Friday Khutbah, Masjid Al-Haram,

Makkah, Saudi Arabia

By Al-Eqtisadiah Newspaper, Saudi Arabia; Dated: 22 July 2011

Translated by: Omar Bouderdaben, ICOP Media Committee; Dated: 23 July 2011

Imam Al-Haram Al-Makki: There are no obstacles (deterrents, preventions) from benefitting from the modern means in the sighting of the crescent moon.

Imam and Khateeb of the Masjid Al-Haram in the Noble Makkah, Sheikh Dr Saud Al-Shuraim, advised the Muslims to be Allah conscious and to fear Him as he ought to be feared and to hold on to the strong rope of Islam.

And he clarified, in his Khutbah delivered on Friday at the Masjid Al-Haram, that the lunar calendar is among things with which Allah blessed the Muslim Ummah and made it as one of its characteristics where as the previous nations used the sun as the basis for their calendars, which is about 11 days longer than the lunar calendar. The calendar of the Arabs before the advent of Islam was based on the moon, in contrast to the others, and Islam asserted that method and accepted it.

He also pointed out that the moon is a sign of Allah’s signs used to warn His servants by its eclipse in this life and in the hereafter, that it is a disgrace to belittle it, and that it is of misguidance to use other than the lunar calendar. It is also wrong to raise children in a manner that makes them attached to pictures whether inanimate and animate subject and amongst these are the moon they represent with eyes and nose and things like that, or it has a mouth, or smiling or crying. It is a sign of Allah which should not be made fun or belittled.

He also pointed out that old nations and modern ones had some wrong beliefs that are outside of what Allah has created the moon for. Amongst these beliefs is the belief of the moon eclipses for the death or birth of people which the messenger, peace be upon him, denied.

The Imam and Khateeb of the Masjid Al-Haram added that a large group of those who interpreted Quran mentioned in their interpretations that some companions asked the messenger of Allah, peace be upon him, why is that the moon appears sometimes as a very thin crescent, then grows to become a full circle then decrease until it is as it started? Then Allah revealed the following ayah: “They ask you about the crescent moons, say they are fixed time for people and Hajj…(Quran 2:189). He also pointed out that there are some people that think that the Shar’i sighting of the moon is not in agreement with the calculations and it (Shari sighting) is only suppositions and not accurate compared to modern means while calculations are certain and precise. The answer to this is that the messenger, peace be upon him, was not unable to comprehend the details of things despite being unlettered. Revelation comes to him so that he, peace be upon him, conveys that which is much greater than that. He indeed described the seven havens and what is in them of the messengers on the ascension of the “Isra” as he described the “Masjid al-Aqsa” as it was (during the same journey with precise details). However his response, peace be upon him, above was short because his Ummah was more in need to the worship of Allah and their obedience to Him and the impact should be practical not theoretical, hence the answer “It is fixed times for people. This is what is beneficial to them.

He also clarified that whoever says in his (the messenger, peace be upon him) response there is disagreement with the science of astronomy, they certainly have committed a grave act against Allah and his messenger, peace be upon him. The book of Allah is greater than to be just a book of astronomy or chemistry or physics as some enthusiasts focus their goals on these points far away from being guidance and a light and success. And may be because of this they fall into three categories: First, a mental decline that makes them think that science is the criterion with which we should judge Quran and that Quran follows science, so they try to confirm Quran by scientific reasoning. The second is the lack of understanding of the reality of Quran and its message that the message is finite and does not accept examination or investigation because the one who said this is the one that nothing escaped Him on earth or in the heavens. And the third is to fall prey to the arbitrary interpretations and sophistication in directing the texts of Quran towards new knowledge and new theories that may be negated in the future. This should not be understood that we should not take advantage of the latest scientific inventions in expanding the meaning of the Ayat of Quran and demonstrate its miracles and that it follows Quran not the other way around.

He went on to say that, on this occasion, we ought to emphasize, with an open mind, that the discussion should be about the moon and the crescent and not let the difference in “mataali’” be the cause of harsh disagreement and conniving against each other. This matter should be approached with gentleness and Ijtihad that will get us to a common greater goal and that we should stay away from unfruitful debate.

Sighting [the crescent] by the human eye is the Shar’i method, but this should not be considered as contradictory to the use of telescopes or helpful  calculation to determine the sighting with more precision so that the differences could be united and the gap will be brought closer.

