47. Muhammad said, "Abu Hanifa informed us saying, 'Awn ibn Abdullah narrated to us from ash-Sha'bi that Ali ibn Abi Talib رضي الله عنه said, "It [the meating of the two circumcised parts] makes the payment of the dowry obligatory. It invalidates divorce. It requires the [observance of the] iddah period [after divorce or being widowed], and [yet] it doesn't obligate [the use of] a sa measure of water?"'"

Muhammad said, "When the two circumcised parts meet, then ghusl is obligatory whether or not one ejaculates, and that is the verdict of Abu Hanifa."

The sa is a measure of four cupped handfuls, a reminder that ghusl is best done with a little amount of water.

16. A MAN AND WOMAN DOING GHUSL BECAUSE OF INTERCOURSE FROM A SINGLE VESSEL


48. Muhammad said, "Abu Hanifa informed us from Hammad from Ibrahim from A'isha, the Mother of the Mu'minun, رضي الله عنه, that 'The Messenger of Allah (salalllaahu 'alaihi wa sallam) would take a ghusl with one of his wives from a single vessel both of them contending for the water at the same time.'"

Muhammad said, "We adhere to this, and we see no harm in the wife taking her ghusl with the husband, wether she begins before him or he begins after her, and that is the verdict of Abu Hanifa."

17. THE GHUSL OF A WOMAN WITH CHRONIC MENSTRUAL BLEEDING AND OF THE WOMAN WHO IS MENSTRUATING


49. Muhammad said, "Abu Hanifa informed us from Hammad that Ibrahim said concerning a woman qwith chronic menstral bleeding (mustahadah), 'She leaves Zuhr until the end of its time, takes a ghuls and prays Zuhr, and then prays Asr. Then she waits until when the time of Maghrib comes but does not pray until the end of its time, takes a ghusl and prays Maghrib and Isha, [doing that] until she is over [her chronic menstrual bleeding].'"

Muhammad said "We do not adhere to this, but we adhere to the other hadith that she makes wudu for the time of every prayer and she may pray up until the next [prayer] time. In our view, she has only one ghusl to make when the [customary number of] days of her period have passed, and that is the verdict of Abu Hanifa."

Muhammad said, "Ayyub ibn Utbah the Qadi of al-Yamamah informed us from Yahya ibn Abi Kathir from Abu Salamah ibn Abd ar-Rahman ibn Awf رضي الله عنه that Umm Habibah bint Abi Sufyaan asked the Messenger of Allah (salalllaahu 'alaihi wa sallam) about the situatin of a woman with chronic menstrual bleeding, and he said, 'She should take a ghusl when the [customary number of] days of her period have passed and then do wudu for every prayer.'"

Muhammad said, "We adhere to this Hadith."

18. THE WOMAN WHO MENSTRUATES DURING [THE TIME OF] PRAYER


51. Muhammad said, "Abu Hanifa informed us from Hammad the Ibrahim said, 'If a woman begins to mensturate during the time of a prayer she doesn't have to make make up for that prayer. When she becomes pure again during the time of the prayer, she should pray.'"

Muhammad said, "We adhere to this and it is the verdict of Abu Hanifa."

Muhammad said, "Abu Hanifa informed us from Hammad that Ibrahim said, 'When a woman is in need of a ghusl because of sexual relations and her period begins, she does not have to take a ghusl, because the menstruation she has is graver than the condition of needing a ghusl because of sexual relations.'"

Muhammad said, "We adhere to this. She does not have to take a ghusl until she is again free of her menstruation, at which time she takes a ghusl once for both of them together [the sexual relations and for the end of her menstruation]. That is the verdict of Abu Hanifa."

53. Muhammad said, "Abu Hanifa informed us from Hammad that Ibrahim said, 'If a woman's period ends during the time of a prayer, but she does not take a ghusl until the time of the prayer has gone, even though she was busy performing her ghusl, she does not have to make up that prayer.'"

Muhammad said, "We adhere to this. If the bleeding ceases at a time in which she is not able to to perform her ghusl before the departure of the time [of the prayer], she does not have to repeat this prayer. That is the verdict of Abu Hanifa, and Allah knows best."

19. WOMEN WHO HAVE GIVEN BIRTH AND PREGNANT WOMEN WHO EXPERIANCE BLEEDING


54. . Muhammad said, "Abu Hanifa informed us saying 'Hammad narrated to us that Ibrahim said, "If the woman who has just given birth hasn't got a definite time [when her bleeding normally stops], then let her wait for the number of days [which are usual] for women [of her family of her time]."'"

Muhammad said "We do not adhere to this, but she is counted as being in this condition for up to forty days. If [her bleeding] goes beyond that, then she takes a ghusl and performs wudhu for every prayer and she prays, and that is the verdict of Abu Hanifa."

(Because the Prophet (saw) appointed 40 days as the limit of the time for postnatal bleeding)
