@wifaq

Jzk for your efforts, individual organisations posting a refutation on its on own website is commendable but how many people visit their websites apart from Muslims after receiving a WhatsApp forwarded message. Wouldn't it be better to sue BBC and the times collectively for defamation?

Get the British Ulama (who are addressed) to agree and it will be done in a week, some of our Ulama don't agree with this methodology.

www.muftisays.com/forums/27-sharing-portal/10893-response...

Who and what is a Deobandee? Since the position is nuanced you can’t have a collective representing a nuanced position (in legal terms).
Money, resources, talent & will is at the disposal of Ulama. Defamation cannot be done collectively but on behalf of someone who is addressed directly by BBC, I hope you see the point (from a legal perspective), Insha'Allah.

wifaqululama.co.uk/society/45-bbcdeobandi

Many members of this forum are Deobandi but Deobandi isn’t a cult or sect with set rules which are mandated and enforced so how can an organisation like Wifaqul Ulama sue on behalf of such a nuanced and divergent group? This also happens to be why the Media targeting of “Deobandees” is nonsense because it isn’t monolithic.

I meant the individuals and organisations targeted by the media should sue collectively.

I guess this is where the zeal of the youths vs wisdom of the ulema comes in

dont want to sound pessimistic but all these responses are futile. i can show you 100s of emails iv sent to bbc and even if u speak firmly and nicely most they will say is we try to be impartial and give view of both sides we're sorry you feel it was unfair bla bla bla.

why aint the institutions and personalities who were defamed doing it themselves? if they dont do anything it will only encourage msm to do more hatchet jobs. personally i think this is jus the beginning. deos will be slaughtered for next few yrs on tv and papers

So the Ulemah dont want everyone complaining on their behalf, I was planning to complain... But fair enough If this is the position of the Ulemah then we should respect it.

The Media themselves, on certain occasion use in house Lawyers as a precaution to ensure the programme, is not in violation of Libel or defamation laws, and that there is not a threat of being sued, and check if they will have a strong basis to launch a legal defence in case they do get sued.

So what is the purpose of the Ulemah in having their statements checked by Barristers, before posting on their websites, unless they are afraid that the BBC might sue them?

Surely if they are hiring a Lawyer then statements should be written directly to the BBC on behalf of the Ulemah by a Barrister, who is a specialist on the Media and on defamation and libel laws, and who also has specialist knowledge directly of the BBC Producers Guidlines...The BBC's own Producers Guidlines is essentially a legal contract, if any part of this programme is in violation of the BBC'S Producers Guidlines the Barrister would be in a position to legally challenge, them, and if any part of the programme is in violation of Defamation and Libel Laws he wouldalso be in position to legallly challenge them..!

If you are paying someone to read and check a statement before posting on a website then you hire a Public Relations expert, who can point out how to effectively counter the arguments made in the Programme you dont need a Barrister for that, seems like a waste of lawyers fees ... all I can say is that it is equivalent to someone consulting with a Farmer to find out if they are using the correct ingredients to cook a particular dish, instead of consulting a chef.

Further more Lawyers come in all shapes and sizes and varying qualities, those who dont have day to day dealings with the media or specialise in this field, will be blissfully unaware that there is any such thing as a BBC producers guidelines.

Whole response from the Ulemah seems strange...As for suing The BBC when it comes to Muslims I have no doubt in my mind the BBC will hedge their bets, that in the present climate of rabid Islamaphobia, that a British jury will not vote in favour of a Muslim Plaintiff, regardless of the merits of the case, or how strong it is.

We have the example of Police Officers who tortured Babar Ahmed being acquitted despite incontrovertible evidence, both of audio recordings of the torture whilst it was taking place, and the photographic evidence and medical testimony on the aftermath of the brutal assault, the jury members as reported in the media after acquitting these officers despite the evidence then actually went and shook hands with them and congratulated them.

Many assumptions and a massive dose of conjecture on your part. I was trying to answer a query from the brother and trying my best to provide updates on activities in the background. Since my updates will cause further confusion I am deleting my posts and everyone is free to continue to discuss the matter as they see fit.

I will be unable to participate further due to time constraints.

Kindly have a little respect, and decorum when addressing the Ulema of Deoband who without a shadow of a doubt are the most righteous, and pious scholars walking the face of this dunya today.

Some deobandi guys think that if they criticize "Deobandi Ulama" brutally, they will be more unbiased, and more rational. Don't know whether it's inferiority complex or something else, in any case it's really awful.

It is narrated about Imam Abu Hanifah رضي الله عنه such was his respect for his tutor, Imam Hammad that Imam Abu Hanifah says; whilst in my home I never even stretched my legs towards the house of my tutor, despite living 7 streets away.

Reason we have deen in this country is because of the sacrifices of our Ulemah and indeed our elders as a whole we owe them a huge debt of gratitude... If One looks at situation of Muslims in other countries were they are a minority then truly what our elders have accomplished by the grace of Allah, is remarkable.

Such a harsh and enraged tone is highly inappropiate no one saying that our Ulemah are Masoom but simply that ettiquettes must be maintained... Indeed the gap between Ulemah and Laymen on some issues has been discussed on this forum such as the following excellent Blogspot by Brother Muadh Khan and with proper ettiquette www.google.co.uk/url?sa=t&rct=j&q=&esrc=s&source=web&cd=7...

Mash'Allah, agree with you.
Also the blog of brother that you shared is indeed a great writing, that discusses the subject "Ulama vs laymen dichotomy" very nicely mash'ALLAH.

Ulama are experts on Qur'aan and Sunnah and their expertise and remit is to work with Islamic Sharia. They are not politicians which means they don't lie, they don't cheat and they are not experts in twisting words and deception. Ulama like Maulana Sameeruddeen Qasmi (DB) have written commentaries in volumes and Allamah Khalid Mahmood Saheb (DB) have also written commentaries explaining Hadeeth to millions. That's what their job is and this is what they do. Ulama are honest, sincere people and they are neither used nor can be expected to act like "hypocrites" with a big smile on their face on BBC.

Maulana Yusuf Motala (DB) has served Islam for over 40 years and he is also neither a politician nor a public servant who BBC expects to drop his work and appear on Interviews based on an email. Who does BBC think it is? They don't contribute a penny to our Masajid or Darululooms so why should they be able to "summon" our Ulama on the drop of a hat? Why should they? If BBC asks me to come for an Interview at random I will have a few choice words which are too rude to be shared on this forum.

But for the sake of Islam, we will provide all the assistance to our Ulama and our Institutions for Islam to be represented, Insha'Allah.

We need to look after 3 million Muslims and that is everyone included. We don't want a wrestling match with the media but at the same time we are responding, will keep responding. There are multiple people working on these issues.

You have articles from Wifaq and you also see people like Brother Mukhtar responding on islam21c.com with his detailed analysis of whoiswho is these programs.

Nobody has been silent, it is not Ulama's job to respond it is the job of all of us because it is not the Ulama but ISLAM which is being undermined.

Yesterday Maulana Yunus appeared on BBC Asian Network to debate with a Qadiani and categorically stated without fear that we will continue to regard Qadianees as Kafir and our stance will not change. Maulana clearly explained the Aqeedah of Khatme-e-Nubuwwat to everyone on Live Radio.

Muslims on twitter are debating with Qadinaees and explaining our Aqeedah clearly so what is needed is Muslims like you to get on the bandwagon and defend Islam but do it wisely.

It's time to be wise and not to make the situation even worse, act wisely Insha'Allah. We have the ability to articulate our position in a calm, intelligent manner.