Also:

Shaykh (Shuraim) in Makkah said in the Jummah Khutbah, sumarised as follows:

The sheikh said sighting the moon is established in the Sharia, and this principle does not preclude benefiting from modern science and technology as these do not violate the principle nor contradict it. Examples of this include the usage of binoculars and mathematical calculations which assist in realising the sighting of the moon, or tahqeeq al-ru'yah. By this means, conflicting points of view can be unified and disputation lessened. He then quoted the following Hadeeth from Saheeh Muslim in favour of following local sighting:
Kuraib says: Ummul Fadle (RA) sent me to Muaviyah in Sham on an errand for her. I reached Sham. I fulfilled her request. While in Sham Ramadan began and on the eve of Friday we saw the Hilal of Ramadan. Then I came to Medina by the end of the month. Ibn Abbas (RA) questioned me and enquired about the Hilal. He said, "When did you see the Hilal?" I said "We saw it on the eve of Friday". Then he said, "Did you see it?" I said, "Yes, the people saw it and they fasted and Muaviyah too fasted." Then he said, "but we saw it on the eve of Saturday and we will continue fasting until we complete thirty or we see it." Then I said, "Is not Muaviya's seeing and his fasting enough for you? He said "No, That is what the Prophet (SAW) ordered us." (Muslim)

Fatawa

Mufti Ahmad Khanpuri(HA)

Darul Ifta, Jamia Ta'limuddin, Dabhel

Answer: it is stated in the"Mahmudul Fatawa" that Observatory's prediction and
astronomical calculations are not acceptable in terms of moon sighting. It is almost ijma.
Shaikul Hadith Moulana Zakariyah (R.A.) wrote in"Awjazul Masalik" that it is incorrect to
brand Mutraf Bin Abdullah (The Tabeea RA) as in favour of astronomical
calculation. (Awjazul Masalik v 5 p 16)........................................................

It is proven from above mentioned quotes that Astronomical calculations and observatory's
predictions have no value in moon sighting subject.
It is even proven as a unanimous
decision. Although some Shafee' scholars are supporters of Astronomical calculation, their
own experts had rejected this kind of opinion. Allama Shami (R.A) in his booklet "Tambihul
Ghafil" opened up a separate chapter on the very subject and questioned the opinions of
calculations. Furthermore he proved that it is an Ijma to sight the moon by naked eye. (See
Rasaeel e Ibn Abedeen v 1 p 246 to 249).

As it is proven that to begin the fast based on Astronomical calculation is not acceptable,
similarly if reliable persons come across and give testimony that we witnessed the moon;
this testimony will be taken under consideration, despite being opposite to astronomical
facts. Allama Shami did give a quotation about Allama Subuki that he is the supporter of
astronomical calculation but at the same time he provided other experts opinions of his
school that because of calculation witnesses cannot be ignored. Rather they will be
considered, as Prophet (SAW) regarded their testimonies as trustworthy status. (Raddul
Muhtar Ala Durril Mukhtar v 2 p 100)

It is clear from this discussion that if calculation says it is impossible to see the moon on a
specific day and Islamic witnesses say they saw the moon, in this instance witnesses will
be taken on consideration.
They will not be rejected because of calculation. Make
sure that the day of moon sighting is not less than 29 days since it is not the time to see the
moon. Prophet (SAW) month consists of 29 or 30 days. (Mahmudul Fatwa v 2 p 136 to 142)

1) The great Sheikh Hadhrat Maulana Shah Waliyullah (rh.)Muhaddith Dahelwi has also rejected the use of calculations and conditioning Establishing of Hilal on Astronomical calculations sighting evidence from Nusus - original texts.

2) It is mentioned in a fatwa of Darul Uloom deoband that

To base or to condition the Sharai Testimony upon Astronomic calculations, and to test Sharai testimony
against Astronomic Calculations and predictions is non-Sharai, illegal, non-admissible, and baatil (because such
a condition is an innovation in deen, AND it is against the practice and teachings of Prophet s.a.w. and
unanimous agreement and practice of all Companions r.a. and the Ummah)

3) Another similar Fatwa authenticating and endorsing that Testimony against theory was issued by a mufti from Majlisul Ulama

There seems to be great conflict between Wifaqul Ulama and Hizbul Ulam, both Deobandi.

Personaly, I agree with sighting the Hilal. InshaAllah I will find my previous banter about this and post it here too.

This is what I wrote in my email

The New moon is born today

This is a fact, lets see what we endup doing.

The Astronomical New Moon is on September 8, 2010 (Wednesday) at 10:30 GMT. This moon may not be visible anywhere on September 8 except some Polynesian Islands. On September 9, it will still not be visible in Northern Asia, Europe and Canada. It can easily be seen in New Zealand, Australia, South-East Asia, Africa and Americas on Sep 9.

Here is another email I sent on 2 October 2008

Must we do Eid according to the NEW MOON or HILAL What does Islam say?
What does The Quran say?
What did the Prophet do?
What did the Sahabas do?
What are the Saudis doing?
What are we doing?
What do the Jews do?
Is the New Moon the begining of the Islamic Month?
Or Is theHilal tha begining of the new month?
What did we do???

Allah says in the Quran

"O you who believe! Follow Allah; follow the Messenger and those of authority (Amr) amongst you." (Surah al-Nisaa Verse 59)

Abdullah ibn Abbas رضي الله عنه says that in this verse, 'Amr' refers to the jurists. This explanation is narrated from Mu'aawiyah ibn Salah from Ali ibn Talhah which is a sound chain, Al-Itqaan)

The verse continues, "And if you dispute, then refer to Allah and the Messenger if you really do believe in Allah and in the last day. (Surah al-Nisaa Verse 59)

Allah's statement subsequently "if you dispute..." proves that those of Amr are indeed jurists because He has ordered everyone else to follow them and then proceed to say that "if you dispute.." Hence Allah has ordered those of Amr to refer the disputed issue to the Book of Allah the traditions of the Prophet. The lay person would be unaware of how to refer the disputed issue to the Book of Allah and to the Sunnah and how their proofs would apply to the situations and events. Thus, it is established that the second command, is for the scholars. (Ahkaamul Qur'aan, vol 2, pg 257)

I dont think the Jurists refers to the committee! it is obviously the Ullema.

Are we Following the Ullema or the Committee.

From muslimah247, Jazakallah. I have put the full link for easy access.

http://www.hizbululama.org.uk/files/visibility_graphs.htm

The true path is the path of Islam, the path of Prophet Muhammad (SW)

Be vigilant and don`t miss the opportunity to perform the Sunnah of sighting the Hilal on the (Astronomicaly unconditioned) eve of 29th date, and don’t ignore witnesses because of ``theoretically calculated Visibility Graphs! ``

The world is a witness to the past and the present that the moon had been sighted even though calculations showed negative visibility on certain days. The recent moon sighting of ``Shawwal 1430H`` was sighted on the eve of Saturday 19th Sep 2009 in many countries including Pakistan and Saudi Arabia.

Be aware that the astronomical computations are not always the same in their ability to predict the moon`s visibility. They use diverse criteria and calculation theory, which also leads to prove uncertainty of the Visibility Maps.

Another example of calculated graphic is Graphed Moon faces by astronomicaly computerised ``Moon faces Clock ``,

The Visibility Graphs are only general predictions - so don`t take them too literally and don`t ignore testimonies.

See the email exchange on ICOP Group below:
...............................................
Dear brothers / sisters

Salaamun 'alaykum

I need to get some clarification on the calculation method used to give the prediction graphs on the ICOP website. Specifically with regards to height above sea-level. Does the calculation used take this into consideration or not? So, for example, in an area where the sighting is not possible, if someone were to climb to the peak of a high mountain, would it then change the possibility of visibility or not?

Was-salaam
T. R. Jaffer
...................
Hello,

The calculations apply a average visibility model. They do NOT take local weather conditions into account and they do not consider local elevation. You can easily see that from the perfect curves in the visibility graphs.

Climbing a mountain is just like climbing to better and better weather. Climbing a mountain can drastically improve the local seeing conditions in terms of dust and humidity and thus greatly improve your chances to see the more difficult crescents.

On the other hand, your own body will have more and more problems with the reduced air pressure at great elevations and thus going to high to fast might not be useful. Example: Driving from sea level to 4000m of elevation can be quite a problem for most people.

Regards,

Martin Elsasser
